  1. 0:00Hello, everyone. I am Professor Joaquim
  2. 0:17Comini. We are starting our unit C.
  3. 0:21Before we learn how trademark
  4. 0:23registration or patent applications
  5. 0:26work, we need to answer a more basic
  6. 0:29question. Why seek this protection?
  7. 0:34Imagine a person who creates a name for
  8. 0:37their business, invests in advertising,
  9. 0:40and some time later discovers another
  10. 0:42company using a very similar brand. Or
  11. 0:46imagine someone who dedicates time and
  12. 0:49resources to developing a new
  13. 0:50technological solution. It is precisely
  14. 0:54in this context that industrial
  15. 0:56property protection becomes important.
  16. 0:59Let's look at the slide. In this image,
  17. 1:04folks, notice why we protect brands and
  18. 1:07inventions at the INPI. Observe that
  19. 1:12creating something and legally
  20. 1:14protecting what was created are
  21. 1:16different situations. In the case of a
  22. 1:20brand, the INPI states that
  23. 1:22registration is an instrument used to
  24. 1:25obtain exclusivity over the name or
  25. 1:27image that identifies a specific
  26. 1:29product or service. This can be very
  27. 1:34important for a company that has
  28. 1:36invested time, money, and marketing
  29. 1:38into building an identity with its
  30. 1:40consumers. For patents, the logic is
  31. 1:45different. When a patent is granted,
  32. 1:49its owner gains the right to prevent
  33. 1:51third parties from producing, using,
  34. 1:54offering for sale, selling, or
  35. 1:56importing the protected object without
  36. 1:58their consent. Within legal limits, the
  37. 2:04owner may also authorize third parties
  38. 2:07to exploit the patent they created
  39. 2:10through a license. So, notice that
  40. 2:15protection can produce significant
  41. 2:17economic consequences. A brand or a
  42. 2:21technology can be transformed into an
  43. 2:23asset for a person or a company.
  44. 2:27Therefore, seeking protection should
  45. 2:30not be seen merely as filling out a
  46. 2:32form at the INPI. It is a way to
  47. 2:36increase legal certainty, reduce
  48. 2:39potential conflicts, and allow what was
  49. 2:41created to be used and exploited in a
  50. 2:44legally organized manner. And this is
  51. 2:48the question we must ask when someone
  52. 2:50presents us with a creation. Is there
  53. 2:53an appropriate way to protect this? So,
  54. 2:58my friends, throughout this unit, we
  55. 3:00will learn exactly how to answer that
  56. 3:02question. First, we will learn about
  57. 3:05brands and understand how their
  58. 3:07registration works. Then we will study
  59. 3:10patents, from identifying a possible
  60. 3:13invention to the procedure before the
  61. 3:15INPI. Keep this idea in mind. Creating
  62. 3:20is important; protecting is too. I'll
  63. 3:22stop here. I am Professor Joaquim
  64. 3:24Comini. Best regards.
