- 0:01when the defense attorney was
- 0:03cross-examining the lead
- 0:05investigator he got a half about halfway
- 0:07through and the judge advised him to
- 0:10take the fifth which investigator was
- 0:12that this was Jimmy Patterson because
- 0:14Patterson had wir tap and the the grave
- 0:17site looking for a grave site confession
- 0:21the fact that a police officer took the
- 0:23Fifth Amendment to me as a jury that
- 0:25would be the end of their credibility I
- 0:27have never and I've testified I can't
- 0:29take hundreds of homicide trials I have
- 0:31never took a fifth amendment sitting on
- 0:33the web it's against self-incrimination
- 0:35and you're the you're the you're the
- 0:37you're the officer the lead officer in
- 0:38the case I can't imagine the judge
- 0:40allowing a capital murder case to
- 0:43continue when you can't cross-examine
- 0:46the lead investigator because he took
- 0:47the Fifth Amendment that's incredible
- 0:49but I'm going to tell you there's not
- 0:52one piece of direct
- 0:54evidence not really one piece of
- 0:56credible evidence why she should spend
- 0:5810 years on death row would certainly be
- 1:04executed you don't do that without a
- 1:07court order you just can't wiretap
- 1:09somebody listen to a conversation let
- 1:11alone the uh the video the Audio I mean
- 1:14that's police work 101 J you know that
- 1:16stuff I think that it should have been
- 1:18thrown that that whole thing should have
- 1:20been thrown out based on the
- 1:22investigator taking the Fifth Amendment
- 1:24if those things are true I think it's
- 1:25really big I mean uh to me it it sounds
- 1:28like darly could be the wrong woman
- 1:30in prison
- 1:34really and something like this we have
- 1:36all the circumstantial evidence I say
- 1:38you know what go through everything
- 1:41whatever it is if there's some DNA
- 1:43evidence blood fingerprints whatever
- 1:45take it all do it all test everything so
- 1:48we could then we could at least say
- 1:49listen we did everything the defense
- 1:51asked we checked it all out they got the
- 1:53Unexplained print and they they believe
- 1:56they have some DNA on the sock and I
- 1:58think that's why they got exhausted
- 2:00these things because imagine putting
- 2:02somebody there's no taking her back once
- 2:04you execute her it's

- 2:30around at Police Department this is
- 2:32Jerry pal from Court TV I'd like to
- 2:34leave a message for James patteron our
- 2:37investigation took on a new sense of
- 2:39urgency Reggie and I were becoming more
- 2:42and more convinced that an innocent
- 2:44woman might be sitting on death row and
- 2:46the Clock Was ticking it's about these
- 2:49two kids I mean they're the real victims
- 2:51in this they were their life was cut so
- 2:53short so fast Reggie what does it mean
- 2:55if Dolly's innocent I'm the wrong person
- 2:58in jail yeah and the right and the right
- 3:01person is still out there that's the
- 3:02real scary part man that a monster like
- 3:05that could be out there I tell you one
- 3:07thing i' be locking my
- 3:09doors the next day we had a bombshell
- 3:12dropped on

- 3:14us a story about Do's husband Darren
- 3:18that came from out of left field
- 3:21[Music]
- 3:30the next day we met with skip
- 3:31hollandsworth a local journalist who has
- 3:34covered dar's case from the very
- 3:35beginning beautiful area nice home he
- 3:37claimed to have information about dar's
- 3:39husband Darren that would blow our
- 3:41investigation wide open
- 3:45thanks if darly the victim says my
- 3:48husband Darren had nothing to do with it
- 3:51and the evidence and the prosecution
- 3:52goes with her why would they go after
- 3:54Darren why would they go after Darren
- 3:56yeah I got to know this defense attorney
- 3:59that was handling the appeals named
- 4:00Steven Cooper and he said to me Darren's
- 4:03father-in-law Bob key has suddenly
- 4:05remembered Darren coming to him a few
- 4:08weeks before the murder and
- 4:10saying I am broke I need to find someone
- 4:14who's going to break into my house steal
- 4:16all my stuff my furniture my jewelry my
- 4:20valuables hide it away in a U-Haul I
- 4:22will claim the insurance get the
- 4:25insurance money and I'll be back to even
- 4:27and then load up my house with the
- 4:29furniture that's been hidden away and I
- 4:31said well is that true and Cooper says
- 4:35go ask Darren go ask Darren so I made
- 4:37Darren at a
- 4:39restaurant and I
- 4:41said did you hire somebody to try to
- 4:43break into your home and burglarize it
- 4:46and there was this long silence and he
- 4:48says are you going to print this and I
- 4:50said yeah and he said okay I did it I
- 4:54was asking
- 4:56around and I said did you hire anybody
- 4:58he said I never hired
- 5:00anybody but I did let the word out the
- 5:04story changes everything if true because
- 5:08it provides a motive it provides an
- 5:11answer to a question that has haunted
- 5:13everyone why would someone break into a
- 5:16nicely lit home in the middle of the
- 5:18night on the culdesac of a pleasant
- 5:20little sub Suburban neighborhood and
- 5:23just walk in and stab two kids to death
- 5:26and cut the throat of their mother and
- 5:28slice her across the arm and then walk
- 5:30out well did you buy the story do you
- 5:32think it was for real did you Darren was
- 5:34hardly blameless there had been evidence
- 5:36that he had uh tried to get someone to
- 5:39steal his jaguar and take it to a Chop
- 5:41Shop when he was going broke in
- 5:431996 and there's always been the
- 5:46question of what did Darren do after he
- 5:50discovered that his children had been
- 5:52stabbed to death mhm
- 5:56and that mystery which the prosecutors
- 6:00never went into during the trial because
- 6:02their trial was focused solely on darly
- 6:06and what was your next question to him
- 6:08are you making up this story to give
- 6:11darly some wiggle room so when the court
- 6:13of appeals hears about this they might
- 6:16give her a new trial and what was his
- 6:17reply he said no and I said do you
- 6:22realize that this story if found to be
- 6:26true could put you on the spot and write
- 6:29in the her trigger of The Da he goes
- 6:32with a pause I want to tell you the
- 6:34truth but I don't want to do anything
- 6:37that might get me arrested and
- 6:39railroaded like darling
- 6:45did the outside chance that this could
- 6:48be true and maybe he set up his home to
- 6:50be burglarized and the word went out
- 6:53yeah this guy's looking to get his house
- 6:54burglarized and two guys one guy
- 6:56whatever comes out and does this you
- 6:59know know and it turns bad and he winds
- 7:01up killing two kids and and trying to
- 7:03kill Dary you know and it also leads to
- 7:06the other side of the right man wrong
- 7:09man who committed his homicide there is
- 7:11some Reasonable Doubt about this whether
- 7:14Dolly did this herself was she whether
- 7:16she was helped by her husband or whether
- 7:19he orchestrated this whole thing with a
- 7:22a burglary attempt that one terribly bad
- 7:25and two children wound up dead as a
- 7:27result the bloody shck wasn't the only
- 7:30piece of evidence that potentially
- 7:31linked Darren to the crime an appeal
- 7:34filed in the wake of dar's conviction
- 7:37set out a number of facts that argued in
- 7:39favor of reversing her guilty verdict
- 7:42first a hair and a murder weapon matched
- 7:44a known sample of Darren's hair second
- 7:47while darly suffered multiple knife
- 7:49wounds during the attack Darren was
- 7:51totally unharmed third that Darren had a
- 7:53powerful Financial motive to kill darly
- 7:56his business was failing and he was
- 7:58deeply in debt while darley's life was
- 8:00insured for a quarter of a million
- 8:02dollars and we also learned that because
- 8:04dar's attorney had represented Darren on
- 8:06another matter he couldn't argue that
- 8:09Darren might have been involved in the
- 8:12murders I don't even know how the judge
- 8:14would allow anything like that yeah it's
- 8:16quite strange I don't like that yeah I
- 8:19wouldn't like that if that was my
- 8:20attorney hey I want you to go after
- 8:23anybody that might be guilty in a case
- 8:25like this two young kids killed I mean
- 8:28it's a horrible crime
- 8:30[Music]
- 8:32how does he get out of that crime scene
- 8:34without leaving a Trice of
- 8:36blood what did he do get up and fly out
- 8:38of
- 8:41there after nearly 6 weeks investigating
- 8:44Dolly rouer's case we could finally see
- 8:46a light at the end of the tunnel we just
- 8:49found out that our request to meet with
- 8:51Dolly herself was approved Reggie and I
- 8:54were anxious to hear what she had to say
- 8:56but today was about a local mechanic
- 8:58named Barry f
- 9:00who was rumored to have been solicited
- 9:01by Darren back in the early 90s to take
- 9:04part in an insurance scam if Barry was
- 9:07involved in this supposedly conspiracy
- 9:10to commit a burglary in a home get the
- 9:12Intruder there that's a big thing you
- 9:15know and Darren just didn't want to get
- 9:17himself involved because he knows if he
- 9:19gets himself involved he's going to be
- 9:21taking Dolly spot guys like this always
- 9:24around somebody knows him you know yeah
- 9:29after a little asking around it was easy
- 9:32enough to find F it seemed everyone
- 9:34either knew him or knew someone who knew
- 9:40him you're Barry five can we ask you a
- 9:44question we wanted to talk to you about
- 9:47the the dolly Rodier case do you
- 9:49remember that yeah there were my
- 9:50neighbors over there well apparently
- 9:52there were allegations made about you
- 9:56and Darren that he wanted to maybe
- 9:59arranged for a burglary of his own house
- 10:02you remember that he didn't talk to me
- 10:04about it do you think dolly is the right
- 10:06person do you know anything about darly
- 10:07what kind of person she was I think he
- 10:09did it I think he did it the whole time
- 10:10you think he did it I think Darren did
- 10:12it I just think he snapped you think
- 10:15Darren SN yeah and when I went over
- 10:17there the the first thing he told me he
- 10:20said uh he said rough night he calleded
- 10:23it a rough night that's it that's it
- 10:25didn't say anything about the kids or
- 10:27anything but if he he did run upstairs
- 10:29and acted like he was asleeping or
- 10:31whatever he did or you know why why why
- 10:33why but why didn't he kill
- 10:35Dolly I think he tried and she just
- 10:38lived that's all I
- 10:43think he thought that Darren is the one
- 10:46that killed his children and cut his he
- 10:48kind of denied the stolen C thing that
- 10:52Darren ever came to him about his
- 10:56Jaguar F told us that he believed Darren
- 10:59had snapped due to his declining
- 11:02financial situation and had killed his
- 11:04two young boys in a blind rage the other
- 11:07thing we have to find out about Darren
- 11:09is any involvement with the Barry F you
- 11:11know what about that is there any truth
- 11:14to that and if so what was it I think at
- 11:17this point he also knows that his name
- 11:19is being dropped around oh yeah he knows
- 11:22you know that he's could be involved in
- 11:23this somehow information was now pouring
- 11:26in and we discovered that 1998 Darren
- 11:31had been given a li detective test
- 11:33according to the police he had failed it
- 11:36they made uh such a big thing about the
- 11:38lie detector test right and we heard it
- 11:40was confrontational and you know and I
- 11:43know that once you get into a
- 11:44confrontational position with the with
- 11:47the person that's taking a test you
- 11:48can't get an accurate reading on no no
- 11:51no you
- 11:52can't according to Darren's account of
- 11:54the lie detector results he had failed
- 11:57because the police had administered the
- 11:59to test him properly but we sat down and
- 12:01watched the tape for ourselves
