21. 0:50premeditated murder of Joseph
22. 0:52Otero in regards to count two it'll be
23. 0:56the Judgment order and sentence of the

26. 1:02by him delivered to the custody of the
27. 1:04Secretary of Corrections to serve the

44. 1:43Joseph Otero Jr in regards to count five
45. 1:47will be the Judgment order and sentence
46. 1:49of the court that you Dennis L Raider be
47. 1:51taken by the sheriff of Sedrick County
48. 1:53Kansas and by him deliver to the custody
49. 1:55of the Secretary of Corrections to serve
50. 1:57the term of life for the death
51. 1:59premeditated murder of Katherine brigh
52. 2:02in regards to count six it will be the
53. 2:04Judgment order and sentence of the court
54. 2:06that you Dennis L Raider be taken by the
55. 2:08sheriff of cedri County Kansas and by
56. 2:10him delivered to the custody of the
57. 2:12Secretary of Corrections to serve the
58. 2:14term of life for the premeditated murder
59. 2:17of Shirley banne in regards to count 7
60. 2:20it will be the Judgment order and
61. 2:22sentence of the court that you Den
62. 2:24alator be taken by the sheriff of sedway
63. 2:26County Kansas and by him delivered to
64. 2:27the custody of the Secretary of
65. 2:29Corrections to serve the term of life
66. 2:31for the premeditated murder of Nancy
67. 2:34Fox in regards to count 8 it will be the
68. 2:37Judgment order and sentence of the court
69. 2:39that UD Dennis El Raider be taken by the
70. 2:41sheriff of Sedrick County Kansas and by
71. 2:43him delivered to the custody of the
72. 2:45Secretary of Corrections to serve the
73. 2:47term of life for the premeditated murder
74. 2:49of marine hedge in regards to count n it
75. 2:53will be the Judgment order and sentence
76. 2:54of the court that you Dennis L Raider be
77. 2:56taken by the sheriff of CED County
78. 2:58Kansas and by him delivered to the
79. 3:00custody of the Secretary of Corrections
80. 3:02to serve the term of life for the
81. 3:04premeditated murder of Vicki wagly in
82. 3:07regards to count 10 the state has
83. 3:10properly filed with the court a request
84. 3:12to impose the sentence pursuant to uh
85. 3:15the hard 40 statute as it is commonly
86. 3:18required referred to excuse me that was
87. 3:20done on the 27th of excuse me that was
88. 3:23done actually on about the 3rd day of
89. 3:26May 2005 there were two
90. 3:30allegations of aggravating
91. 3:33circumstances those being that the
92. 3:35defendant committed the crime in order
93. 3:36to avoid or prevent a lawful arrest of
94. 3:38the
95. 3:39prosecution I find that the evidence in
96. 3:42this case and also pursuant to State
97. 3:45versus hiin bottom 264 Candace 593 State
98. 3:49versus
99. 3:52Marsh State versus Bailey which is a
100. 3:55case I prosecuted State
101. 3:58versus Walker also a case I prosecutor
102. 4:01that that factor does in fact exist
103. 4:04there's an additional
104. 4:06factor that was the factor of this being
105. 4:10especially heinous
106. 4:12[Music]
107. 4:17cruel heinous atrocious or cruel manner
108. 4:20that the homicides were committed in
109. 4:23based upon the evidence which I did hear
110. 4:25from the deputy uh Captain Sam Houston
111. 4:30in regards to the fact that the uh
112. 4:33victim Dolores Davis in your
113. 4:37opinion knew what was going to happen to
114. 4:39her knew her that you were going to kill
115. 4:40her and you took two to three minutes to
116. 4:43suffocate her that that is a homicide
117. 4:47committed in an especially hangous
118. 4:50atrocious or cruel matter it will
119. 4:52therefore be the Judgment order and
120. 4:53sentence of the court that UD Dennis L
121. 4:55Raider be taken by the sheriff of SED
122. 4:57County Kansas and by him delivered to
123. 4:59the custody of the Secretary of
124. 5:00Corrections to serve a term of life for
125. 5:03which you will not be proo eligible
126. 5:05until the expiration of 40 years I will
127. 5:08assess yes I could interrupt the
128. 5:11findings that you've made regarding the
129. 5:12aggravating factors I believe the law
130. 5:14says that you must make a finding that
131. 5:16those have been proven Beyond A
132. 5:17Reasonable Doubt I am going to do that
133. 5:19okay and that they're not outweighed by
134. 5:21mitigation I am going to do that as well
135. 5:24I will pronounce that sentence as I
136. 5:26indicated you will not be cor eligible
137. 5:28for 4
138. 5:30years I have found that those
139. 5:33aggravating factors existed and I will
140. 5:35find that those aggravating factors
141. 5:38beyond A Reasonable Doubt outweigh any
142. 5:41mitigating factors and circumstances
143. 5:43which
144. 5:44exist I have heard some statements in
145. 5:47regards to mitigating factors but no
146. 5:49evidence has been produced the
147. 5:51statements I've heard in regards to
148. 5:52mitigating factors are that uh you had
149. 5:56uh cooperated with law enforcement that
150. 5:57had not in fact taking the case through
151. 6:01trial I do not find that those outweigh
152. 6:03the aggravating factors existing here in
153. 6:06I will assess the cost to the
154. 6:10defendant I will give the parties
155. 6:13approximately 30 days to make
156. 6:16determinations in regards to restitution
157. 6:18and miscellaneous court cost also I will
158. 6:22give the parties 30 days to argue
159. 6:26relative to the recommendations of
160. 6:29conditions of
161. 6:30incarcerations all the court can do
162. 6:32Under the statutes in existence at the
163. 6:34time is to make recommendations it's
164. 6:36entirely up to the Secretary of
165. 6:37Corrections what they will or will not
166. 6:40do all right I would suggest that we
167. 6:43obtain a date for hearing these
168. 6:46particular matters please obtain that
169. 6:48date from my Aid is there anything
170. 6:50further to put on the record at this

175. 7:05that evidence is of
