- 0:23this regular council meeting on today,
- 0:25May 26, 2026
- 0:28to order at 6:04 p.m.
- 0:37Okay, and before we move into agenda
- 0:40approval, I have missed to actually read
- 0:43um the opening statement that uh Pat had
- 0:45drafted for us um a few weeks ago um
- 0:49around um
- 0:51public um
- 0:54uh meetings
- 0:56conduct. Sorry, this glare is kind of in
- 0:58the way.
- 0:59And um I'm going to go ahead and reread
- 1:02it um just to make sure that we are
- 1:04setting agreements and expectations
- 1:06amongst those in the audience with us
- 1:09over here on council and with our staff
- 1:11to make sure that we have a smooth
- 1:15um
- 1:16conversation and meeting altogether
- 1:19today.
- 1:20Um the standard opening statement
- 1:23Uh before we begin, I want to remind
- 1:25everyone that this is a public meeting
- 1:27held to conduct the city business. We
- 1:29welcome public attendance and value
- 1:31engagement. However, disruptions
- 1:33including shouting, interrupting
- 1:34speakers, or other disorderly conduct
- 1:36are not permitted. Anyone who engages in
- 1:39such behavior may be asked to leave so
- 1:41the meeting can proceed. Thank you for
- 1:43your cooperation.
- 1:45And so um we will be reminding folks um
- 1:49first reminder during a minor
- 1:50disruption, then it will escalate to a
- 1:53formal warning,
- 1:54and then there will be direction to
- 1:56remove the disruptive individual from
- 1:58the gallery.
- 2:01And we may call a recess if needed.

- 3:44an item that we vote on. We

- 3:48public public comment to to do that
- 3:51before we we vote. Also, um
- 3:54I don't know what you guys feel about
- 3:56the the approval of PSA for city
- 3:59attorney. I know he's here. I don't know
- 4:01if we want to move that up and maybe
- 4:04even have him take the oath of office
- 4:05and and have him sit in today. I don't
- 4:07know what your feeling is about that,
- 4:09Pat.

- 4:49last-minute item that was brought to
- 4:52public works attention regarding a grant
- 4:54funding that we need to have completed
- 4:56by the end of this week. So, we added
- 4:58item B,
- 5:00which is
- 5:01airport perimeter fencing improvement.
- 5:07If I can have a motion to add that.
- 5:09>> And
- 5:10we will be adding an executive session
- 5:13to
- 5:15the
- 5:16towards the end of the meeting pursuing
- 5:18to RCW 42.30.110
- 5:22subsection 1 G to evaluate the
- 5:25qualifications of an applicant for
- 5:27public employment or to review the
- 5:28performance of a public employee.
- 5:31Um
- 5:33and
- 5:35item I
- 5:37after having some discussion earlier,
- 5:41I was asked if we could move item I to
- 5:43after executive session if you all are
- 5:46agreeable to that.

- 8:43you tonight at this Council meeting and
- 8:45I want to thank you for being here Lord
- 8:48in this proximity to deal with
- 8:53all that needs to be dealt with tonight.
- 8:55We thank you for the
- 8:58godly wisdom that you can present here
- 9:01and we thank you for the unity that this
- 9:04Council can
- 9:05come under we thank you for
- 9:09the needs of our community being met at
- 9:11large for the safety of this community
- 9:15for the our children for our
- 9:20schools. We
- 9:22want to thank you for the
- 9:26law enforcement for the first responders
- 9:29for all of these people that are working
- 9:31for our city and helping us to have a
- 9:34safe and prosperous city. We just love
- 9:37you and praise you in Jesus' name.

- 10:17active agenda items.

- 10:46So, for those of you that maybe haven't
- 10:48um been
- 10:50um around for a little bit, we um the
- 10:54agenda has just shifted where we have
- 10:56two public comments now. One relating to
- 10:59any active um agenda items, and then at
- 11:03the end we have a second round of public
- 11:04comments for general public comment. So,
- 11:08just making sure and if you haven't
- 11:09signed up for either, let me know and I
- 11:11can add you to the list.
- 11:17So, I have first on the list, Jim
- 11:20Stevens.
- 11:23And citizens are advised that they must
- 11:25limit their remarks to the council to 3
- 11:27minutes. Council may refer items to
- 11:29staff to review and a research for
- 11:30presentation at a future meeting.
- 11:34>> Uh
- 11:34>> Stevens, 328 Grandview Avenue,
- 11:37Sunnyside.
- 11:38I wanted to talk about the
- 11:41item on the agenda for uh
- 11:44uh
- 11:45to endorse uh
- 11:47acknowledge
- 11:48uh
- 11:49gay month or pride month and then also
- 11:52to have the pride flag flown over the
- 11:55city hall.
- 11:56Um
- 11:57I
- 11:59don't have any
- 12:00qualms about people who choose uh
- 12:03the gay lifestyle.
- 12:04Uh if that's their choice,
- 12:07so be it.
- 12:08Um
- 12:10we
- 12:12aren't giving
- 12:13equal
- 12:14time, I would say,
- 12:16to for lack of a better term, the uh
- 12:20uh straight people and the gay people.
- 12:23We're saying they're going to fly this
- 12:25flag for them. We're going to have a
- 12:27uh special month and we don't do that
- 12:29for the other part of the population.
- 12:31Um
- 12:33it's uh
- 12:35I don't want my grandchildren
- 12:39to be
- 12:40going into a gay lifestyle. I don't want
- 12:42my children to do that. I wouldn't
- 12:44recommend it for people. If it's
- 12:46somebody does because something
- 12:48sometimes it's genetic. So
- 12:50sometimes it's choice. I don't think we
- 12:52need to promote it. I don't especially
- 12:54for young kids.
- 12:55Uh
- 12:56they have a lot of decisions to make.
- 12:58Sometimes it's uh hard on them. And I
- 13:01think we need to be really careful about
- 13:03that. Sometimes that leads to sex
- 13:05changes,
- 13:06uh surgery. A lot of those people end up
- 13:08having committing suicide.
- 13:11Uh becomes a real problem. A lot of them
- 13:13wish they'd never done it and leads to
- 13:14psychological problems. So I think we
- 13:17need to be really careful about that,
- 13:19not so cavalier about it. Uh again,
- 13:22I respect people that make that choice.
- 13:25Not my choice and I don't think we ought
- 13:26to slip it off onto the community.

- 13:33>> Next up on our list is Chelsea Deemas.
- 13:42>> Hi everyone. Thank you so much for your
- 13:44time. I'm Chelsea Deemas. I live in the
- 13:46city of Sunnyside.
- 13:49Um I just wanted to make the case for
- 13:51why the Pride Proclamation should be
- 13:52signed. I reached out to every member of
- 13:56the council, and I heard from everybody
- 13:58minus one, and that's okay. I know it's
- 14:01busy, but I did want to share some
- 14:03statistics on why I think this matters.
- 14:06Um nearly 66% of LGBTQ
- 14:10Q youth report symptoms of anxiety and
- 14:14depression.
- 14:15Uh the suicide rate is up to 41%
- 14:19and
- 14:22over 70% of LGBTQ youth report
- 14:25experiencing discrimination based on
- 14:28their identity.
- 14:29Uh three in five LGBTQ youth experience
- 14:33harassment. Uh there are so many
- 14:36statistics out there that I don't think
- 14:38it really covers the harm and pain that
- 14:39LGBTQ youth experience every day in
- 14:42schools.
- 14:44Um I'm very connected with the GSA club
- 14:46at the Sunnyside High School, and I've
- 14:48had the pleasure of meeting with LGBTQ
- 14:51youth here in our community. Many that
- 14:53have shared that they have gotten
- 14:55attacked, um even thrown in a trash can,
- 14:58beat up, hurt simply because of how they
- 15:01identify. So, I think when you y'all are
- 15:04looking at this proclamation, I think
- 15:06think of those youth. Um think about
- 15:09what they're going through and what this
- 15:10could mean. There has been a lot of
- 15:13tension and things that have been going
- 15:16on with City Council, and I think this
- 15:18would just be a powerful move to show
- 15:21that we support folks regardless of what
- 15:24we may personally believe but that we
- 15:26support and stand with them in
- 15:27solidarity. This isn't to promote sex.
- 15:31This isn't to promote nudity because
- 15:33it's not that's just the furthest thing
- 15:35that pride is about. It's about
- 15:37community and accepting people as they
- 15:39are regardless if you believe in them or
- 15:41or believe in the lifestyle or not
- 15:43because it's not a lifestyle. It's the
- 15:45way we were born. Thank you.

- 16:14Um two items, payroll vouchers. Approve
- 16:17payroll voucher numbers 4211 through
- 16:204508 and wire transfers as listed for
- 16:23$677,811.29
- 16:27for the period ending May 21st, 2026.
- 16:31And B claim vouchers.
- 16:33Approve claim voucher numbers 4509
- 16:35through 4523 and wire transfers as
- 16:38listed for
- 16:40$684,907.96
- 16:44for the period ending on May 22nd, 2026.
- 16:51What is the desire of council?
- 16:53>> I'm good.
- 16:56>> I had counselor that one.
- 16:57>> So I I just want to give council and the
- 16:58public an update.
- 17:00Finance subcommittee has been meeting on
- 17:03a weekly basis
- 17:05with Leo.
- 17:06He has been
- 17:08very informative. One meeting that was
- 17:11Vanessa, right? I think Vanessa was
- 17:12there with with some of the invoices.
- 17:15So we've been we've been going through
- 17:16invoices, these
- 17:18checks, and actually they have not been
- 17:20mailed out until the finance
- 17:23approves them.
- 17:24Um with that being said, there has been
- 17:26some questions on some of these
- 17:28invoices, and I think as a group um
- 17:31in the finance
- 17:33you know, we haven't received those
- 17:35those answers yet, and you know, I think
- 17:37I see a a couple of the personnel that
- 17:39could possibly give us those answers if
- 17:42if you can permit me to ask some of
- 17:45these um questions.
- 17:47So,
- 17:48with that being said, um
- 17:51transaction number 4518 is for ammonia
- 17:54meter, and just a question from the
- 17:56finance committee if it was a a new um
- 17:59or replacement or something that we've
- 18:01never have had, and I'll let Chief uh
- 18:05respond to them.
- 18:06>> Yep, I can answer that question. So,
- 18:07that is a replacement meter.
- 18:09Um the meter that we were in possession
- 18:11of prior to, I don't know exactly how
- 18:13old it it was, but it was quite old to
- 18:15the point where it was having some
- 18:17operational issues to where it wasn't
- 18:19working, and when we contacted the
- 18:20vendor, it was uh past the point of
- 18:22being able to repair or uh
- 18:26get back to working order. So, we were
- 18:27unfortunately
- 18:29uh our only other option was to uh
- 18:31replace it. So, it is our only one that
- 18:33we currently have just due to the cost,
- 18:35they're not cheap. We do have smaller
- 18:36meters called four gas meters, um but
- 18:38when it comes to actually detecting
- 18:40higher levels of ammonia, we require
- 18:42that that device there, and
- 18:44that was the uh purpose of that item.
- 18:46>> Are these meters something that the the
- 18:47crews take into a building if if you
- 18:50suspect ammonia could cause it?
- 18:52>> That is correct, sir. Yeah, they're
- 18:53they're kind of about the size of like a
- 18:55tablet, right about there.
- 18:57>> Okay, the next one is uh 4911. Um think
- 19:00Hector could help us out with this. It's
- 19:02a $10,000 for traffic signs and posts,
- 19:05and just a question from the uh
- 19:06subcommittee, it's how often do we
- 19:08replace these signs, and who determines,
- 19:11you know, when
- 19:13and how damaged they need to be in order
- 19:14to be replaced?
- 19:16>> So, to replace the signs, obviously, we
- 19:18don't replace them until they're getting
- 19:19faded, lost the illumination of the
- 19:22light, you know, when you're especially
- 19:24in the dark, um you see a faded stop
- 19:27sign
- 19:28or you're not able to see it at night,
- 19:30that's a problem. So, we replace them as
- 19:33needed. Um I know
- 19:36we have we need to stock some um cuz
- 19:39it's not something we can overnight. So,
- 19:42um
- 19:44that's why we uh
- 19:46spent that much for the signs.

- 19:52the next one,
- 19:53uh Leo, maybe you could
- 19:56help us with this one. 4561, it was a
- 19:58$3,200 repairs to a 2023 Ford uh from
- 20:02Sick Customs, and and our question was
- 20:05if
- 20:05this is something that's going to be um
- 20:07submitted to their insurance for
- 20:10reimbursement cuz it is a newer vehicle,
- 20:13so I'm guessing it was some sort of
- 20:15damage or crash.
- 20:18>> Yes, I'm going to uh
- 20:21Yes, I'm going to be following up on
- 20:23that.
- 20:24And I'm going to get back to you um
- 20:26tomorrow.
- 20:27>> Okay. And there is some items that we we
- 20:30did decide to pull as a committee.
- 20:33Um one of them being 4920 to the Yakima
- 20:37County Department of Corrections.
- 20:39Um I think this one on uh Mr. Layman, um
- 20:45we were looking at the invoices and and
- 20:46it appears that some of that this one
- 20:48might have been coded differently or
- 20:50wrong. Um it was it was for inmate
- 20:52housing, but the code that you provided
- 20:54on the on the signature box was for
- 20:57towing services, and we just want to
- 20:58make sure with that
- 21:00these items are coded correctly, so we
- 21:02are pulling this one until we could get
- 21:04the correct code.
- 21:05>> That would be an incorrect code. It is
- 21:07inmate housing and we did find a
- 21:08discrepancy with that bill. It's
- 21:10actually a couple thousand dollars less.
- 21:11They charged us for a couple of inmates
- 21:13that were not ours.
- 21:15>> Okay.
- 21:15>> So, it's a good thing we're pulling it.
- 21:17>> Good thing we asked.
- 21:18>> So, the next one is that we're pulling
- 21:22is 4906 for $8,266.18
- 21:28to sick custom body and paint. Um
- 21:32just for the same reason as to it it is
- 21:35a it looks like it could be submitted to
- 21:37the insurance. It is repairs to a police
- 21:40vehicle. So, Leo was
- 21:44going to look into that and and get back
- 21:46to us.

- 23:14council, um we are moving the pride
- 23:18proclamation as the first item on the

- 23:32Uh let me swing back here to the
- 23:34resolution.

- 23:41>> So, uh the recognition of Pride Month is
- 23:45in support of the L G B T Q plus
- 23:49community.
- 23:50Uh supporters of this proclamation
- 23:53believe that it brings residents
- 23:54together, supports one another,
- 23:57shows solidarity for all its citizens,
- 23:59celebrates all people and all cultures,
- 24:02and affirms our commitment to diversity,
- 24:04equity, and inclusion for all people in
- 24:06the community.
- 24:07In addition to the proclamation,
- 24:09supporters are asking for the pride flag
- 24:11to be flown at City Hall for the month
- 24:13of June.

- 24:18So, this proclamation is being brought
- 24:20before council. Um it was submitted by
- 24:23Chelsea Deanne who which whom you heard
- 24:25of um from um during public comment of
- 24:29regarding the active uh
- 24:31items on the agenda.

- 24:42that would raise some concerns that she
- 24:45was agreeable to striking language
- 24:47around waving of the flag. Um

- 25:11then, you know, mentioned that her
- 25:13initial proclamation did not include um
- 25:17the wording flying of the flag the pride
- 25:19flag at City Hall. So, I was just
- 25:21curious as to how if she if she didn't
- 25:24submit it with with flying of the flag
- 25:26how it got in there.

- 25:32uh proclamation and it included that in
- 25:35the sample. So, I customized it for the
- 25:37city of Sunnyside
- 25:39and uh drafted the resolution to
- 25:43to indicate that. Uh but a motion can be

- 25:47accept the proclamation without the
- 25:50flying of the flag if you want it. I
- 25:52mean, whatever the motion you want to
- 25:53make I just provided a
- 25:56sample motion.

- 28:37it was a lifestyle. It's not a
- 28:39lifestyle. It's how we are. It's just
- 28:42how we are. And so um
- 28:45I just I just want to
- 28:47make that clear. It's not a lifestyle.
- 28:49I've gotten in trouble many times by
- 28:51calling it a lifestyle and so I know
- 28:53better now. So just tell they are and I
- 28:56just think that we need to support them
- 28:58just based on the
- 28:59the different percentages that are
- 29:02impacted, but all families are impacted
- 29:05by
- 29:06uh

- 29:10this this situation and so I don't want
- 29:12to call it a situation either. I'll get
- 29:14in trouble with that one, too.
- 29:15But but we're all
- 29:17um impacted

- 29:25something. So I actually have family
- 29:27member who one is gay and the other is
- 29:28bisexual and I love them so much.
- 29:30They're my family and you know, whatever
- 29:32at the end of the day anyone decides to
- 29:34do with their lives is their decision.
- 29:36Um and I do firmly believe that every
- 29:38person deserves dignity, kindness, and
- 29:39respect no matter what they do, no
- 29:41matter their background or their
- 29:42choices. So I just want to be clear with
- 29:44that and everyone should be respected
- 29:46and treated equal.

- 30:24said, Chelsea. That was really tough cuz
- 30:25I worked at the schools and met with a
- 30:26lot of the kids and seeing what they
- 30:29went through and
- 30:32it was tough to see that.

- 30:53different beliefs, and still live
- 30:56together as neighbors. Uh, true
- 30:57tolerance is not agreeing with everyone,
- 31:00is respecting the rights of humanity, of
- 31:02people, even when we disagree. So,
- 31:06even when we we have these
- 31:07disagreements, I think if if um
- 31:10if we all learn to respect one another's
- 31:13opinions and
- 31:14not necessarily attack
- 31:17somebody else's beliefs, somebody else's
- 31:19opinions, uh, I think this
- 31:22world could be a better place, and just
- 31:24that understanding [clears throat]
- 31:25of um
- 31:27you know, not everybody's going to
- 31:28believe the same thing that you believe
- 31:30in,
- 31:31you know, I have family, too, in in in
- 31:33in the community, and
- 31:35you know, I I voted for it 2 years ago,
- 31:37and you know, I I still respect the the
- 31:40the community. Um,
- 31:42it's not
- 31:44And but I still I I I do understand that
- 31:46other families, you know, do believe
- 31:48differently, um,
- 31:50but it's it's up to the the parents. It
- 31:52shouldn't be up to to the community to,
- 31:55you know, tell the youth what to do, um,
- 31:58influence the youth. It's it's let's
- 32:00leave it to the parents.

- 35:04Lions Club fireworks standby fee waiver
- 35:07request. Proposal motion directing the
- 35:09interim city manager to waive the fire
- 35:11department public works display standby
- 35:12fee of $210 per hour for the 2026
- 35:174th of July Lions Club fireworks event.
- 35:21Mr. Haley.
- 35:23>> Under fair to Cameron that is using his
- 35:27staff as a part of this celebration.
- 35:31>> Uh,

- 35:32>> good evening mayor and council.
- 35:35If you guys recall about this time last
- 35:37year, we implemented an amendment to our
- 35:40schedule of fees and charges to reflect
- 35:44cost recovery for the requirements to
- 35:46adhere to our municipal code which
- 35:47constitutes the fire department's
- 35:50staffing
- 35:52a type one engine which is a traditional
- 35:54pumper or fire engine
- 35:56with a crew of three at all public
- 35:58displays of firework events.
- 36:00So that was put into effect last year
- 36:02and again that was to offset our costs
- 36:04to be able to do those standbys. So been
- 36:08in effect for about a year but
- 36:09earlier
- 36:11last week or the week prior Mr. Haley, I
- 36:13apologize.
- 36:14Regardless, we received a formal written
- 36:17request for the Lions Club
- 36:19to waive such fees so they can put on
- 36:22their annual event which according to
- 36:24their letter they've been doing since
- 36:251996. Am I correct Deputy Mayor?
- 36:28Give or take. Um so, I bring it before
- 36:31the council at the your discretion to
- 36:32determine whether or not um I do not
- 36:34have the authority to uh waive those as
- 36:37part of the schedule and fees and
- 36:38charges. So, we bring it forward uh
- 36:40to you all today.
- 36:41And I stand for any questions.

- 36:47>> So, the the EMS [clears throat] crew
- 36:48that's going to be on standby, um that's
- 36:51not some that's not a crew that's going
- 36:53to be able to respond to regular calls.
- 36:54So, that's it's just it's going to be
- 36:56overtime and they have to stay there
- 36:58to tend to any medical issues there.
- 37:01>> So, this is not a medical standby, per
- 37:03se. This is for fire crews for the
- 37:04fireworks themselves. But to your
- 37:06question, that is correct. So, per the
- 37:08municipal code, they have to be
- 37:09dedicated to the incident. So, they
- 37:11cannot leave and respond on emergencies.
- 37:13Um they are there for the duration of
- 37:15the uh of the event, which technically
- 37:17includes 30 minutes before and 30
- 37:19minutes after the event. After is
- 37:21particularly to ensure that we don't
- 37:23have any delays in the ignition or um
- 37:26you know, something just doesn't decide
- 37:27to spark off without uh
- 37:30the pyrotechnics' awareness.
- 37:31>> And and how many and how many um I guess
- 37:34personnel do we need there?
- 37:36>> So, per the municipal code, it is uh
- 37:38required to have three personnel.
- 37:40>> Are any of them uh volunteer
- 37:44or they all paid?
- 37:46>> So, it's it's honestly, it's whatever we
- 37:48can get. So, it's a combination of both.
- 37:50So, we um per contract put out for paid,
- 37:52but we also put it out for volunteers as
- 37:54well. Um
- 37:56we put it out. At this point, we've had
- 37:57one career member um
- 38:00offer to work it. Um at that point, then
- 38:02we'll put it out to to volunteers. Um
- 38:04there is a cost for that as well.
- 38:06Volunteers are paid. Um
- 38:09the the stipend is different than a
- 38:11career member, but there are still those
- 38:13fees and
- 38:14incurred. But uh more so less. So, the
- 38:17the fees that we implemented in the fee
- 38:18schedule is to not only cover um kind of
- 38:21average costs for the staffing, but also
- 38:23for, you know, wear and tear, fuel, that
- 38:24kind of thing. So, it's a it's a
- 38:26break-even number at that point.

- 38:33that
- 38:35is listed here, the wages?
- 38:37>> That that's included. So, that that one
- 38:39hourly rate that is all encompassing of

- 38:50said you guys are there usually 30
- 38:51minutes before the fireworks and 30
- 38:53minutes after.
- 38:55What How long about is the firework
- 38:58display? Is it about an hour?
- 39:00>> So, that was one thing is the the
- 39:01request letter sent to us reference that
- 39:04the crews normally stand by for about 4
- 39:06hours. Um, I'm not going to contradict
- 39:08that, but that does seem longer than
- 39:11what would be normal. Um, typically
- 39:14counting the half hour before and a half
- 39:16hour after, we're looking at about a
- 39:182-hour window. Again, I wasn't going to
- 39:20um,
- 39:22disagree with the request letter, but
- 39:24historically in these events, we see
- 39:25about a 2-hour uh, total window.

- 39:31>> Yeah, that's why I kind of I I've asked
- 39:32because I've been there before and it
- 39:34didn't seem like to go
- 39:364 hours or even close to four, so

- 39:40request, but yeah, it's realistically
- 39:42it's more of a 2-hour window.

- 39:49reflect this 2 hours instead of the

- 39:52>> So, it it can. Again, just the cover
- 39:54sheet on there was put just based on

- 40:01less than that, but I wanted to
- 40:02incorporate what the former request
- 40:04captured.

- 40:18when we get the permit application,

- 40:29free to step in at any point, but this
- 40:31is done preliminary because I think that
- 40:33my understanding is the determination of
- 40:35council's decision tonight will dictate
- 40:37whether or not they apply for the
- 40:39permit. Am I correct, Deputy Mayor, or
- 40:41incorrect?
- 40:41>> We're we're applying for the permit.
- 40:43>> Okay.
- 40:43>> Yeah, we're we're going to do that. And
- 40:46to answer the sec- the the other
- 40:48question,
- 40:49normally the fireworks begins just at
- 40:53dusk. It's usually probably about a
- 40:55quarter to 10. It's usually over by
- 40:57about 11:00.
- 40:59If unless I can make them stretch it
- 41:01further on the fire
- 41:03you know, how long we blow the
- 41:05fireworks. But it's usually it's usually
- 41:08just about, I believe, 2 hours is
- 41:10sufficient
- 41:11for us.
- 41:13And so, we were just we were just
- 41:16trying to air on the
- 41:18larger side, but we we'll back it off.
- 41:21We can do that.

- 41:30it's only going to be 2 hours, isn't
- 41:31there a minimum when you call in a crew

- 42:26field, Clemson High School uh football

- 42:32firemen have always been there,
- 42:33and they've always been on hand for us.
- 42:35Sometimes we fed them, and sometimes we
- 42:38figured out other ways to help take care
- 42:39of them while they're there, get them
- 42:40water and so forth. Um and we do
- 42:43appreciate them being there. It's not
- 42:45that we don't want to to to um
- 42:49do the uh least at least the 3 hours.
- 42:51I'm just concerned if we will be able to
- 42:53raise that sort of money to pay for the
- 42:56standby amount. But um if that's the way
- 42:59the council goes, then we will
- 43:02we will figure out something. But uh
- 43:05and we do as I said, we do appreciate
- 43:06them, and you guys have always been very
- 43:08very professional about it. So, walk
- 43:11through and
- 43:12play the games, and eat the watermelon,
- 43:13too, and the hot dog contest.

- 49:06Engineering and Land Surveying Inc. was
- 49:08selected based on qualification and
- 49:10required by the FA Federal Aviation
- 49:13Administration, FAA.
- 49:15Uh city staff desires to secure expiring
- 49:19federal funds for the purpose of design
- 49:21engineering for a perimeter fence as
- 49:23identified in the airport layout plan.
- 49:26Uh design engineering will include
- 49:28environmental documents, uh 60%, 90%,
- 49:32and 100% contract documents to review by
- 49:35the FAA and city staff, coordinations
- 49:38with tenants and stakeholders,
- 49:41the preparation of a aviation easement
- 49:44to secure the runway protection zone for
- 49:48uh right-of-way 25, and meeting all FAA
- 49:52requirements necessary for
- 49:54construction advert advert
- 49:57Sorry, advertisement authorization.
- 50:00The task order it also includes
- 50:01construction engineering services, which
- 50:03is requirement of the FAA.
- 50:06Uh service all include the preparation
- 50:08of grant application secure construction
- 50:10funding.
- 50:11Design engineering services are
- 50:13anticipated over the remaining 2026
- 50:16calendar year with a construction
- 50:17improvement occurring in 2027 depending
- 50:21on funding availability.
- 50:22Uh and I'm here for any questions. I

- 50:30that has replaced uh Stephanie Ray, who

- 53:30to do it the hard way and make it more
- 53:31expensive, I guess.
- 53:33So with that being said, is
- 53:35where's this money coming from?
- 53:37>> Uh it is coming from the FAA FAA grant
- 53:41that we received.
- 53:43Um it is
- 53:44I don't believe uh there's any cost to
- 53:47us. I know on a later item that we have
- 53:50on the agenda
- 53:52uh that I submitted, that it is a a
- 53:55grant that we have gone out for.
- 53:57Uh we have about
- 54:00off the top of my head, it's like
- 54:02$413,000
- 54:04that we received through FAA.
- 54:07So, um
- 54:09if we don't and it's um
- 54:12I believe it's a certain amount that
- 54:14we've just collected and moved forward
- 54:17to the next year, to the next year, to
- 54:18the next year.
- 54:19Um speaking to Angus Fisher, um who we
- 54:24who I deal with FAA, it's it's something
- 54:27that uh has been brought up many times
- 54:30prior to me
- 54:32um
- 54:33to be done. And so, now we are at the
- 54:36limit of either we use it
- 54:39or we lose it. And um as everybody
- 54:42knows, we don't want to lose any money,
- 54:44especially the FAA
- 54:46with the airport that we have.

- 54:49it it could be very hard to receive more
- 54:51grants.

- 57:15even the airport in Yakima has a fence
- 57:18around it if you look real close.

- 57:24the design and for where it's supposed
- 57:26to be that's being done by HLA.

- 57:34out there for a number of years.

- 57:38what I've told been told was there's
- 57:40been some

- 57:43our airport turnpike, so
- 57:46>> No, we don't need that.
- 57:48>> That's something we can do our best to
- 57:50eliminate.
- 57:52>> Yeah, we don't need to have dirt bikes
- 57:53on the airplane on the airport tarmac
- 57:57where we're taking in hospital
- 58:00helicopters and airplanes for medical
- 58:03evacuations and that sort of thing we
- 58:05for the private pilots, so
- 58:07fencing is good.

- 58:12can contribute to
- 58:14Brad you can confirm this, but in this
- 58:17task order 95% is being paid for by the
- 58:21FAA and 5% is the local match.
- 58:24So FAA dollars usually come from gas tax
- 58:28fund airplanes and that's how they
- 58:30pump money back into the system.
- 58:33And airport security has become kind of
- 58:35a thing since
- 58:369/11.
- 58:37And [snorts and clears throat] so
- 58:38airports across the country are getting
- 58:39fenced to provide higher protection and
- 58:42security.

- 1:07:25resolution 2025-23
- 1:07:28was brought to council for permission to
- 1:07:30order a a new sewer vac truck. The
- 1:07:33resolution was approved and the sewer
- 1:07:34vac truck was ordered. The sewer
- 1:07:36department received the new vac truck on
- 1:07:38May 4th, 2026.
- 1:07:41No budget amendment was done for the new
- 1:07:43sewer vac truck and we are bringing an
- 1:07:45amendment for the amount of 637,803.50.
- 1:07:52I and I put in the documents of the
- 1:07:56council minutes that when it was
- 1:07:58approved.

- 1:08:01>> So, at the finance subcommittee meeting
- 1:08:04that we had this afternoon, we discussed
- 1:08:06this a little bit further

- 1:08:19that said that, you know, it was a 1.5
- 1:08:22charge per month if it if it wasn't paid

- 1:08:31to give them a call and and just explain
- 1:08:33to them the process of council approving
- 1:08:36this and hopefully we don't get a
- 1:08:39late charge for this for this invoice.

- 1:12:49I have been working with Department of
- 1:12:51Ecology

- 1:12:57to allow our storm
- 1:12:59department purchase that vac truck so we
- 1:13:01can
- 1:13:02uh
- 1:13:04refurbish it and um
- 1:13:06use it during a storm uh for storm
- 1:13:08water.
- 1:13:09So.

- 1:13:33we are running our vac truck uh
- 1:13:36on a maintenance that does our storm
- 1:13:38water our our sewer lines uh
- 1:13:42daily.

- 1:13:46with the reason of having two,
- 1:13:49I believe it's usable for not only storm
- 1:13:51water but for uh the water department
- 1:13:54also. When we have those high um when we
- 1:13:57have water leaks, um we are are able to
- 1:14:00use it. Um if we need a backup, uh we
- 1:14:04have a second one in town and don't have
- 1:14:06to call out to uh other cities for their
- 1:14:09vac truck.

- 1:14:52putting repair bills to? I mean, if if
- 1:14:55it was if it was up to me, I would send
- 1:14:56it off to auction and let somebody else
- 1:14:58deal with the with the headaches and not
- 1:15:00so much our pocketbooks, right? The
- 1:15:02taxpayers that have to pay for these
- 1:15:04bills.
- 1:15:05That's just That's just my thought on
- 1:15:07this, um, the second one, Larry, but
- 1:15:10I mean, that's
- 1:15:11>> And that is a good thought. Um, the only
- 1:15:13reason we were thinking of keeping it,
- 1:15:15um, isn't if we have not sent it out
- 1:15:17yet, but our you know, talking to Mr.

- 1:15:20um, that that's what our thought
- 1:15:22thinking was for
- 1:15:24the purpose of not having one vactor
- 1:15:27stop, um,
- 1:15:29doing a project, either cleaning storm
- 1:15:32drains or doing sewer lines,
- 1:15:34to go handle another problem where we
- 1:15:36can have the second one, the older one,
- 1:15:40as more of a floater.
- 1:15:42So,
- 1:15:43that was our thought theory behind it.
- 1:15:46Um, if council would like, I mean, we
- 1:15:49we are more than happy to send it off to
- 1:15:50auction or surplus it with your guys'
- 1:15:53permission and,
- 1:15:55um,
- 1:15:55use the just the one vac truck.

- 1:16:59council would like me to entertain of uh
- 1:17:02surplusing it and sending it out to
- 1:17:03auction, I'd be
- 1:17:05more than happy to also.

- 1:19:19WSDOT, requirements.
- 1:19:20The six-year TIP should identify the
- 1:19:22transportation priorities for the city
- 1:19:25for the next six years and must include
- 1:19:27projects which have secured funding and
- 1:19:29also plan projects for the which the
- 1:19:31city intends to seek for funding for.
- 1:19:34Uh
- 1:19:36Jurisdictions are required to conduct a
- 1:19:38public hearing to solicit comments on
- 1:19:40the six-year TIP.
- 1:19:42Following public hearing and addressing
- 1:19:44any comments, the jurisdiction is
- 1:19:45required to adopt the six-year TIP.
- 1:19:48After adoption, the six-year TIP is sent
- 1:19:51to the regional MPO, uh which is our
- 1:19:54WSDOT,
- 1:19:55which also uh solicits for public
- 1:19:58comment. The MPO develops the MRITP
- 1:20:02and forwards that MRITP
- 1:20:06to WSDOT.
- 1:20:09So, we I I am asking for us to be able
- 1:20:13to do a June 22nd uh public hearing.

- 1:21:35replacement attorney after the
- 1:21:37termination of our contract and I
- 1:21:38interviewed
- 1:21:40two firms.
- 1:21:41One was Malek and Malek and another one
- 1:21:44was uh
- 1:21:46I forget the name of the firm. Um but
- 1:21:49they were out of Issaquah.
- 1:21:51Um I got that company from Bonney Lake
- 1:21:55who had done an RFP for city engineer
- 1:21:58city attorney services.
- 1:22:00They weren't selected, but they were on
- 1:22:02the list of respondents. So, I
- 1:22:04interviewed them.
- 1:22:06And then I talked to Dan Height who used
- 1:22:09to be the city attorney here for
- 1:22:11Sunnyside who now works for the city of
- 1:22:13Toppenish and gave him my thoughts as to
- 1:22:17the process of selecting a city
- 1:22:19attorney.
- 1:22:20And he concurred that the the rationale
- 1:22:23that I was using in selecting the city
- 1:22:25attorney was appropriate. So, I am here
- 1:22:28to
- 1:22:29propose an agreement with the law firm
- 1:22:31of Malick and Malick out of Boise, Idaho
- 1:22:35for legal services of Rob Luce as the
- 1:22:37city attorney for city of Sunnyside.

- 1:23:16Um I was the city attorney for Boise for
- 1:23:194 years. And I'm the city attorney for
- 1:23:23my hometown in Southeast Alaska
- 1:23:26um at the present time.
- 1:23:28Um
- 1:23:30the city of Sunnyside would be our
- 1:23:32primary municipal client here in this
- 1:23:35part of Washington.
- 1:23:37Um I [clears throat] brought one of my
- 1:23:39deputy city attorneys from Boise into
- 1:23:43our firm.
- 1:23:45And we recently hired another municipal
- 1:23:48lawyer who does work for Colfax and some
- 1:23:51of the other smaller cities in that part
- 1:23:53of the part of the state. So, there are
- 1:23:55actually three of us on the team. I I
- 1:23:57will be the primary point of contact.
- 1:24:00And I would say that,
- 1:24:02you know, well over half of the
- 1:24:04interaction, 75% of the interaction
- 1:24:07would be with me.
- 1:24:09Um I I travel a fair amount. Um and so,
- 1:24:13Kim Smith, who's the deputy attorney
- 1:24:16>> [snorts]
- 1:24:16>> at Boise, would be the second. And then
- 1:24:20uh Uh, Hannah is the person who does the
- 1:24:22work for Colfax.
- 1:24:24Um, would be kind of third or on deck,
- 1:24:28um, so to speak, but I'd be your primary
- 1:24:30point of contact.

- 1:24:37difference of form of government, um,
- 1:24:39and what Sunnyside is, um, just because

- 1:24:48not respected, but I I just want to make
- 1:24:50sure that, you know, the form of
- 1:24:51government is something that either you
- 1:24:53or whoever is on board completely
- 1:24:55understands.

- 1:24:58City of Boise was the same setup.
- 1:25:01City of Wrangell is the same setup. City
- 1:25:04of, uh, Colfax the same setup.
- 1:25:07Um, the you know, the the municipal
- 1:25:10codes
- 1:25:11are different from city to city, but in
- 1:25:16in a sense, they're also quite
- 1:25:19similar
- 1:25:20in how they how they're structured and
- 1:25:23how they how they set things up. I was
- 1:25:25lucky enough, um, I I came over on the
- 1:25:27bus today.
- 1:25:30Um, and I got to read
- 1:25:32the City of Sunnyside
- 1:25:33code, municipal code. I read that on the
- 1:25:35way over. And, uh, I I did take one nap
- 1:25:39on the way, but
- 1:25:41I I did get through all of that. It's
- 1:25:43very, very, uh, similar to what we see,
- 1:25:46um, throughout the Pacific Northwest and
- 1:25:48Mountain West.

- 1:26:19because Zoom's great, but
- 1:26:22you you need to have a personal presence
- 1:26:26to build that trust and relationship.

- 1:26:30um I'll attend, you know, those meetings
- 1:26:33when I'm up there and then um on Zoom
- 1:26:36whenever they want me. The um
- 1:26:39the the arrangement we have up there
- 1:26:41is that I don't attend every uh meeting
- 1:26:45of council.

- 1:26:48a lot of the meetings are, you know,
- 1:26:50you've got your consent agenda and and
- 1:26:53it and it's it it's kind of wrote and to
- 1:26:55have
- 1:26:56a city attorney there or an attorney
- 1:26:58there present who who doesn't even say
- 1:27:02anything and then you pay them
- 1:27:04doesn't necessarily make sense. So, what
- 1:27:06we have done up there and and it's
- 1:27:09something we could do here is I meet
- 1:27:11with the city manager
- 1:27:14Tuesday before the council meeting. We
- 1:27:17go through the agenda, we talk about it.
- 1:27:19Do I need to be there? Do I not need to
- 1:27:21be there? What do you What is your
- 1:27:22preference? And and that's kind of how
- 1:27:24we've handled it there. But Zoom works
- 1:27:26great, but I but I anticipate
- 1:27:28that um
- 1:27:30you know, I I'd like to have a personal
- 1:27:32presence here, too. Maybe once a quarter
- 1:27:35or so, something like that.

- 1:27:43six, compensation B, travel time for all
- 1:27:45in-person meetings will be billed at 50%

- 1:30:04is to bring top-tier legal services to
- 1:30:08rural communities that
- 1:30:11haven't in the past necessarily been
- 1:30:13been served. And I say that from
- 1:30:15personal experience. I grew up in
- 1:30:17Wrangell.
- 1:30:18And Seattle was 1,300 miles away.
- 1:30:21Anchorage was 1,500 miles away. They
- 1:30:24could care less
- 1:30:25about answering an email, answering a
- 1:30:28phone call,
- 1:30:30coming down to be at a city council
- 1:30:32meeting.
- 1:30:34We We had city attorneys in Wrangell for
- 1:30:3610 or 15 years that had never visited.
- 1:30:39And it's not It's not right. Frankly,
- 1:30:42it's not right. And so, we have a very
- 1:30:45big passion for
- 1:30:48um public service and folks that that do
- 1:30:52the good work that you do. So, very very
- 1:30:54proud to be uh a part of this team.

- 1:32:35Um the city of Wrangell is a true home
- 1:32:40rule city manager type um type of a
- 1:32:44situation. So,

- 1:38:29with the law firm of Ogden and Murphy
- 1:38:31Wallace for the legal services
- 1:38:33to complete the inter-
- 1:38:36interrogatories specifically related to
- 1:38:38the Munson Vetta development LLC case.
- 1:38:43All the litigation matters are driven by
- 1:38:46deadlines,
- 1:38:47and failure to meet those deadlines have
- 1:38:49can have major consequences
- 1:38:51for successfully managing legal risks.
- 1:38:55Sometimes meritous positions are lost
- 1:38:57simply by delay.
- 1:38:59Damages in the Munson Vetta case are
- 1:39:02very large.
- 1:39:05This process was originally started by
- 1:39:08the law firm of Ogden Murphy Wallace,
- 1:39:10and without their continuity of
- 1:39:12discovery sanctions, failing to meet
- 1:39:14schedule order deadlines, and losing
- 1:39:16momentum in managing pre-trial processes
- 1:39:19of motion and discovery exposes the city
- 1:39:23to significant risks.

- 1:39:49I'm looking for the word. Limited
- 1:39:50assignment, is that based on the number
- 1:39:53of interrogatories
- 1:39:55that we need to have taken?
- 1:39:58>> Right.
- 1:39:59The document that
- 1:40:00uh is involved in pre-trial discussions.
- 1:40:04It's all about investigations, answering
- 1:40:06questions, different parties that are
- 1:40:08participating in it. It also requires
- 1:40:11proof of documentation or proof of uh of
- 1:40:14uh
- 1:40:14statements that are necessary.
- 1:40:17Uh is about 125 questions.
- 1:40:21Uh typically these things are around 30.
- 1:40:24So, we have a very very extensive
- 1:40:26interrogatories that have to be
- 1:40:29answered, and they are governed by a
- 1:40:31certain time frame. We received that
- 1:40:34with a 30-day turnaround. We're seeking
- 1:40:37an extension of that for another 60
- 1:40:39days.
- 1:40:40But, it would be um
- 1:40:43uh uh highly risky for us to turn this
- 1:40:45over to a new attorney and start the
- 1:40:47process over
- 1:40:48when Ogden Murphy Wallace has already
- 1:40:50started it. And this limited contract
- 1:40:53just simply allows them to finish this
- 1:40:56this this one project, and then we are
- 1:40:59uh
- 1:41:00canceling or terminating the agreement
- 1:41:02as we originally proposed.

- 1:41:20So, given that we now have new counsel,
- 1:41:23um my my question to you, Pat, um to put
- 1:41:26on the record is that um
- 1:41:28uh Mr. Luce couldn't take this on
- 1:41:31because
- 1:41:33the project had already started.
- 1:41:36>> Right. Documents have been collected. Uh
- 1:41:39uh Some of those discussions have
- 1:41:41already been taken place. It's all
- 1:41:43recorded. It has to be done by an
- 1:41:44attorney.
- 1:41:46The idea of duplicating the work that's
- 1:41:48already been done seems wasteful.
- 1:41:50It's just a matter of them finishing the
- 1:41:52work that they started in this and and
- 1:41:54getting it done in the time frame that's
- 1:41:56necessary. Again,
- 1:41:58uh just because we changed attorneys
- 1:42:01does not change the deadline. And so
- 1:42:03there's a amount of time that a new law
- 1:42:05firm would have to ramp up, become
- 1:42:07familiar, start the process again, all
- 1:42:10that.
- 1:42:12Uh again, it it
- 1:42:13there's significant risk to the city in
- 1:42:15this process. And so the request is just
- 1:42:19simply let them finish the task.

- 1:42:25Dolan. Just go in that order.
- 1:42:27>> Yeah, so I completely agree with you,
- 1:42:29Mr. Haley.

- 1:42:32for the simple reason that
- 1:42:35you know, at at the at the finance
- 1:42:36subcommittee, you know, we learned that
- 1:42:39city attorney services, claims, and
- 1:42:40litigations, we budgeted 50,000 for this
- 1:42:43year, and we're already at 80,000.
- 1:42:45Um we're over budget
- 1:42:47just for claims and litigation. And if
- 1:42:49we do not let this firm Ogden & Murphy,
- 1:42:54like you said, [clears throat] it's just
- 1:42:55they're just going to be repeating what
- 1:42:56Ogden & Murphy already did. And so I I
- 1:42:58strongly believe that we need to let
- 1:43:01this law firm continue with this with
- 1:43:04this litigation.

- 1:43:10>> What are we looking at time-wise on
- 1:43:11this?
- 1:43:13>> Well, it's driven by deadlines. So they
- 1:43:15have to, you know,
- 1:43:17meet the deadline.
- 1:43:19And so I can't say how long it takes to
- 1:43:22do these things. It's gathering the
- 1:43:23information, interviewing people,
- 1:43:26documenting that.

- 1:43:34law firm saying, "You know, we were in

- 1:43:42you're going to have to figure out how
- 1:43:43to get this done."

- 1:43:49that is it was part of the original
- 1:43:51contract. Which it had about four
- 1:43:53different attorneys involved in it and

- 1:44:00actual interviews.

- 1:44:04have an attorney do this. There's no way

- 1:46:22>> The city is the owner and operator of
- 1:46:25the Sunnyside Municipal Airport. The
- 1:46:27airport actually serves business on the
- 1:46:29airfield, general aviation, corporate
- 1:46:32aviation, and Airlift Northwest and Life
- 1:46:35Flight services.
- 1:46:36The airport supports an average of
- 1:46:3824,000 aircraft annual operations.
- 1:46:41By comparison, adjacent airports have
- 1:46:44the following numbers of operations from
- 1:46:46Prosser Airport to 13,200,
- 1:46:49Richland Airport 45,500 and Desert Air
- 1:46:523,000
- 1:46:54250.
- 1:46:55Uh, the airport is
- 1:46:58encumbered by grant assurance as federal
- 1:47:01funding and has continued to be provided
- 1:47:04to support improvements on the airfield
- 1:47:07focused on safety, security, and pay-
- 1:47:09pavement preservation.
- 1:47:11The Federal Aviation Administration
- 1:47:13required the city to prepare an airport
- 1:47:16layout plan, which was completed in
- 1:47:172024.
- 1:47:19The funding received through the Airport
- 1:47:21Improvement Program
- 1:47:23can only be used on capital needs
- 1:47:25identified in the airport layout plan.
- 1:47:27Uh one of the highest priority projects
- 1:47:29on the airfield is to secure the
- 1:47:31airfield with a deterrent fence.
- 1:47:34Currently, the airfield is has
- 1:47:36unrestricted areas or access for
- 1:47:39motorists and pedestrians.
- 1:47:41Without full-time staff on the airfield
- 1:47:43to monitor daily activities, having
- 1:47:45unrestricted access to the airfield is a
- 1:47:48major safety and insecurity concern.
- 1:47:51Ongoing document concerns include
- 1:47:53vehicle exits from Highway 241
- 1:47:56into the runway safety area and runway
- 1:47:58protection zone. Adjusting agriculture
- 1:48:01uses the runway to turn around with farm
- 1:48:04equipment and pedestrian and bicyclist
- 1:48:06access both the taxiways and runways.
- 1:48:09The events These events are considering
- 1:48:12because pilots cannot clearly observe
- 1:48:14ground operations. And I am here to ask
- 1:48:18uh answer any questions.

- 1:48:47entitlement funding. Uh these funds
- 1:48:49expire May May 29th, 2026.

- 1:48:54local share of entitlement funding. 113
- 1:48:57And that was for the Sorry. Uh AIG
- 1:49:03for the AIP
- 1:49:05uh 113,000 airport infra- infrastructure
- 1:49:08grant funding. These funds expire May
- 1:49:1129th, 2026.
- 1:49:14Uh and 5,948
- 1:49:17local share for the airport
- 1:49:18infrastructure grants, which came out to
- 1:49:20a total of 273,285
- 1:49:24of the funding that's requested.

- 1:52:27The amount The issue of recusal, I think

- 1:52:32pretty particular about that. If there's
- 1:52:34any conflict of interest, I think we
- 1:52:36need to really look seriously at
- 1:52:37recusing yourself.

- 1:52:40and that would include being a member of
- 1:52:42a group. It doesn't have to be financial
- 1:52:44gain.
- 1:52:46And then as a matter of protocol for the
- 1:52:50state of Washington and also for the
- 1:52:51city of Sunnyside,
- 1:52:53when you have a vote, if there's not
- 1:52:56a tie If it's not a tie, then the mayor
- 1:52:57doesn't vote.
- 1:52:59And it's only special situations in
- 1:53:01which the mayor would vote.

- 1:53:36sewer vac truck. Had some questions.
- 1:53:39Several of you weren't here back then,
- 1:53:40but
- 1:53:41it was hard to hear the price and also
- 1:53:45without a
- 1:53:46an agenda
- 1:53:48and some of the stuff that wasn't on the
- 1:53:49agenda until later,
- 1:53:52it was hard to follow.
- 1:53:53Um, back at a meeting March 24th of
- 1:53:572025, there was a resolution done.
- 1:54:00Uh, it was resolution number 23
- 1:54:03on the Sourcewell contract. I've got the
- 1:54:06contract number 10122V.
- 1:54:10And it was for the price of 600 and I we
- 1:54:14couldn't hear the price. $650,000.
- 1:54:18Um,
- 1:54:19and it was approved by council. So,
- 1:54:23just for clarification for myself and
- 1:54:25for the audience,
- 1:54:27do we not have the money for that truck?

- 1:55:13broken, I don't know, but I have
- 1:55:15received about 10

- 1:56:06meet. We did get an application for
- 1:56:07parks and recs yesterday, but we're
- 1:56:09going to meet this week and we'll be
- 1:56:12reviewing that um those uh applications
- 1:56:16and then bringing them forward for
- 1:56:18council approval the next time that we
- 1:56:21can be.
- 1:56:22Um
- 1:56:24other reports announcements under
- 1:56:25questions by
- 1:56:27council.
- 1:56:29I'll go ahead and start bottom over

- 1:56:50um in regards to for the Boys and Girls
- 1:56:53Club.
- 1:56:55And I also got the email from
- 1:56:59um
- 1:57:01our chief of police uh
- 1:57:02for a meeting for this week.
- 1:57:054:00 p.m.

- 1:57:10committee. Yep.

- 1:57:35our city manager, did you get any of the
- 1:57:36information from from them?
- 1:57:39>> No, I haven't followed up with them, but
- 1:57:42uh
- 1:57:43I think the the the [clears throat]
- 1:57:45meeting
- 1:57:46which is an amazing facility that is.
- 1:57:49But they clearly said that's not how
- 1:57:51they started, so you know, we have to
- 1:57:53look at their beginnings. And it really
- 1:57:55needs a community champion. I think
- 1:57:57that's the point is that you need
- 1:57:59somebody that's just driving this thing.
- 1:58:02And so that's something that we might
- 1:58:04work on as a council of finding that
- 1:58:07champion
- 1:58:08that can push it through cuz there's a
- 1:58:10lots of steps and processes.
- 1:58:13>> And that's why I think we it's a good
- 1:58:14idea for that we talk about it a little
- 1:58:16bit more cuz I mean it's something that
- 1:58:18I would love to bring here, but
- 1:58:20but [clears throat] that almighty
- 1:58:22dollar's tough.
- 1:58:24And it'd be really hard on our city to
- 1:58:25be able to work something out like that.

- 1:59:08to be baby steps and we just have to
- 1:59:12stay focused and form a group and um you

- 1:59:26have a few Well, I have a few questions.
- 1:59:28Um in regards to the Community and
- 1:59:29Economic Development Commission, um just
- 1:59:32going
- 1:59:33searching them up on the City of
- 1:59:35Sunnyvale website, um our members we
- 1:59:37actually have seven active members as of
- 1:59:39right now, but they will all be ending
- 1:59:42June 30th, 2026.
- 1:59:44And I was getting some feedback from
- 1:59:46some of the members telling me that they
- 1:59:47were hearing that it wasn't ending till
- 1:59:492028, um but it's actually
- 1:59:52this year.
- 1:59:53>> You are correct and I did look that up.
- 1:59:55And I did advise uh
- 1:59:58the committee members
- 1:59:59>> Okay.
- 2:00:00>> that it will be ending this year.
- 2:00:01>> Okay, perfect. So, with that said, um I
- 2:00:04just also wanted some direction in
- 2:00:06regards of, you know, the application
- 2:00:08process. How are we going to be putting
- 2:00:11um this information out for our
- 2:00:12community and letting community know
- 2:00:14because we're already at the end of May.
- 2:00:16Come We're entering June here soon.
- 2:00:19That's going to be one month and a month
- 2:00:20goes by really quick and I'm on that.
- 2:00:23So, I just want to make sure I've been
- 2:00:25getting a lot of feedback from current
- 2:00:26members and I hear about almost more
- 2:00:28than half of them are not seeking to
- 2:00:30renew their their application. They're
- 2:00:33not seeking to stay on that board. So,
- 2:00:36I'm just kind of worried and the at the
- 2:00:38fact of like what's the process to put
- 2:00:40the the applications out to get
- 2:00:42community members to be interested just
- 2:00:44because time seems to be running out and
- 2:00:46so that there's enough and sufficient
- 2:00:47time for community members to one, know
- 2:00:50that there's going to be openings to
- 2:00:52apply, and three, have a board that's
- 2:00:54ready for at least, you know, come July.
- 2:00:58>> Yes. Um so, I was I'm working on putting
- 2:01:01a
- 2:01:03I guess it's an advertisement uh on on
- 2:01:05our website to um update the community
- 2:01:08and allow them to uh
- 2:01:11reach out to the city if they want to
- 2:01:13apply. I I know that an application
- 2:01:14process that uh obviously goes to rules
- 2:01:17and committee. Um
- 2:01:19>> Yeah.
- 2:01:20>> And then it'll be brought to the
- 2:01:22council.
- 2:01:23>> Okay. And you know, this is just
- 2:01:25something that I'm I've just kind of
- 2:01:26it's been on my head and I'm like, we
- 2:01:28need to have something ready. Um so, I
- 2:01:30just wanted to bring that up into
- 2:01:31everyone's attention.
- 2:01:33>> Yeah, I did email uh Mr. Haley earlier
- 2:01:36this Monday. I think you've been copied
- 2:01:37on those emails um asking him and um I
- 2:01:40think Jeffet to make sure that we're
- 2:01:42updating that on the website. And I
- 2:01:44think it it is now updated on the
- 2:01:45website, Rejaffet.
- 2:01:47The um
- 2:01:48vacancies for the economic community
- 2:01:51development.
- 2:01:52>> The amount of vacancies for each um
- 2:01:54uh board and commission has been
- 2:01:56updated, but each board and commission
- 2:01:59has a individual page that some of that
- 2:02:03information might be out of date.
- 2:02:04>> outdated.
- 2:02:05>> Yeah. Our clerk used to take care of
- 2:02:08keeping up on on that information. Um
- 2:02:12I I would have no idea who was currently
- 2:02:15on any of those commissions. So, if uh
- 2:02:17if we can get the information, we can
- 2:02:19put it on the website.

- 2:02:24getting at is making the announcement
- 2:02:27about these vacancies.

- 2:02:30had asked as well. So, um
- 2:02:32Mr. Haley, is that something that we can
- 2:02:34work with you to make sure
- 2:02:37it's reflected on the website and we can

- 2:02:41positions are open.

- 2:02:51tomorrow. So, I'll be asking for her

- 2:02:55Um with that all of that being said, I
- 2:02:58know we've talked about
- 2:03:00discussing, you know, the boards and
- 2:03:01commissions and looking at it all again
- 2:03:04and trying to maybe like make changes
- 2:03:06because these are long-term commitments.
- 2:03:09Um again, going back these were like
- 2:03:104-year commitments and I heard feedback
- 2:03:12that you know,
- 2:03:14some of the members
- 2:03:16family emergencies occurred and they
- 2:03:17weren't able to step up and we just had
- 2:03:19a lot of like sometimes we would we
- 2:03:21didn't have a quorum. Like these
- 2:03:23meetings didn't have a quorum and
- 2:03:25maybe just kind of like dividing it in
- 2:03:26half, making it not such of a long-term
- 2:03:28commitment. So, you know, maybe doing a
- 2:03:30workshop. I I would push for a workshop.
- 2:03:33Um that way we could all get together
- 2:03:34and discuss what we can do, what we can
- 2:03:36better and change.
- 2:03:39>> Mhm.
- 2:03:40>> So, that's something that I would
- 2:03:41request and maybe I could just add that.
- 2:03:43Are we still doing that council report

- 2:04:29no individual without a smile on their
- 2:04:32face.
- 2:04:34There would that place was just packed
- 2:04:36full of kids who were having fun and
- 2:04:37enjoying each other's company and I was
- 2:04:40very impressed with it.

- 2:05:50um
- 2:05:51we've been doing this the Lions Club
- 2:05:52Sunnyside Lions Club is
- 2:05:54has uh kind of taken on responsibility
- 2:05:57for forming the annual 4th of July uh
- 2:06:01celebration every year.
- 2:06:03And so we've been doing that since uh
- 2:06:05Well, I think it's been '95, but it
- 2:06:08could be '96. It's been so long.
- 2:06:10Um but we've been hosting it uh with the
- 2:06:13cooperation and support of the city of
- 2:06:15Sunnyside and we bring together uh it's
- 2:06:18a day of fun and family and patriotism
- 2:06:21and it's most it's all free of charge.
- 2:06:23You know, last year we included a day at
- 2:06:25the pool. We had uh sponsorship for
- 2:06:29the day at the pool afternoon at the
- 2:06:30pool. We had the fireworks, we had
- 2:06:33vendors down at the football field.
- 2:06:35Somebody asked me earlier about how many
- 2:06:37people attend and it's a little hard to
- 2:06:39tell you how many people attend because
- 2:06:42they all kind of park outside the
- 2:06:45football field, those who don't come
- 2:06:47inside and they park along Lincoln
- 2:06:49Avenue and behind the schools there on
- 2:06:52on 16th and over along Yakima Valley
- 2:06:55Highway and down through the bus garage
- 2:06:58lane down that way
- 2:07:00and over in South at the Eastway parking
- 2:07:04shopping center which isn't called that
- 2:07:06anymore, but it's across from the high
- 2:07:07school.
- 2:07:09Plus people can see it from the hill as
- 2:07:11well and but the thing of it is is when
- 2:07:14we started doing this and I think this
- 2:07:16is why it's such a passion for me.
- 2:07:18When we first started doing the 4th of
- 2:07:20July celebration in Sunnyside
- 2:07:23we were the only community in lower
- 2:07:26Yakima Yakima Valley that did not have a
- 2:07:294th of July celebration.
- 2:07:33Zillah did, Granger did, Grandview did,
- 2:07:36Prosser did, Mabton did, although
- 2:07:39there's is a war zone, but they still
- 2:07:41had one.
- 2:07:42So we got together, the Lions got
- 2:07:44together and we decided we wanted to
- 2:07:46have a 4th of July celebration in our
- 2:07:50community. First it was small, then it
- 2:07:53got bigger, we had politicians there.
- 2:07:55Some of them were running for office,
- 2:07:57some of them were already in office, but
- 2:07:59the thing of it is is throughout all of
- 2:08:01that when we started asking for money
- 2:08:04for the 4th of July fireworks show which
- 2:08:06became very popular very quickly, the
- 2:08:09city of Sunnyside supported that
- 2:08:12endeavor as well and throughout the
- 2:08:14years it has been in our contingency
- 2:08:18fund, an line item that has come up to
- 2:08:20usually $5,000
- 2:08:22for the Lions to order the fireworks.
- 2:08:25Now we put on a show, an $8,000 show,
- 2:08:28every year that I've been able to manage
- 2:08:30it, get enough money to do that.
- 2:08:33So, it's um again coming up. This year,
- 2:08:36we're going to be celebrating America's
- 2:08:38250th anniversary with the signing of
- 2:08:41the Declaration of Independence. We're
- 2:08:43going to have the pool is going to be
- 2:08:45open again. We're getting some good
- 2:08:46support for that. We're getting some
- 2:08:48good support for the people who are
- 2:08:50going to do a little mini uh reader's
- 2:08:52theater on the Declaration signing of
- 2:08:55the Declaration of Independence. We uh
- 2:08:58um
- 2:08:59Well, then of course, we have games down
- 2:09:01there. We have bingo. We have face
- 2:09:03painting. We have
- 2:09:05all coloring contest. We have all kinds
- 2:09:07of fun stuff.
- 2:09:09And uh we invite the community to come
- 2:09:11down. We'll have the the Laurel Valley
- 2:09:13Honor Guard
- 2:09:16be there. We're going to try to honor as
- 2:09:17many branches of this of the military
- 2:09:20that can be there as long as as well as
- 2:09:22Boy Scouts, Girl Scouts, and any other
- 2:09:25explorers, police explorers, and even
- 2:09:27some volunteer firemen should we get
- 2:09:29them down there as well.
- 2:09:31So, um so, my request tonight is as as
- 2:09:34Lions and having been served as the
- 2:09:37chair of that committee, which is why
- 2:09:38it's kind of been difficult for me to
- 2:09:40vote on it every time cuz I feel a
- 2:09:42little
- 2:09:43like I shouldn't. But, I I want to
- 2:09:46desperately vote on it and say, "Yes, we
- 2:09:48should do this." cuz every dollar goes
- 2:09:51directly towards making this event
- 2:09:52possible. Every dollar that we get from
- 2:09:55the city, that goes right back into the
- 2:09:574th of July celebration.
- 2:10:00So, I'm hoping that
- 2:10:02um
- 2:10:03one of the other things I wanted to
- 2:10:05mention about attendance,
- 2:10:07you don't know how many people are there
- 2:10:10until you turn on the lights at the end
- 2:10:13of the show.
- 2:10:14And then that field is full of uh
- 2:10:17blankets and little kids and chairs and
- 2:10:20grandmas and grandpas clear to the
- 2:10:2250-yard line on that football field and
- 2:10:24up into the stadiums as well.
- 2:10:27So, I just I just hope that the council
- 2:10:29can see their way clear tonight to um
- 2:10:35sponsor you know, sponsor the fireworks
- 2:10:37show again this year in the amount of
- 2:10:39$5,000.
- 2:10:40And um
- 2:10:42even though we asked for a uh a waiver
- 2:10:45on the fireworks uh the police standing
- 2:10:48by,
- 2:10:49we love you as firemen. We feed you at
- 2:10:52least once a year and the police chiefs
- 2:10:54crews, we do them, too. We always manage
- 2:10:57to get more food to them than
- 2:10:59as as the case may be. So, we'll we'll
- 2:11:02figure out something. Don't don't worry.
- 2:11:03I'll figure out something.
- 2:11:05But anyway, that's that's my request.
- 2:11:07That's the little bit of the history and
- 2:11:09I I certainly hope that
- 2:11:12we can celebrate the Declaration of
- 2:11:14Independence with a huge fireworks show
- 2:11:17this year. Thank you.

- 2:11:49uh at uh 6:00 will include a financial
- 2:11:52update from our finance director.
- 2:11:55Be going over our financial situation
- 2:11:57and answering any questions.

- 2:12:01giving uh an update on her progress for
- 2:12:04reconciling all of our books over the
- 2:12:06last few years.
- 2:12:08Uh we'll also be uh discussing the
- 2:12:11process for a permanent city manager
- 2:12:15and going [clears throat] through that
- 2:12:16process. It's typically about 4 months
- 2:12:19it takes to do that, so we should
- 2:12:20probably get that started.
- 2:12:22Uh and that might include using
- 2:12:26a firm that we've done in the past or
- 2:12:27selecting a new firm. I'll have options
- 2:12:29for you to consider for that at our
- 2:12:32upcoming retreat.

- 2:12:50was contacted by uh Pete Marquez uh for
- 2:12:54the usage of the baseball field at
- 2:12:56Sunnyview Park. Um he has a baseball
- 2:13:00club, Monarch Baseball, um and they're
- 2:13:03wanting to clean up the area,
- 2:13:05uh edge the field, drag the dirt, make
- 2:13:08it more playable.
- 2:13:10Um
- 2:13:12have access to water, uh so they can
- 2:13:14practice there. Um
- 2:13:17they they'll be practicing about
- 2:13:21once a week during the summer. It's a
- 2:13:22summer program that he's getting
- 2:13:24together. Uh I have
- 2:13:27uh a baseball uh team schedule
- 2:13:31uh that they'll be playing in games, so
- 2:13:32they just want to use Sunnyview Park as
- 2:13:34practice right now with a possible
- 2:13:36future using it um
- 2:13:39to make like these one or two fields at
- 2:13:41the size of where they'll be able to
- 2:13:42play baseball. Um but I'll bring that to
- 2:13:45council um obviously during that
- 2:13:48possible time. That's future
- 2:13:49discussions. Um but, you know, they want
- 2:13:51to use the baseball fields for this
- 2:13:53summer. Um he has sent me
- 2:13:55uh insurance, so he'll be covering his
- 2:13:58own insurance. He'll be taking care of
- 2:14:00all the maintenance out there. Um I did
- 2:14:02bring it up to uh my our city manager.
- 2:14:05Um
- 2:14:06so I'm updating uh council with that. Um
- 2:14:10that uh we have also been donated uh
- 2:14:13flags by the Rotary.
- 2:14:15They they're paying the cost for all 32
- 2:14:17flags that we will be purchasing under
- 2:14:21them.
- 2:14:22Um
- 2:14:23Uh just to also update you on the grants
- 2:14:27through
- 2:14:29um
- 2:14:30Capital Path that's been working on
- 2:14:32them. We have made it past the small
- 2:14:35list.
- 2:14:36So we will be being funded for the East
- 2:14:39Edison Bridge and the head works
- 2:14:42um
- 2:14:43at sewage treatment plant for the year
- 2:14:45fiscal year of 2027.
- 2:14:47Um once uh
- 2:14:50Wait, May
- 2:14:5221st I believe was Friday. That's when
- 2:14:55we're supposed to find out. I hadn't
- 2:14:57heard anything that day so I did make
- 2:14:59contact with John Colton on Sunday.
- 2:15:02I thought I was writing my memo for the
- 2:15:03council.

- 2:15:20ones I'm working on right now also.

- 2:15:25in January when Jim Burgess was still
- 2:15:27here. I believe it was myself, Tom

- 2:15:36and then we have hired a code
- 2:15:39enforcement. They will start June 1st.
- 2:15:42Um Jason Moore who was uh
- 2:15:45who is in the street departments right
- 2:15:46now will be coming to code enforcement.
- 2:15:49Um so we will have an opening in the
- 2:15:50street department. Uh and
- 2:15:53working with the pool,
- 2:15:55all staff summer staff has been asked if
- 2:15:58they would like to come back or
- 2:16:01be part of it. Everybody said yes.
- 2:16:03So summer swimming pool starts will be
- 2:16:06going. I believe tomorrow we'll be doing
- 2:16:07some clean up between 5:30 and
- 2:16:106:00 or 7:30
- 2:16:12um tomorrow and Thursday.
- 2:16:14Um
- 2:16:16and then Thursday is uh Harvest Food
- 2:16:18Second Harvest Food Drive, which will be
- 2:16:20closing off um
- 2:16:23off of uh Edison uh parking lot. That's
- 2:16:27where they'll be having the semi and
- 2:16:29other uh volunteers there to
- 2:16:32uh give out food.
- 2:16:34So, um and then Friday I'll be working
- 2:16:36with Leo and Miss Mejia on the other uh
- 2:16:412026 uh fiscal year money that we
- 2:16:44received back in 2025
- 2:16:47uh to get caught up.

- 2:16:54>> Yes, they're the flags that are 6 by 8
- 2:16:57uh 5 by 8 10 um bigger flags. They're

- 2:17:54had a fairly busy week, 124 calls for
- 2:17:56service. Um brings our yearly total to
- 2:17:591,815.
- 2:18:01Participated in just over 115 training
- 2:18:04hours, bringing our annual total to
- 2:18:051,928.
- 2:18:08Um and uh one other thing I just wanted
- 2:18:10to uh throw out there is we had a
- 2:18:12donation of a pallet of drinking water
- 2:18:14to the fire department. I was not able
- 2:18:16to get um the name of the individual or
- 2:18:19individuals who made that donation, so I
- 2:18:21would just like to publicly thank those
- 2:18:23uh that community member or members who
- 2:18:25made that uh donation to the fire
- 2:18:27department. It uh as we go into an a
- 2:18:29very expected hot uh rigorous summer, uh
- 2:18:31drinking water is quite literally a
- 2:18:33lifesaver. So,
- 2:18:35to those who did, thank you very, very
- 2:18:36much.

- 2:18:42got just a couple of things.
- 2:18:44We were [clears throat] awarded a uh
- 2:18:45health grant through the um Criminal
- 2:18:48Justice Training Commission. We'll be
- 2:18:49able to update some of our workout
- 2:18:50equipment here at the police station.
- 2:18:52Um I In my um report, I'd mentioned that
- 2:18:56we were awarded a Bureau of Justice um
- 2:18:58vest grant. Um I got the amount for that
- 2:19:01is $5,143.
- 2:19:03And so, what that does is we buy our
- 2:19:04bulletproof vests, they reimburse us
- 2:19:06when we submit for that up to that
- 2:19:07amount.
- 2:19:08And then, also in my report, I mentioned
- 2:19:10that we had a shooting a week ago on
- 2:19:12Cemetery Road. And since we've been here
- 2:19:14at council, um
- 2:19:16they arrested two people on that. So,
- 2:19:18we've got two people in custody. So,
- 2:19:20that's all I have.

- 2:22:54individuals in municipal finance.
- 2:22:56The city has been challenged in recent
- 2:22:58years with significant turnover in the
- 2:23:00finance department.
- 2:23:02The intent is to have

- 2:23:31in the finance department. The intent is
- 2:23:33to have an objective evaluation of our
- 2:23:35financial condition and have Mike Mike
- 2:23:38provide some guidance on how we might
- 2:23:39structure this department moving
- 2:23:41forward.
- 2:23:42The city of Yakima used Mike to guide
- 2:23:45them in a priority-based budgeting and
- 2:23:46helped them to restructure their
- 2:23:48department to utilize leading practices
- 2:23:50in municipal finance.
- 2:23:52So, um
- 2:23:56is
- 2:23:57you know, among the various positions
- 2:23:59I'm trying to fill is our finance
- 2:24:01director position.
- 2:24:04We can't have somebody working remote in
- 2:24:06Alabama.
- 2:24:08And so, the question that is there
- 2:24:12is um
- 2:24:13personnel that
- 2:24:15Monica has brought in to replace her.
- 2:24:18She has doubts about him
- 2:24:21as a finance director in municipal
- 2:24:23finance.
- 2:24:25Um
- 2:24:26and
- 2:24:28I've never hired a finance director
- 2:24:30before. So,
- 2:24:32uh I'm hearing two sides of the story
- 2:24:36where one side is saying that person is
- 2:24:39not ready for that finance director
- 2:24:41role.
- 2:24:42Another person saying they are ready.
- 2:24:46And
- 2:24:47>> [clears throat]
- 2:24:48>> I'm wanting to bring in somebody who,
- 2:24:50like every other position I've tried to
- 2:24:52fill,
- 2:24:54uh utilize uh senior expertise in the
- 2:24:57evaluation of that process.
- 2:24:59Mike Bailey is
- 2:25:01uh long-time finance director at
- 2:25:03multiple cities. Uh he is a CPA. He's
- 2:25:08got a master's in business
- 2:25:10administration.
- 2:25:12And so, he worked for MRSC for many
- 2:25:14years as a
- 2:25:16uh a financial advisor, conducted
- 2:25:19seminars through AWC,
- 2:25:21and currently is semi-retired as a
- 2:25:24consultant.
- 2:25:25So, the idea is that he would come here
- 2:25:27and evaluate what our situation is and
- 2:25:30what is the best structure for moving
- 2:25:31forward
- 2:25:32because this is the probably one of the
- 2:25:35biggest decisions for the city over the
- 2:25:37next few years. So, I want it to be a
- 2:25:39good one.
- 2:25:40And so, I'm um
- 2:25:42contacted Mike.
- 2:25:44Uh as I said,
- 2:25:46he worked in Yakima. So, initially, I
- 2:25:49got information from the city manager
- 2:25:51there, um Vicky Baker,
- 2:25:53who said that they had doubts about how
- 2:25:56Yakima was running in in their city, and
- 2:26:00they brought in Mike to do an assessment
- 2:26:02of that and worked with the council
- 2:26:04to um best structure the city
- 2:26:06department.
- 2:26:08So, that's what this uh professional
- 2:26:09service agreement is. It's um
- 2:26:12specific to a task, and has a not to
- 2:26:15exceed amount.

- 2:26:47Uh he tells her she she uh he has, you
- 2:26:50know, his tasks are supervisors of the
- 2:26:53finance clerks. That's what his job is
- 2:26:56as financial supervisor.
- 2:26:59And um
- 2:27:02uh
- 2:27:03having never been a municipal finance
- 2:27:06director,
- 2:27:08you know, that after 2 and 1/2 months,
- 2:27:11I've got to make an assessment of
- 2:27:12whether or not he's the guy to take over
- 2:27:14that job.
- 2:27:15And I'm not sure that that is I'm
- 2:27:18capable of making that decision.
- 2:27:20So, I'm trying to have a third party,
- 2:27:23somebody who knows and who's also CPA,
- 2:27:27uh whether or not a
- 2:27:29a private practice CPA can come in and
- 2:27:32become the municipal finance director
- 2:27:33for the city of Sunnyside. That's a big
- 2:27:35decision.
- 2:27:37So,
- 2:27:37>> I just have a quick question for legal.
- 2:27:39Are Are we allowed is is this personnel
- 2:27:42conversation?
- 2:27:44>> Stick to the
- 2:27:45contract piece.

- 2:27:52conversations when it's regarding
- 2:27:53personnel.

- 2:28:58her contract is going to come to an end.
- 2:29:00So I have to make a decision of who's
- 2:29:01going to be the next finance director.

- 2:29:09>> Well, I I guess I am I'm having a little
- 2:29:12I just don't want to cross the borders
- 2:29:14on
- 2:29:15personnel issues, but um
- 2:29:18I just find it a little difficult when
- 2:29:21we don't have the the budget's not
- 2:29:23reconciled yet and we don't know where
- 2:29:26we stand and to have that extra expense.
- 2:29:30I personally have sat into in the
- 2:29:32finance meetings and
- 2:29:36I think Leo is very competent. I mean,
- 2:29:39he's a very he has new ideas, great
- 2:29:42ideas that I think are working so far. I
- 2:29:44mean, I'm not in Monica's shoes or
- 2:29:46anything, but it seems to be working and
- 2:29:50maybe there's just a mis- misconnect
- 2:29:52because they have different ideas on on
- 2:29:55on what works best, but um
- 2:29:57so I'll just give that opinion because
- 2:30:00like I said, I don't want to cross the
- 2:30:01line on
- 2:30:02any personnel comments.
- 2:30:05>> Right, you know what I'm looking for are
- 2:30:07flags.
- 2:30:09And flags are coming up, not just from
- 2:30:12one person, but from other staff
- 2:30:14members.
- 2:30:15>> Um let me come to Council Galvan since
- 2:30:17he hasn't gone and then I'll come right
- 2:30:19back to you. Go ahead, Council Galvan.
- 2:30:20>> So
- 2:30:23So this is this contract would be for
- 2:30:24$10,000 at $220 an hour equals out to 45
- 2:30:29hours.
- 2:30:30I we're pretty confident that he can
- 2:30:32make the decision in in within those 45
- 2:30:34hours.
- 2:30:35>> Right, it's not to exceed that amount,
- 2:30:36so it could be less. And the idea is
- 2:30:39that he would have interviews, he would
- 2:30:40meet people, he would discuss, he would
- 2:30:42talk,
- 2:30:43get clarity on the our financial
- 2:30:45situation,
- 2:30:46and provide a report as to how how to
- 2:30:49best move forward. It's not making any
- 2:30:51decisions on positions, it's just making
- 2:30:53sure that the the personnel that we
- 2:30:56currently have are the right positions
- 2:30:58if they are to be advanced to a very
- 2:31:01large position, if they're ready.
- 2:31:04Uh
- 2:31:05you know, 2 and 1/2 months in and and
- 2:31:08never having been in the public sector
- 2:31:11is a scary decision to make to advance
- 2:31:14that person to the finance director
- 2:31:16position.
- 2:31:17And I just want to make it more
- 2:31:18carefully. So I'm utilizing people who
- 2:31:21who are far more experienced in finance.
- 2:31:24And I remember when I had my meeting
- 2:31:26here when when I was being interviewed,
- 2:31:28I told you I didn't come up through the
- 2:31:29finance department. So, I don't know
- 2:31:31necessarily who's right and who's
- 2:31:33telling me
- 2:31:34what is correct, but I've been receiving
- 2:31:36all sorts of information from all sorts
- 2:31:38of different people.
- 2:31:40And flags are coming up, and I'm not
- 2:31:43wanting to ignore those flags.
- 2:31:45Yet, I don't know I need some more
- 2:31:47judgment as to how to move forward.

- 2:32:13Because I want a third-party assessment.
- 2:32:16I don't want this to come down to a uh
- 2:32:18a battle of wills or a battle of
- 2:32:20personalities.
- 2:32:21Uh and I don't want it to become a a
- 2:32:24judgment based on, you know, feelings.
- 2:32:26Uh
- 2:32:27Uh and and a person's likability is a
- 2:32:30very important factor, and skill sets
- 2:32:32are very important factor.
- 2:32:35But, I don't want to move somebody into
- 2:32:37position at a level that they could not
- 2:32:40perform at. I mean, you you're talking
- 2:32:41about auditors, RCW's, auto fluid rules
- 2:32:46that are necessary as a finance
- 2:32:48director. And if you're putting somebody
- 2:32:49in that position who's never had that
- 2:32:52role,
- 2:32:53you want to make that decision very
- 2:32:54carefully. I'm sorry. [clears throat]

- 2:32:59>> Yeah, I uh
- 2:33:01was just thinking about his resume or
- 2:33:03what we've heard of his resume. I'm
- 2:33:04impressed because if you're
- 2:33:07working at MRSC, you have a
- 2:33:10fair amount of knowledge there.
- 2:33:12And uh sitting in finance today in the
- 2:33:15finance committee meeting,
- 2:33:17I uh I just started thinking hearing
- 2:33:20this that how wonderful it would be to
- 2:33:23have somebody like him sitting in that
- 2:33:25meeting with us and give us direction.
- 2:33:27I mean, there's a lot there to
- 2:33:29thought about getting a box of tissues,
- 2:33:31but
- 2:33:32um there's a lot there to work with. I
- 2:33:35think if you have somebody with that
- 2:33:37kind of a background
- 2:33:38talking to
- 2:33:40our finance committee and how to go
- 2:33:43about things.
- 2:33:45I mean, I It could confirm We saw
- 2:33:47results.
- 2:33:48>> Could confirm the direction that we want
- 2:33:49to go.
- 2:33:50>> Yeah.
- 2:33:50>> Could confirm that.
- 2:33:52But like I said, it's a bigger decision
- 2:33:53that I want to make in a vacuum, and I
- 2:33:56don't think any of us are qualified to
- 2:33:58make financial
- 2:33:59director decisions.
- 2:34:01>> Well, and I don't think it's a matter of
- 2:34:02personalities. I think it's a matter of
- 2:34:05background and and knowledge and

- 2:34:18determine the direction that we need to

- 2:34:22potentially save

- 2:34:26road in either making the bad or wrong
- 2:34:29decision or the correct decision,
- 2:34:31um I'm all for it. Um

- 2:34:44was just kind of thinking like what if
- 2:34:46we divide it in half and not changing
- 2:34:48not to change the contract or anything,
- 2:34:49but more so like an update at the
- 2:34:5122-hour mark. Is it possible like maybe
- 2:34:54like add language or kind of just like
- 2:34:56direct them to give us an update?
- 2:34:58>> What kind of with Augur Murphy Wallace
- 2:34:59like yes, kind of like a halfway mark
- 2:35:01and just kind of give us some direction
- 2:35:02or some feedback that way we know if we
- 2:35:05want to continue or not. I think that
- 2:35:07would be wise to do.
- 2:35:10>> Yes, I um
- 2:35:14I love that idea. Uh it would, you know,
- 2:35:16kind of get us halfway to say are we
- 2:35:20are we making the direction that we
- 2:35:22want? Um
- 2:35:24I'm
- 2:35:26you know, these decisions are long-term,
- 2:35:29you know, and if you look at our finance
- 2:35:31department is to like gosh, it is
- 2:35:34going through so many and
- 2:35:37you know, you need some continuity in
- 2:35:38that department to really figure out how
- 2:35:40things are going and we just not have
- 2:35:41had it.
- 2:35:42And so I'm trying to make that decision
- 2:35:45for the group that will have the long
- 2:35:48best long-term value.
- 2:35:50>> Okay.

- 2:35:52>> So if this is regarding, you know,
- 2:35:55hiring the right person or whatever,
- 2:35:57right personnel. Um so
- 2:36:00is he just going to like job shadow to
- 2:36:02make sure they know they're up to par,
- 2:36:04the level or
- 2:36:06>> Well, I'll leave that up to him. He's
- 2:36:09done this many other places and so he he
- 2:36:11actually was very
- 2:36:13enthusiastic about it saying, I love
- 2:36:15doing these kind of projects. So he will
- 2:36:16probably conduct interviews
- 2:36:19and get information and background and
- 2:36:21get a
- 2:36:23you know, kind of a
- 2:36:2430,000 view of where we're at and how
- 2:36:26we're doing. He also [snorts] has so
- 2:36:28many knowledges of RCWs he can know
- 2:36:29where we're
- 2:36:31in the shadows, you know,
- 2:36:33and we don't want to be in the shadows.

- 2:36:54No, but I I felt like a sense um I I I
- 2:36:59appreciate the idea and having
- 2:37:02this the the professional services
- 2:37:04agreement with this gentleman. I think
- 2:37:07we need to do that. I think that'll
- 2:37:09settle a bunch of questions that uh
- 2:37:13that we that we have that we just want
- 2:37:16to make sure that we're going down the
- 2:37:17right direction. We feel like we are
- 2:37:19kind of moving in the right direction
- 2:37:20with the
- 2:37:22uh
- 2:37:22with working with the finance
- 2:37:23department. They've um especially now, I
- 2:37:27think we've had less um
- 2:37:30less Alabama less Alabama hands and more
- 2:37:34uh Sunnyside hands on on the finances
- 2:37:36and it's
- 2:37:37I think that we're getting pretty good
- 2:37:39results from from all the questions that
- 2:37:41we have. And he's also you know, so I
- 2:37:44think that if this gentleman uh Mr.
- 2:37:46Bailey here could could come in and
- 2:37:48confirm that or maybe point us in a
- 2:37:50whole another direction, I think it's
- 2:37:52worth the money to do it.

- 2:37:57>> I was kind of weary with the idea just
- 2:38:00because um you know, like getting some
- 2:38:03feedback from the finance, you know, we
- 2:38:04still don't really know where we stand
- 2:38:05on the budget and you know, here's
- 2:38:06another contract for $10,000.
- 2:38:09Um and sometimes these hard decisions do
- 2:38:11have to come from a city manager and
- 2:38:13they have to come very quickly. And I
- 2:38:15feel like uh the finance
- 2:38:17department is is one, but then you know,
- 2:38:19the public works department is a whole
- 2:38:21another beast to handle as well. And I
- 2:38:23feel like there's a lot of
- 2:38:25decisions that should be made very
- 2:38:27quickly in that department as well. So
- 2:38:29anyways, I feel that you know, the city
- 2:38:30manager should be able to to conduct
- 2:38:32this as as as as thoroughly and quickly
- 2:38:34as we as we can without needing a
- 2:38:35consultant. But seems like the majority
- 2:38:38of the council wants to go that
- 2:38:40direction, so
- 2:38:41>> I I think we really need to. I think
- 2:38:43it'd be the professional thing to do.
- 2:38:45And um
- 2:38:47I I have some real strong feelings that
- 2:38:49I think that it that going going through
- 2:38:51and looking at the budget and and all
- 2:38:53the things that we have been doing, I
- 2:38:55think it's
- 2:38:56I think we're going to be surprised in a
- 2:38:58good way.
- 2:38:59We've had several already good news
- 2:39:02situations have come up um and I I that
- 2:39:05we're going to see more.
- 2:39:07>> Yeah, the
- 2:39:08uh we're approaching the time for
- 2:39:10doing the '27 budget.
- 2:39:12>> Right. So, we need to have this done
- 2:39:14right away.
- 2:39:15>> so um we're either going to put it in
- 2:39:17the hands of somebody who's never done a
- 2:39:19municipal budget ever.
- 2:39:21Going to put it in their hands to do it
- 2:39:23for the first time ever or we're going
- 2:39:26to utilize somebody who's done it many
- 2:39:29times and and and get it right. So, this
- 2:39:33is the enormity of the decision and the
- 2:39:35time frame it's it's got to you know
- 2:39:37>> Yeah, we have to
- 2:39:37>> the next thing is that on my list.
- 2:39:39>> When would we be starting on this?
- 2:39:42>> June 1st.

- 2:39:50days, you know, I just don't see a lot
- 2:39:52of time being spent on this. It's just
- 2:39:54pretty straightforward interviews,
- 2:39:56looking at our situation
- 2:39:58and making a recommendation. And we can
- 2:40:00hit them halfway as you're saying Karen.

- 2:40:33authorize city manager to sign the
- 2:40:35professional services agreement with
- 2:40:36Mike Bailey of Local Government Finance
- 2:40:38not to exceed 10,000.
