- 0:19Senior solicitor at Laurent law Baristas
- 0:21and solicitors located in grangland
- 0:24Auckland New Zealand in this video I'm
- 0:27going to talk about character waivers
- 0:30principal Simon Laurent has previously
- 0:33presented a video regarding character
- 0:35waivers however we we thought at this
- 0:37point that someone should refresh the
- 0:39content and prepare a new video on the
- 0:41topic that person will be me
- 0:44the basic principle is that all
- 0:47applicants for visas in New Zealand must
- 0:49be of good character
- 0:51applicants are usually required to
- 0:53provide police certificates with Visa
- 0:55applications to show whether they have
- 0:57any criminal convictions
- 0:59if a police certificate from a
- 1:01particular country is required for a
- 1:03visa application but the applicant does
- 1:06not provide us it is highly likely the
- 1:08application will be declined
- 1:10it is important to follow the correct
- 1:13process for obtaining police certificate
- 1:15sentence as set out on the ironsid
- 1:18website to ensure the correct type of
- 1:20police certificate is obtained you can
- 1:23search for the phrase police
- 1:24certificates on the inz website to find
- 1:27the instructions for obtaining police
- 1:29certificates
- 1:31if a police certificate shows that a
- 1:33person applying for a Visa has no
- 1:35criminal convictions then all is okay
- 1:38however if a person's applying for a
- 1:41Visa does have one or more criminal
- 1:43convictions the situation can become
- 1:45more tricky that is the criminal
- 1:48conviction or convictions may require
- 1:50inz to approve what is called a
- 1:52character waiver
- 1:54the circumstances in which a person
- 1:57requires a character waiver for a
- 2:00residence and temporary Visa
- 2:01applications very slightly
- 2:05some examples of the type of criminal
- 2:07conviction which will require a
- 2:08character waiver as part of a residence
- 2:10application include any conviction
- 2:13involving prohibitive drugs any
- 2:16conviction involved in dishonesty any
- 2:18conviction of our sexual nature any
- 2:21conviction for which the person who has
- 2:23sends to a term of imprisonment any
- 2:25conviction involving violence any
- 2:28conviction for Dangerous driving driving
- 2:30Heaven consumed excess alcohol or
- 2:32driving heaven-consumed drugs
- 2:35and applicants will also require a
- 2:37character over as part of a residence
- 2:39application if they have made any
- 2:40statement or provided any information
- 2:42evidence or submission to immigration
- 2:44New Zealand there was false misleading
- 2:47or forged or if they have withheld
- 2:49material information
- 2:52some examples of the type of criminal
- 2:54conviction which will require a
- 2:55character over as part of a temporary
- 2:57visa application include any conviction
- 3:00against the immigration's citizenship
- 3:02and passport laws of any country any
- 3:05conviction for which the person has been
- 3:07imprisoned
- 3:08any conviction in New Zealand for which
- 3:11the court has the power to impose a term
- 3:13of imprisonment of three months or more
- 3:14this can require careful checking of the
- 3:17Crimes Act 1961 or the summary offenses
- 3:20Act 1981.
- 3:22any charge for an offense which on
- 3:25convictions which make would make the
- 3:26applicant an excluded person
- 3:29or if the person is under investigation
- 3:31or wanted for questioning for such an
- 3:34offense
- 3:35I have previously presented a video
- 3:37about exclusion issues this can be found
- 3:39on their website
- 3:41an applicant will also require a
- 3:43character waiver as part of a temporary
- 3:44visa application if they've made any
- 3:46statement or provided any information
- 3:48evidence or submission to immigration
- 3:50New Zealand that was false misleading or
- 3:53forged or if they have withheld material
- 3:55information
- 3:57it seems to me that the rules about
- 3:59circumstances in which a visa
- 4:01application will require character for a
- 4:04residence implication is stricter
- 4:05compared to applications for temporary
- 4:08visas
- 4:09this is probably because residence is
- 4:11more permanent and Carries greater
- 4:13rights and privileges competed temporary
- 4:15Visas so New Zealand may want to be
- 4:18especially careful about hurricanes

- 4:48wherever we have seen include assault
- 4:49robbery and having provided false
- 4:52misleading information
- 4:54the character waiver assessment process

- 5:06conviction how long ago it occurred
- 5:09whether the applicant has family in New
