- 0:12what our stance is is that the
- 0:14attorney general has tried to create an
- 0:17intellectual argument
- 0:20that
- 0:20they can occupy the space between
- 0:24beyond a reasonable doubt and clear and
- 0:26convincing evidence they admit that that
- 0:29there is no evidence to convict damon
- 0:32thibodeaux that they say that under the
- 0:35terms of the statute he has to show by
- 0:37clear and convincing evidence
- 0:39that um he's innocent well
- 0:44paul connick joined in a motion to
- 0:46vacate his conviction
- 0:49and when you do that what you're saying
- 0:51is not there was a procedural error
- 0:54which should give damon thibodeau a new
- 0:57trial what you're saying is
- 0:59this man is innocent he deserves to be
- 1:02set free
- 1:04they're not looking at what happened in
- 1:07this case
- 1:08and they're not giving that any credence
- 1:11and that's and and they want to
- 1:14put him to tremendous expense time and
- 1:18effort all while he's not being
- 1:20compensated under the statute to come in
- 1:23and prove something that is a
- 1:26foregone conclusion
- 1:28based on the district attorney's action
- 1:31and we think that that's unconscionable
