- 0:02This is a case about a man who was
- 0:03guilty until proven innocent. Andrew
- 0:07Malkinson always maintained that it
- 0:09wasn't he who violently raped a woman in
- 0:12Manchester 20 years ago.
- 0:15But a jury had found otherwise. Their
- 0:17verdict based on identification
- 0:19evidence, not DNA or forensics.
- 0:23When a jury finds you guilty when you
- 0:25are innocent,
- 0:27reality does not change.
- 0:30You know you did not commit the crime.
- 0:35But all the people around you start
- 0:36living in a false fantasy universe
- 0:39and treat you as if you are guilty.
- 0:43On the 2nd of August 2003, I was
- 0:45kidnapped
- 0:46by the state.
- 0:49It has taken nearly 20 years to persuade
- 0:51my kidnappers to let me go.
- 0:54In that time, he made three attempts to
- 0:57appeal, each one denied.
- 1:00The body which refers cases to the Court
- 1:02of Appeal dismissed his application to
- 1:04investigate DNA evidence, not once, but
- 1:08twice. He spent nearly three times the
- 1:11specified period
- 1:14imprisoned
- 1:16because he would not
- 1:18falsely confess
- 1:19to abhorrent crimes which he did not
- 1:23commit.
- 1:24Today, Mr. Malkinson's lawyers argued
- 1:26his conviction be quashed not just
- 1:27because of the new DNA evidence, but
- 1:30also because of the way in which he was
- 1:32convicted in the first place. They say
- 1:34there were failings in both the trial
- 1:36and appeals processes and a denial of
- 1:38disclosure, which means members of the
- 1:40jury didn't have the full picture when
- 1:42they delivered the guilty verdict.
- 1:46Today, the Crown Prosecution called it
- 1:48sad that evidence came too late. Greater
- 1:51Manchester Police have now interviewed
- 1:53the man whose DNA does match that found
- 1:56on the victim's clothes. Their
- 1:58investigation in that matter continues.
- 2:01But on Andrew Malkinson, the force said
- 2:03it is sorry for a grave miscarriage of
- 2:05justice. It was a litany of failures by
- 2:08Greater Manchester Police. The
- 2:09Independent Office of Police Conduct
- 2:11will review this matter. Uh and if there
- 2:14are shortcomings, then I think it's
- 2:15important to consider criminal
- 2:18criminal investigation.
- 2:21At last exonerated, Mr. Malkinson will
- 2:23now have his name removed from the sex
- 2:26offenders register.
- 2:27He has found justice, perhaps, but
- 2:30Andrew Malkinson is still looking for
- 2:33answers. Sadiya Chowdhury, Sky News, at
