Casey Anthony: Day 27, Lee Reveals the Family Secret? — Transcript

- 0:00We want to go back out live to West 2's
- 0:01Amanda Ober with our legal analysts. So
- 0:04Amanda, what do Jeff and Richard have to
- 0:06say about today?
- 0:08Well, they always have a lot to say,
- 0:09Aayixa, and it's always interesting. So,
- 0:11let's dive right in. Lee Anthony on the
- 0:13stand, and there was this very emotional
- 0:15moment where he started to break down
- 0:17and sobbed as he talked about how
- 0:19personally hurt he felt during Casey's
- 0:22pregnancy when his mom and his sister
- 0:24didn't talk to him about it. And just a
- 0:26personal observation here, I felt
- 0:28uncomfortable with his reaction. I
- 0:30thought, you know, 5 years later, you
- 0:32know, the secret might have hurt him,
- 0:34but where's that sobbing coming from?
- 0:36What do you gentlemen think? Well,
- 0:38Amanda, I'm not a psychologist, but I
- 0:40get to play one on TV. And um which is a
- 0:43little frightening. Yeah. Here's what I
- 0:45I I think. I think and I think it's the
- 0:48same problem that the state had when
- 0:49they called him. I don't know if you
- 0:50recall when Frank George called Lee and
- 0:51and they the state was kind of
- 0:52tentative. They didn't really know what
- 0:54Lee was going to say. I don't think they
- 0:55expected him to have this faulty, you
- 0:56know, selective amnesia type um thing.
- 0:59And I think that's the thing with Bias.
- 1:00I think Lee wants to save his sister's
- 1:02life. And I think he also doesn't want
- 1:04her to go to jail, period. But I think
- 1:06he's willing to go to a limit. And I and
- 1:08I think he at one point may have been
- 1:09willing to go over that edge for for his
- 1:11his sister. But once he was on the stand
- 1:13after staring at his parents while he
- 1:16was going to be I think asked to to
- 1:18reveal the family secret, which is
- 1:20supposedly a molestation or something
- 1:21like that, I think he backed out and
- 1:23he's like, "You know what? uh this as
- 1:24far as I want to go is like the family
- 1:26secret is we we hid the the pregnancy.
- 1:28So you think Bayz really thought at that
- 1:30point Lee was going to say something
- 1:33about the sex abuse, the alleged sex?
- 1:35You don't put someone on the stand
- 1:36unless you know what know what they're
- 1:37going to say or you expect them to say
- 1:38something and you don't keep asking them
- 1:40is there anything else unless you expect
- 1:42there to be something else. Well, you
- 1:43know, and a source this morning who had
- 1:46a conversation with Bayz said that Bayz
- 1:48hinted there was going to be explosive
- 1:51testimony from Lee and we didn't hear
- 1:53that. So, that's in line with what
- 1:54you're saying. Do you agree, Jess? Oh, I
- 1:55do. They have a sidebar. He's sitting at
- 1:58the sidebar. He starts to cry. He starts
- 2:01to weep in the thing. She uh Casey
- 2:04Anony's over there balling her eyes out.
- 2:07Uh the uh there's a big argument at the
- 2:10at the bench. They come back out. He
- 2:13asks the question, "Is there what were
- 2:14you upset about?" Because the state had
- 2:16already objected to that question to
- 2:18start with. What are you upset about? He
- 2:21can't talk. Everybody's moving to the
- 2:23edge of their seat. What are you excited
- 2:25about? What were you mad about? What
- 2:26were you upset about? Jeff Ashton's
- 2:29objecting to almost every word of it.
- 2:32They didn't include me. Okay, come on.
- 2:35Of course, that's what everybody thought
- 2:37he was going to say. He was Everybody
- 2:38thought he was going to say something
- 2:40about his father and her being molested.
- 2:42Uh he had already set that testimony up
- 2:44by the fact that he said that he
- 2:46recognized very early on that she was
- 2:48pregnant. her dad has already testified
- 2:50that he didn't know till very late that
- 2:52she was pregnant. They were all in the
- 2:53same environment. Everybody thought he
- 2:56was going to he was going to give up the
- 2:57ghost right then and it didn't happen.
- 2:59And that's the that's about the fifth or
- 3:00sixth time it hasn't happened. Wow. And
- 3:03you know, while we're having this
- 3:04discussion, something I want to point
- 3:06out for our viewers because the question
- 3:07continues to come up is uh people still
- 3:10wonder, you know, could Lee or George be
- 3:12the father of Kaye? And we know that
- 3:13paternity tests prove that that was not
- 3:16the case, that they are not the father
- 3:17of Kaye. But my question to you
- 3:19gentlemen is after lunch the state
- 3:21cross-examines Lee. What do they ask
- 3:23him?
- 3:26We don't know. We don't know. There's a
- 3:28great moment right there. I got nothing.
- 3:32Well, well, here's the thing. And that's
- 3:33the problem is I don't think anybody
- 3:35knows anymore what they will say. Okay,
- 3:37that is the problem the defense has. I
- 3:39don't think Bayz knows exactly what Lee
- 3:41will say. And here's the thing about
- 3:42Lee. I really think he's a wild card in
- 3:44this whole trial because he was the the
- 3:46first Anthony to get an attorney, Tom
- 3:48Luca. He was the he's the only Anthony
- 3:50to never have given a uh an interview.
- 3:53We've never seen him give more
- 3:55depositions or statements than are
- 3:56absolutely required of him. And we saw
- 4:00his really odd emotional display at
- 4:04Kayle's memorial where he was like,
- 4:06"CMA, I love you. CMA this CMA, I
- 4:09promise to protect you, CMA." And here's
- 4:11the thing. Um, what I haven't gotten out
- 4:13of Discovery is that Lee was a
- 4:15particularly close uncle. When I mean
- 4:17close, like he he replaced the father
- 4:19figure in her life. And so that's why it
- 4:21struck me as odd that I don't think he
- 4:23was talking to Kaye Marie Anthony. I
- 4:26think he was talking to Casey. I agree,
- 4:28Anthony. And and so he's clearly the
- 4:31wild card in here. But Amanda, here's my
- 4:33opinion of what I think the broader
- 4:34picture is. what we're seeing with Cindy
- 4:36and what we're seeing with Lee. And as
- 4:38you point out about who the father is,
- 4:40the subtext to what's going on and bias
- 4:42is I I think he's making the point very
- 4:44subtly and very clear to the jury. The
- 4:46subtext is this family does have
- 4:48secrets. Um, and he's making that point
- 4:51by literally making that point with each
- 4:53witness. He's making the point that
- 4:54Cindy's only willing to say enough to
- 4:57help, you know, Casey without also
- 5:00throwing her the rest of her family
- 5:01under the bus or herself. Lee is willing
- 5:03to say enough to help Casey and throw an
- 5:06instant reasonable doubt, but he's not
- 5:07willing to to go that far. Basically,
- 5:09they're willing to reveal enough of
- 5:10their family secrets to try to help out
- 5:12Casey, but no more than they absolutely
- 5:13have to. So, may this jury only end up
- 5:17getting hints and implications that
- 5:20there was sex abuse, but never really
- 5:22hearing someone testify about it. I
- 5:24can't imagine that if they had evidence
- 5:25of that that you wouldn't have already
- 5:26heard it. Okay. Uh that's a uh point
- 5:29that they stressed in the opening
- 5:30statement. It's a moment that they could
- 5:33have had at the very beginning of the
- 5:34trial. They could have had it a couple
- 5:35of times in the state's case. They've
- 5:38set it up a couple of times in their own
- 5:39case, including uh yesterday and today.
- 5:42And I can't imagine that there's some
- 5:44direct evidence out there that nobody's
- 5:46seen yet and that they have just failed
- 5:48to ask. That is a big point in their
- 5:50defense. They've locked themselves in.
- 5:52They did it again today. The judge
- 5:53reiterated what their defense was.
- 5:55They've affirmed that again. At some
- 5:57point, you're going to have to hear
- 5:58that. Yeah. What? Let's talk about that
- 6:00moment this morning when the judge said
- 6:02to the defense, "Okay, guys, what is
- 6:04your defense theory?" The judge had
- 6:07cited a case uh right before that. And
- 6:09without going into the technicalities of
- 6:11what the case said, what it actually
- 6:13said was uh is that what a defense
- 6:17presents uh as far as what's relevant in
- 6:19a defense case is pretty liberal. If it
- 6:21goes to anything that has to do with one
- 6:23of their defenses, then the judge has to
- 6:25let it in. and he alluded to some
- 6:26pictures that he let in that he didn't
- 6:28think that might be relative about the
- 6:30ladder and the window and the pictures
- 6:32of the videotape and things like that
- 6:34with uh Casey playing with her daughter
- 6:36because they go indirectly at least to
- 6:39the defense that she drowned. Uh that
- 6:43point of law is really weighing on this
- 6:46judge right now. He is walking a very
- 6:49thin line about what he's excluding
- 6:51because of the objection of relevance
- 6:53that Jeff Ashton keeps making. It's not
- 6:56relevant. It's not relevant. You know
- 6:57what? It almost all is relevant.
- 6:59Especially this uh evidence of about the
- 7:02affair. this river cruise uh person. Uh
- 7:06if he wasn't getting along with his wife
- 7:09at the time and he was having an affair,
- 7:12it is not a far leap to say that he
- 7:15wouldn't have confided in his wife that
- 7:18her granddaughter had drowned and that's
- 7:20why she doesn't know, but he does. That
- 7:23I don't know if they've made that
- 7:24argument to this judge, but at some
- 7:26point that's relevant. and and Amanda,
- 7:28we've the question's been asked of us
- 7:30just about every day we've been here is
- 7:32um will Casey Anthony testify? How can
- 7:34they get in this evidence without Casey
- 7:35Anthony testifying? And I think we're
- 7:36seeing how they could get in the
- 7:38evidence without Casey Anthony
- 7:39testifying because remember Bayas gave
- 7:41this very graphic description of of a
- 7:42sexual act between George and Casey. And
- 7:45all of us, I think, assumed it either
- 7:46would have to be George or Casey that
- 7:48would testify to that event. However, um
- 7:51if another person walked in on that
- 7:53event, they could then testify to that
- 7:55event. Um, and I think that that's how
- 7:58Bayz hopes to get in. I don't know that
- 8:00we're necessarily done with Lee Anthony
- 8:02or Cindy Anthony either. I wouldn't be
- 8:04surprised if Lee Anthony goes, "Well,
- 8:05there is something else I wanted to say
- 8:06and I just I just couldn't bring myself
- 8:08to say it, but now I can." Um, because
- 8:10it bias is almost doing the same thing
- 8:11the state did in their case and chief.
- 8:13He's now that he's got the forensics out
- 8:14of the way, he's going to start going
- 8:15through the family dynamic
- 8:16chronologically and he's going to start
- 8:18building up to it. And I think that
- 8:19that's why he's going to kind of end
- 8:22with, you know, something big. I I I
- 8:24still don't think Case is going to
- 8:25testify, but I think someone's going to
- 8:27come forward and lay a bombshell about
- 8:29that supports Bias's theory. I you know,
- 8:31maybe at the end of the day, we were all
- 8:32wrong and Bias was really right. Maybe,
- 8:35but you know, cuz he's proving us wrong.
- 8:37I I think the last few days I I don't
- 8:38think anybody knew expected yesterday
- 8:40about Cindy saying, "I searched for
- 8:42chloroform." Um I don't think anybody
- 8:44expected Lee to come on here um and do
- 8:47what he did. And I think we were all
- 8:48screaming on our TV and our computer
- 8:49monitors, "Say it, say it, say it." And
- 8:51then he didn't say it. But the fact is
- 8:54he did get on there and he made some
- 8:55kind of emotional output for that we
- 8:57none of us even thought about him doing.
- 8:59So I think there's more to come from the
- 9:01Anony's and uh stay tuned. Well and and
- 9:04that leads beautifully to our my next
- 9:05question. We come back after lunch and
- 9:08uh the state will do we've got some loud
- 9:10sirens going by. The state will do their
- 9:13cross-examination of Lee. Um is it
- 9:17possible that Jose could continue to
- 9:19press him maybe during rebuttal on this
- 9:21issue of the sex abuse? Well, he can
- 9:22recall him if he needs to, so there's no
- 9:24no real need to re uh to have a rebuttal
- 9:26this time. Uh I think that
- 9:29um this is pure speculation on my part,
- 9:32but I don't believe that uh Jose Bayas
- 9:36100% of what we do is speculation. 100%
- 9:38of it. And let me tell you that those
- 9:40sirens weren't for Richard. So, uh, the,
- 9:43uh, the the point of it is though is I
- 9:45think that Jose Bayz expected Lee
- 9:48Anthony to say, uh, something about, uh,
- 9:52something along the lines of what
- 9:53Richard was alluded to. I don't think he
- 9:55expected the answer he got. I don't
- 9:57think anybody did because that was a lot
- 9:59of argument. I think Jeff Ashton, just
- 10:01by his sheer number of objections, was
- 10:04expecting the very worst and it just
- 10:06didn't happen.
- 10:08Absolutely. I I I think Jeff was is
- 10:10scared that it that it would occur as
- 10:12Bias was hoping it would occur. And um I
- 10:15don't think we're done with Anony's what
- 10:16we will see with these law enforcement
- 10:17people that are there. I think they're
- 10:18going to be brought in by Bayz to say,
- 10:20"Wasn't true Miss Anthony was confused
- 10:21on these days or she she exhibited some
- 10:23kind of confusion? Isn't it true there
- 10:24was some problems in front of evidence?"
- 10:26I think he's going to bring these people
- 10:27in now to kind of bolster what the
- 10:28confusion that they've testified to so
- 10:29far. Okay. All right. Richard Hornsby
