- 0:08is not going to be seeking a new death
- 0:11sentence against scott peterson
- 0:13he was convicted in 2005 of murdering
- 0:15his pregnant wife lacey
- 0:17the d.a said the decision was made in
- 0:18consultation with lacey peterson's
- 0:20family
- 0:22justices said the death sentence could
- 0:24not stand because potential jurors
- 0:26were excluded after saying they
- 0:28disagreed with the death penalty
- 0:31peterson maintains his innocence a judge
- 0:34is considering whether to grant a new
- 0:36trial because of juror
- 0:37misconduct but again the breaking news
