  12. 0:26right after kathy's disappearance
  13. 0:30uh once the news broke it was
  14. 0:33in the tabloids wasn't it yes it was
  15. 0:36and that's something that's anathema
  16. 0:39to the durst
  17. 0:43very existence isn't it yes meaning of
  18. 0:46course that
  19. 0:49you didn't want that out there
  20. 0:52like that
  21. 0:55that's correct not much you can do about
  22. 0:58it though
  23. 0:58if the tabloids start running with a
  24. 1:00story is there that's correct
  25. 1:04is it true that the story alone
  26. 1:08could have had enormous economic
  27. 1:12impact financial impact on the durst
  28. 1:15organization
  29. 1:16that was a concern but it did not happen
  30. 1:19but you were concerned about it yes
  31. 1:21and you're also concerned
  32. 1:26about kathy your sister-in-law
  33. 1:30seymour durst daughter-in-law being
  34. 1:33missing
  35. 1:34yes and so
  36. 1:38i assume that you tell me if i'm correct
  37. 1:41that you and others in the durst
  38. 1:44organization were paying close attention
  39. 1:46to what the police were doing and what
  40. 1:48was going on in the investigation
  41. 1:53uh i i don't recall
  42. 1:57uh i recall reading about in the papers
  43. 2:00but i had no contact with the police
  44. 2:04well did you did you believe that they
  45. 2:06were
  46. 2:07they were thoroughly investigating it
  47. 2:09last foundation
  48. 2:15if you had believed that the police had
  49. 2:18dropped the ball
  50. 2:18you would have done something wouldn't
  51. 2:20you objection assumes facts not in
  52. 2:23evidence at this point it's also vegas
  53. 2:25time relevance as well the time is clear

  55. 2:33i had no reason to believe they dropped
  56. 2:35the ball i don't know what i would have
  57. 2:37done if they believed they did
  58. 2:38well you know that seymour was doing
  59. 2:40everything he could

  62. 2:51bring to the table any kind of economic
  63. 2:56needs that would be needed to try to
  64. 2:59find her

  66. 3:04yes and bob uh
  67. 3:09gave every appearance of wanting to find
  68. 3:12her at the time didn't he

  71. 3:26there have been allegations through the
  72. 3:27years and there's even
  73. 3:30a lawsuit pending now there's a lawyer
  74. 3:33with that lawsuit
  75. 3:35staring at you from the
  76. 3:39gallery here that accuse
  77. 3:42you or the durst organization or seymour
  78. 3:45or even
  79. 3:46mr luing lewin of colluding
  80. 3:50to cover up kathy's disappearance right
  81. 3:55that allegation has been made i can
  82. 3:57speak for my family but not mr lewin
  83. 4:02well you're insulted by it aren't you
  84. 4:07and you know that seymour would not have
  85. 4:11done anything to cover up bob's
  86. 4:14complicity if he believed that bob was
  87. 4:17complicit
  88. 4:18that is correct yes although seymour
  89. 4:21loved
  90. 4:22bob right yes and
  91. 4:25and he felt somewhat responsible for
  92. 4:28bob's
  93. 4:34injured condition right
  94. 4:37that would be my belief yes
  95. 4:40that came from a feeling of
  96. 4:44responsibility whether he's responsible
  97. 4:45or not but a feeling of responsibility
  98. 4:47that bob had been
  99. 4:49there when your mother fell to her death
  100. 4:54uh i don't know that that was
  101. 4:57that was the cause of it uh uh
  102. 5:00bob which obviously had issues
  103. 5:05even before uh my mother's death or my
  104. 5:07mother's death
  105. 5:11well you've made the statement before i
  106. 5:14believe
  107. 5:14that seymour felt responsible for bob
  108. 5:18being damaged
  109. 5:19what was the basis of that statement
  110. 5:23that you have made that statement i have
  111. 5:24made that statement yes
  112. 5:26what was the basis for that statement
  113. 5:28that uh
  114. 5:29some things uh seymour had done
  115. 5:33or not done that caused bob to be the
  116. 5:36way he is
  117. 5:42and the way he is is unusual
  118. 5:45to say the least didn't it to say the
  119. 5:47least
  120. 5:48yes do you have any
  121. 5:52knowledge about the autism spectrum and
  122. 5:56asperger's foundation i just asked him
  123. 5:59if he had any knowledge about it
  124. 6:02you might have no i have no knowledge of
  125. 6:06the autism spectrum okay

  127. 6:30seymour felt some responsibility
  128. 6:33and even though seymour loved bob
  129. 6:39seymour would not have protected bob

  136. 7:14soon after they were together

  141. 7:28still the strain relationship that you
  142. 7:32had most of your life yes
  143. 7:36but your relationship was enough
  144. 7:40wasn't it to know that that seemed to be
  145. 7:43a time in bob's life when he was really
  146. 7:45happy

  149. 7:54made him come back and join the durst
  150. 7:56corporation don't you
  151. 7:58absolutely i dispute that but he did
  152. 8:01come back and join the durst corporation
  153. 8:03right
  154. 8:04he did come back did you know what that
  155. 8:06was about i mean
  156. 8:07if he was happy with kathy running a
  157. 8:10natural food store
  158. 8:12out in the country my understanding that
  159. 8:14the food store
  160. 8:15failed
  161. 8:19okay
  162. 8:23so we be clear about bob's leaving
  163. 8:26the durst company you know i'm jumping
  164. 8:30around a little bit but so we can be
  165. 8:31clear about that
  166. 8:33about bob leaving the durst company
  167. 8:36it started when you used your influence
  168. 8:39to have
  169. 8:40to make sure that he was not going to be
  170. 8:42named the successor trustee right
  171. 8:44that's correct and that happened like
  172. 8:47three years before
  173. 8:49seymour made the decision
  174. 8:53that you would be the ceo that is
  175. 8:56correct
  176. 8:57so it would be
  177. 9:01incorrect for someone to say that
  178. 9:04bob left because seymour made that
  179. 9:07decision
  180. 9:08that's just not correct which decision
  181. 9:10the decision
  182. 9:11to make you ceo instead of him
  183. 9:16if somebody said that that would be
  184. 9:17incorrect yes in my opinion
  185. 9:20right your opinion is that
  186. 9:23you're the one that saw the necessity
  187. 9:26for be
  188. 9:27becoming the successor trustee rather
  189. 9:30than bob
  190. 9:31yes and you brought that about yes
  191. 9:53you made an effort to stop the
  192. 9:55production of all good things didn't you
  193. 9:58i did it it was
  194. 10:01in conjunction not the only reason of
  195. 10:04course
  196. 10:04but in conjunction with your
  197. 10:08feeling that the durst name needed to be
  198. 10:11protected
  199. 10:14yes and you also tried to stop
  200. 10:18production of the jinx didn't you
  201. 10:22uh
  202. 10:25we we tried to limit it but i don't know
  203. 10:28that we actually tried to stop it
  204. 10:30did you write a letter uh threatening
  205. 10:35jarecki about what he was doing and
  206. 10:39if he i believe if he defamed the

  209. 10:50earlier today that
  210. 10:54at one point you thought that jarecki
  211. 10:56was working in concert with bob
  212. 10:59to help bob and to hurt the durst
  213. 11:01corporation is that am i saying it
  214. 11:03correctly is that what you thought
  215. 11:06i don't think he was doing doing it to
  216. 11:09help bob or hurt the tourist
  217. 11:10organization i think he was doing it to
  218. 11:12help

  224. 11:32mr lewin asked you about whether bob was
  225. 11:34generous

  228. 11:42but were you aware that he has
  229. 11:46given people money in the past
  230. 11:50where he gave money to susan berman i've
  231. 11:52read he's given gifts to uh
  232. 11:56his friends yes yes in fact
  233. 12:02i want to show you something that's in
  234. 12:05evidence
  235. 12:06if we can have mainly wolf

  240. 12:41this is a check susan berman
  241. 12:44for 25 000 that's the one that you were

  250. 13:10endorse checks and the checks would go
  251. 13:13go to you get to check in your statement

  324. 17:04organization would probably be aware of

  330. 17:18the durst organization or try to break
  331. 17:20the trust or whatever

  394. 19:48to be an act of generosity or ulterior

  409. 20:20call from san francisco
  410. 20:22uh in february 2002 a collect call did
  411. 20:24you recall that
  412. 20:25you do revolving so the best of your
  413. 20:27knowledge was your brother tom living in
  414. 20:29the san francisco area in 1982
  415. 20:32i really can't say i don't recall based

  417. 20:36knowledge and experience are you aware
  418. 20:39of any durst family members
  419. 20:41living in pay phones
  420. 20:44in barnegat new jersey or ship bottom

  425. 20:54family members were living
  426. 20:56in your paypal so if those calls
  427. 20:58emanated from pay phones
  428. 21:00the calls that i asked you about from
  429. 21:02new jersey would those be consistent
  430. 21:03with the kind of phone numbers that
  431. 21:05would be accepted
  432. 21:06by durst employees

  457. 22:06from mavis tire shop
  458. 22:09yes you've now seen the phone records is

  462. 22:16that the collect call from mavis tire
  463. 22:18was made on february 2nd
  464. 22:20and not february 1st 1982. that is

  467. 22:27it says whether it was done this or that
  468. 22:30and then he said that's correct
  469. 22:31so it doesn't the answer doesn't

  549. 25:26with the young children in the house
  550. 25:31and one thing that sticks out in my
  551. 25:34memory is that
  552. 25:35i hung a swing
  553. 25:39on a tree outside a window really
  554. 25:42responsive
  555. 25:43really i'll allow the witness to explain
  556. 25:46his answer
  557. 25:48and bob bob cut the swing down
  558. 25:51made my children very upset so it wasn't
  559. 25:53a good rule good
  560. 25:54it wasn't just the drugs it was just the
  561. 25:56whole relationship
  562. 25:58and were the issues that you had which
  563. 26:01caused you
  564. 26:02to want bob and cathy to leave were they
  565. 26:04issues with
  566. 26:05bob or were the issues with kathy or the
  567. 26:08issues with both who were the issues
  568. 26:09with the issues
  569. 26:10with bob um
  570. 26:14at any point in time either when you
  571. 26:16lived with kathy or
  572. 26:17afterwards did you ever see her
  573. 26:20exhibiting
  574. 26:20signs that she was a drug addict no i
  575. 26:23nervous those times
  576. 26:24her being a drug addict um you also said
  577. 26:28you were asked about
  578. 26:29bob's phone call when he told you about
  579. 26:31kathy being missing
  580. 26:32and your words were that he seemed
  581. 26:35distraught when he told you the cat
  582. 26:37is missing do you recall that testimony
  583. 26:38i do yes do you know if he was actually
  584. 26:40distraught
  585. 26:42speculation um overall
  586. 26:48he did he did not seem as distraught as
  587. 26:52i would have been if my wife had was
  588. 26:54missing for three days
  589. 26:56and to whatever level he appeared
  590. 26:58distraught do you know if that was
  591. 26:59genuine
  592. 27:00speculation over overall
  593. 27:04do you remember my question i remember
  594. 27:06your question and
  595. 27:08uh there's no almost no emotion that bob
  596. 27:11shows that is genuine
  597. 27:14and let me ask you something
  598. 27:17given your relationship with your
  599. 27:19brother
  600. 27:21i want you to assume the father i want
  601. 27:23you to assume
  602. 27:25that bob durst has killed his wife would
  603. 27:27you expect him on the phone
  604. 27:28to say hey douglas uh sunday night
  605. 27:32i killed my wife kathy no he would not
  606. 27:34say that
  607. 27:35whether bob was guilty or innocent would
  608. 27:37you expect bob
  609. 27:39to tell you or to attempt to appear
  610. 27:41distraught over his missing wife
  611. 27:44he would attempt to appear destroyed yes
  612. 27:49there was also you testified in response
  613. 27:51to mr dagaran
  614. 27:53that quote that bob gave every
  615. 27:55appearance unquote that he wanted kathy
  616. 27:57found
  617. 27:59again do you know if the quote
  618. 28:02every appearance was genuine speculation
  619. 28:08the question is whether he knows not not
  620. 28:10whether it was
  621. 28:11do you know if it was genuine i do not
  622. 28:13know if it was genuine
  623. 28:17do you have any idea you were asked
  624. 28:20about
