- 2:36>> So, we're going to go ahead and call
- 2:37this meeting to order at 6:02 p.m. For
- 2:41the record, all members of council are
- 2:43here with the exception of councelor
- 2:45Vasquez. Council members, I spoke to
- 2:47councelor Vasquez earlier today and she
- 2:49did ask for an excused absence. Um, she
- 2:54was going to try to log on, but it
- 2:56doesn't look like she's zooming in. Is
- 2:58there any objection
- 3:01with excusing councelor Vasquez?
- 3:03>> No question.
- 3:04>> Okay.
- 3:06So, for the record, councelor Vasquez
- 3:08has been excused for today's meeting.
- 3:11Um,
- 3:13and then also for the record, we have um
- 3:15staff here um all members of staff
- 3:19exception of Corey,
- 3:21Mr. Taylor. that.

- 3:26attorney on the line as well. And we
- 3:29still have Jet holding it down over
- 3:31here.

- 3:36we will go ahead and
- 3:39um go into actually before we go into
- 3:43agenda approval, I'm going to go ahead
- 3:44and read this.

- 3:47disturbance, but you know, you could if
- 3:49you like. I think I we should probably
- 3:51do some opening comments around this.

- 4:00>> with the intention of making sure that
- 4:03our meetings are running effectively and
- 4:05efficiently and without disruption. Um,
- 4:09I do want to remind everyone that this
- 4:12is a public meeting to conduct uh city
- 4:15business and we do welcome public
- 4:17attendance and val and value community
- 4:19engagement
- 4:21um and public comment um despite the
- 4:24nature of the comment um and um but you
- 4:29know we just want to make sure we keep
- 4:31it um we keep it moving along with as
- 4:35few disruptions as possible including
- 4:38including shouting, interrupting
- 4:39speakers or otherly other disorderly
- 4:41conduct. Um those will not be permitted
- 4:44by anyone. Um and anyone who engages in
- 4:47such behavior may be asked to leave so
- 4:49the meeting can proceed. And we want to
- 4:51thank everybody in advance for their
- 4:53cooperation. So just a just to set some
- 4:56agreements and expectations amongst all
- 4:58of us here in the chambers. There will
- 5:00be a reminder. we will escalate that to
- 5:03a formal warning and um if that needs a
- 5:08follow through we will be directed
- 5:10directing um Chief Layman to uh help
- 5:15remove disruptive individuals um if that
- 5:18didn't follow prior warnings. So this
- 5:21does apply to everyone and I will be
- 5:24using my gavvel. I was told that I need
- 5:27to use the gavvel. Um oftentimes you
- 5:29don't expect disruption. it hadn't
- 5:31hasn't really been happening. We're all
- 5:33just here to listen, to learn, and to
- 5:35try to get through things together
- 5:38irregardless of um where we stand on
- 5:41issues. Um so, we just want to make sure
- 5:43that we're getting through things and
- 5:45we're not being disruptive of us
- 5:46conducting business. This is why we're
- 5:48here for. This is a council meeting and
- 5:50like you all know, we have a ton of work
- 5:53ahead of us and we're just going to try
- 5:54to and we're, you know, we're trying to
- 5:56get through that. That that definitely
- 5:58is the end goal of the meeting. Um, so
- 6:00just wanted to state that for the record
- 6:02before we move into agenda approval.
- 6:06So, council members, we do have an
- 6:08amendment to the agenda.
- 6:12Um,
- 6:13if you have it in front of you on your
- 6:15laptops, you will see that there was an
- 6:18item added at the end. It's item H. It
- 6:21is a budget amendment topic and um that
- 6:26will be presented by Pat Haley uh to us.
- 6:29So um if I can entertain a motion
- 6:34um to adopt the amendment to the budget
- 6:37for today's meeting.

- 7:06of the action agenda. It's the last
- 7:08thing. It it doesn't don't want to
- 7:10disrupt the other action items, but it
- 7:12has to be on the agenda.

- 11:06So, my name I'm just going to ask folks
- 11:09to stand. If you're able to um please go
- 11:11ahead and stand, but please remain
- 11:12standing for the pledge of allegiance.

- 11:21>> Okay. So, thank you for having me. My
- 11:24name is Emanuel Suarez,
- 11:26lead pastor of Victory City Church, also
- 11:28funeral director at Smith Funeral Home.
- 11:30It's an honor to be here.
- 11:31So, Father, we just we just raise our
- 11:34hands, God, today. And we just come
- 11:36before you, Lord, as your word says to
- 11:38come before your courts with
- 11:39thanksgiving, Lord. And no matter what
- 11:41has happened today, God, we just thank
- 11:43you. We thank you. We thank you because
- 11:45you are God and we are not. And in this
- 11:47moment, Lord, I just begin to lift up,
- 11:49Lord. Lift up this this council meeting.
- 11:51Lift up the leaders of Sunnyside, God.
- 11:53the leaders that have been appointed for
- 11:55such a time as this God that have been
- 11:57appointed, anointed and mantled, Father,
- 11:59to bring forth, Father, leadership
- 12:01within this city, Lord, that others can
- 12:03see, Father, that the spirit of
- 12:04leadership still lives and the spirit of
- 12:06leadership still resides, Father, in
- 12:08this city, God. And so I just pray,
- 12:10Father, beginning with godly wisdom,
- 12:12Lord. We pray for godly wisdom at this
- 12:14moment Lord that our earthly humanistic
- 12:17earth earthly wisdom God may decease
- 12:20Father and that we come alive with godly
- 12:22wisdom God and that is looking to the
- 12:25hills from where our help comes from.
- 12:26Our help comes from the Lord. So we pray
- 12:28for godly wisdom today Lord then leaving
- 12:31all man agenda behind Father. And we
- 12:33just pray Lord that you give us the
- 12:35wisdom the wisdom over each and every
- 12:37person in this place God to be able to
- 12:40bring heaven on earth God according to
- 12:42your will and your purpose in the name
- 12:44of Jesus. Father we pray for unity Lord
- 12:46we pray for unity father that everything
- 12:48Father every skin color it fall at the
- 12:51door when we walk in this place God that
- 12:53every agenda our personal agenda fall
- 12:55God that we be able to be united Father
- 12:58as you said so beautifully on the cross
- 13:00dying in your last couple of words. Let
- 13:02them be one as you and I are one. Let
- 13:05there be unity today in the name of
- 13:07Jesus. Father, we pray God for the needs
- 13:09of the community at large. God, we pray
- 13:11for the orphans, the widows. We pray for
- 13:14those that are on the brink of divorce.
- 13:16We pray God for the marriages, for the
- 13:18school districts. We pray, God, for our
- 13:20teachers. We pray for our our our
- 13:22community at large. Father, for those
- 13:24that don't have, we pray, God, that you
- 13:26supply according to your riches and your
- 13:29glory, God. We pray for the safety of
- 13:31our community Lord. We pray God let
- 13:34Sunnyside be known for safety Lord in
- 13:36Jesus name. Let gang violence go down
- 13:39and let peace come and let it be arose
- 13:41God. Let it arise God. Let people be
- 13:44able to say that Sunnyside is a safe
- 13:47place to live in the name of Jesus. We
- 13:49pray God. We pray for the safety for
- 13:52individuals and for businesses. We pray
- 13:55for each business God that is has has so
- 13:57boldly
- 14:00so boldly said within themselves that I
- 14:02want to do something in this city God.
- 14:04We pray that you prosper them, that this
- 14:06be a prosperous city, God, that you open
- 14:08the floodgates, that the heavens be
- 14:10open, God, that finances, that the
- 14:12people may find work, that they the
- 14:15economic system within this city, God,
- 14:17may be able to grow and that we lack
- 14:20nothing in this city, Father, we pray in
- 14:22Jesus mighty name. Lord, we pray also
- 14:25something so precious, God, we pray for
- 14:27the safety, the safety of our children,
- 14:29God. We all pray for the safety of our
- 14:32children in this city, Father, because
- 14:34you said, Jesus, let the children come
- 14:36unto me. And we know, God, that you love
- 14:38children, Father. We pray, Lord, in
- 14:40Jesus name, for the safety of our
- 14:42children, wherever they may be, whether
- 14:43they're playing basketball in the city,
- 14:45whether they're playing basketball at
- 14:47their house, in the schools, God, we
- 14:49pray, God, that you bless them, Lord,
- 14:51wherever they are. Lord, we pray for
- 14:53each and every person that is in this
- 14:55room, God. Uh once again we pray for
- 14:57godly wisdom, Father. For wisdom that
- 14:59surpasses all human understanding, I
- 15:01just declare victory. Victory in the
- 15:03name of Jesus. What the devil meant for
- 15:05evil, God, you shall turn it around for
- 15:07good. We pray in Jesus mighty name so
- 15:09boldly, God. We pray knowing, Lord, that
- 15:12any man that makes a decision without
- 15:14counsel from on high, Father, is going
- 15:16to equal
- 15:18failure. So we pray, help us to humble
- 15:22ourselves, to repent, and help us to
- 15:24seek the maker of heaven and earth in
- 15:28the mighty name of Jesus. God, I pray
- 15:29for our mayor, Lord, that our mayor may
- 15:31be able to lead with boldness, with
- 15:33integrity, Lord, with with with
- 15:35holiness, Father. We pray, God, if you
- 15:37could do it in Nineveh, Father, if even
- 15:39the animals could humble themselves,
- 15:41God, and repent, Father, I pray, God,
- 15:43that you you give our mayor what she
- 15:46needs in this time, God. We thank you
- 15:47because she's like an Esther that she is
- 15:50here for such a time as this, God. And I
- 15:52just bless our mayor. Help our mayor
- 15:54Lord to lead us well in victory in the
- 15:57mighty name of Jesus. God, we give you
- 15:59all the glory, all the praise, all the
- 16:01honor, all the adoration for all things
- 16:03that we see are from you. They go back
- 16:07to you and they are for you in the name
- 16:09of Jesus. God, we give you the glory in
- 16:11Jesus mighty name. And everybody says
- 16:14amen.
- 16:15Amen. Amen. Thank you.

- 17:21>> Okay. So, there's um a proclamation
- 17:24being brought forth. I don't know if
- 17:26that was you, Deputy Mayor, or Mr. Haley
- 17:29put it on the
- 17:30>> This is the 38th annual Cinco de Mayo
- 17:32Festival. And so, this is a proclamation
- 17:34to acknowledge that and to welcome
- 17:37people to our city.
- 17:38>> Yeah. And let me just take a sip of
- 17:46Okay.
- 17:47>> So, yes.
- 17:48>> So, 38th year celebration of Cinco de
- 17:51Mayo and um we know that's a def a big
- 17:53celebration happening in in our
- 17:55community. It's been happening in our
- 17:56community for as long as I can remember.
- 17:58Um and um and we are coming up on that
- 18:02weekend uh where um so many community
- 18:05members um the Rotary Club have been um
- 18:08behind this effort. So um this
- 18:11proclamation is before us. I would like
- 18:13to entertain a motion to uh pass the
- 18:17proclamation celebrating the 38th 38th
- 18:20year of of Cinco de Mayo.

- 18:31I move to approve the resolution to
- 18:32recognize the 38th annual Cinco de Mayo
- 18:35Festival in Sunnyside May 1st, 2nd, and
- 18:383rd of 2026.

- 19:14now read the proclamation into the
- 19:16record.
- 19:18Okay. Whereas the Cinco de Mayo holiday
- 19:21commemorated the victory of the Mexican
- 19:23people over the French army at the
- 19:24battle of Puebla on May 5th, 18662.
- 19:28And whereas the city of Sunnyside is
- 19:31home to a significant Latino population
- 19:33and we wish to honor the community
- 19:35groups and individuals of this
- 19:36community. And whereas we recognize the
- 19:39strong cultural and familial ties in
- 19:41Sunnyside as we commemorate the 38th
- 19:43Sunnyside Cinco de Mayo Festival in
- 19:45downtown Sunnyside by exploring foods,
- 19:48traditions, and entertainment. And now
- 19:51therefore, I, Vicki Frato, mayor of the
- 19:53city of Sunnyside, Washington, by virtue
- 19:56and the authority vested in me by the
- 19:58laws of the state of Washington, and on
- 19:59behalf of the city council, do hereby
- 20:01proclaim May 1st through the 3rd of this
- 20:04year, 2026, as the 38th annual Cinco de
- 20:08Mayo Festival in the city of Sunnyside
- 20:10honor and celebrate me Mexican's
- 20:12heritage, culture, and history.
- 20:15In testimony whereof, I have I have here
- 20:18unto set my hand and cause the seal of
- 20:20the city of Sunnyside to be affixed done
- 20:23at the city of Sunnyside this 22nd day
- 20:25of April in the year 2026.
- 20:28So, I'll go ahead and get that sign when
- 20:30we have a copy of it.
- 20:32But thank you for getting that on the
- 20:34agenda. And if you all have some time
- 20:36this weekend, um I believe the event
- 20:40commences on Friday and it takes us in
- 20:42through Sunday. And I have seen some of
- 20:45the flyers and seems like there's going
- 20:47to be a lot of activity out there. So,
- 20:49um go ahead and go out and support local
- 20:51and support the city.
- 20:54Okay,
- 20:56moving into the next item of the agenda
- 21:03are public comments on the agenda. So I
- 21:07have sorry I have um just to confirm
- 21:11there's nobody signed up for public
- 21:13comment around agenda items. Oh yes.
- 21:17Yeah. Okay. Uh, council, if there's no
- 21:20objection, um, uh, Miss, um, Moore, uh,
- 21:24reached out earlier asking if, um, they
- 21:28she it would be able along with some
- 21:30high schoolers, I believe, uh, that work
- 21:32with her, provide an update about the K9
- 21:34fundraiser, and they do have school, so
- 21:38they wanted to get this done sooner than
- 21:40later during the council meeting. Is
- 21:42there any objection for allowing them to
- 21:44do public comment now?
- 21:47>> No objection. Okay, go ahead and
- 21:49approach the podium.
- 21:57>> Hi, my name is Angelina Esposa and I'm
- 22:00from Graan View. So, I just wanted to
- 22:02give you guys a quick recap on how our
- 22:05um fundraiser went for the Sunnyside
- 22:08Police Department K9 unit. First of all,
- 22:11I want to thank you guys for letting me
- 22:13speak right now a little early. And then
- 22:16um I also want to thank on behalf of
- 22:18Bob's Drive-In the Sunnyside Police
- 22:20Department and surrounding sheriff
- 22:22offices for stopping I mean officers for
- 22:25stopping in. And um thank you for all
- 22:28the K9 dogs and all of their handlers
- 22:32for stopping by and doing some
- 22:33demonstrations. We also had some
- 22:36t-shirts made for this fundraiser that
- 22:38all the staff wore. So, it's the one I'm
- 22:41wearing has the puppy on it and then the
- 22:44back it says we back the blue. So,
- 22:48I think we have extra. So, you know, if
- 22:50you want to purchase one, you know, hit
- 22:51up Brit. But yeah, and then also um
- 22:55thank you to Tony Clearary Mororrow for
- 22:57donating the big dog basket. It had like
- 23:00I think $120 worth of like cool dog
- 23:04items. So, yeah. And then
- 23:08um so we had a couple different ways
- 23:09that we were raising money. So we had
- 23:11like a guess the treat thing where we
- 23:13just had like a like a mason jar like a
- 23:15really big one like filth of a bunch of
- 23:17dog treats and whoever guessed it was
- 23:19going to win like the whole bucket. So
- 23:21those will be announced tomorrow. Then
- 23:24um us employees donated back all of our
- 23:27tips. So that was about $90. The spin
- 23:31the wheel made about $30. Um, every like
- 23:35everybody who was like in uniform got a
- 23:37discount. So like police officers,
- 23:39firefighters, and they had an option
- 23:40like to donate back their discount. So
- 23:43we made $26 in that. And then the raffle
- 23:47made about $175.
- 23:49And then we also had a paw wall where
- 23:51you could write your name and then how
- 23:52much you donated. That made about $445.
- 23:55And then we do plan on giving that um
- 23:59back over to I think it was the
- 24:03sheriff's office or the and then so
- 24:07people can continue to donate. And then
- 24:10from 2025 to 2026, we also have the
- 24:13black and blue burger and some of the
- 24:15proceeds go towards the police
- 24:17department. So that's made about $300.
- 24:20And then we sold about four K9 like dog
- 24:24stuffed animals and that made about 100.
- 24:26So in total from the fundraiser we made
- 24:29about $1,17642.
- 24:34So yep, that's about all I have for you
- 24:36guys today. Thank you again for letting

- 25:09giving us the opportunity to have that
- 25:10event down there and and uh it went
- 25:12really well, I thought. So, thank you.

- 25:47grassroots fundraising going, that helps
- 25:49to speed up any other funding that's
- 25:52going to start happening, too, I'm sure.
- 25:54And, uh, that was a wonderful thing your
- 25:55your your team put together. That was a
- 25:58good deal.

- 26:05little bit more about that black and
- 26:06blue burger? What's what's in it?
- 26:09that we created

- 28:09Leo, our our um finance supervisor here.
- 28:13Um Mr. Leo and we went through
- 28:15everything. We had some questions if you
- 28:17recall from the last meeting um
- 28:20reference the um some of our uh billings
- 28:24for uh lawyer fees and we were looking
- 28:28at those from uh from the um sorry I'm
- 28:32looking up the name here Ogden Murphy
- 28:34and Wallace and uh we were kind of it
- 28:37was several months worth of of billing
- 28:39but it came out to be uh $67,575.72
- 28:452 cents and we did have some questions
- 28:47about some of that. Uh but I think that
- 28:49they were answered. It was just kind of
- 28:51a shock I think to the the size of the
- 28:53bill. I don't believe there was any
- 28:55other uh uh uh invoices uh andor and we
- 29:00checked invoices versus uh the items the
- 29:03checks as well. And so we we did that.
- 29:07We found everything to be in order. Uh,
- 29:09like I said, we did look at a couple
- 29:10extras, but mostly the big one with that
- 29:13kind of caught our eye was the uh one
- 29:14for the lawyer fee. Um, I don't know,
- 29:17Tom, did you have as your first time
- 29:19there, do you have anything else you
- 29:20want to add?
- 29:21>> Yeah, well, we had this uh this one
- 29:23sheet where it prints real small and we
- 29:26didn't go over that very much. I was
- 29:28kind of curious about some of the um
- 29:31the titles because the titles weren't
- 29:34very clear on some of it. I'm sure it's
- 29:35just uh something that needs to be added
- 29:37on the next one, but uh I can ask you
- 29:41about that at a at a later date.

- 34:27attorney and the uh, swim team
- 34:29representative. Uh, I can answer any
- 34:32questions if you have any.

- 42:24>> I defer to uh Rob. So, we've talked
- 42:27about this quite a bit, but this is the
- 42:29actual contract. Um, we waited until we
- 42:31had things worked out with the union to
- 42:33bring it to you. There's uh this has
- 42:34been through our legal. There's been a
- 42:36couple of changes that she suggested.
- 42:38one being extending the period of time
- 42:40that if either party decides to get out
- 42:42of the contract, it gives us more time
- 42:44to decide where we're going to go next
- 42:46because it was originally written, I
- 42:47think, for like 60 days. Well, that's
- 42:49probably not enough time to get
- 42:50everything moved over uh technologically
- 42:53uh wise, radio u equipment moved over
- 42:56and everything else. So, we extended
- 42:58that. Sheriff's office was um good with
- 43:01that. And then they had some things we
- 43:03needed to change in the payment
- 43:04schedule. And then uh as far as amounts
- 43:07weren't updated and then we asked for
- 43:08this to go through the end of next year
- 43:10because we're already halfway through
- 43:11this year. So
- 43:13I'm available for any questions.

- 43:30about this at our meetings. Um, so do

- 43:39the uh it says effective of first day of
- 43:42May, but we've uh our discussions are
- 43:44May uh June 1st. That would be the
- 43:46soonest probably
- 43:54>> and this goes through December
- 43:56>> of 2020 27.
- 43:57>> So, so this is a 26 and 27 contract.

- 44:05>> we have uh some parts we need to order
- 44:07to get our radio traffic up to their
- 44:09dispatch center. It's about $3500,
- 44:12$4,000 somewhere in that range. But we
- 44:15need to get um we needed to get this
- 44:17signed before we ordered that. So, it'll
- 44:19it'll take at least a couple weeks to
- 44:20get that installed.
- 44:24>> Just um one question, Chief. Um, I' I've
- 44:26seen online with where the community
- 44:28feel that, you know, by moving the
- 44:31dispatch over to to Yakma, the the
- 44:33service might change and whatnot, but I
- 44:36believe in my in my opinion, you know,
- 44:38it's the same dispatch, right? They they
- 44:40know what they're doing out there and
- 44:42they they do they have experience. The
- 44:44only thing is you might not have
- 44:46somebody with as much local knowledge.
- 44:48Um, but we are the only county in the
- 44:50state that does not have a countywide
- 44:52dispatch center. So the the goal is
- 44:55eventually to move the entire county to
- 44:57this and that actually it's been
- 44:58discussed within this county for
- 45:00probably 30 years or more. It's just
- 45:03never happened. The um the goal now is
- 45:06to have this done by the end of 27
- 45:09uh countywide. So there's a big push for
- 45:10this to happen. Actually the county is
- 45:12currently funding a study to determine
- 45:14how many dispatchers it would take, how
- 45:16many radio channels it would take, what
- 45:17departments would be on what radio
- 45:19channel. Um so that's currently in the
- 45:21process. the county is funding that.

- 45:33dispatchers? I know this was a topic of
- 45:35conversation the last time this came up.
- 45:37You said um that some of the dispatchers

- 45:45five dispatchers. So going off
- 45:47seniority, which is the way their union
- 45:49contract is spelled out, the top two in
- 45:51seniority would move to um uh jail
- 45:55support staff is what I believe we
- 45:56called it, and they would man that
- 45:58control center. Um there would be four
- 46:01people that are laid off. I know one um
- 46:03is currently doing a background to
- 46:05become a dispatcher in Grand View. One
- 46:07is currently in background to be a
- 46:09police officer for us. Um they're next
- 46:11up on the civil service list. And so I
- 46:13believe there's two that would um be
- 46:15laid off that that to my knowledge don't
- 46:17have a place to go that I'm aware of.

- 47:03C on the agenda. approving an MOU with
- 47:07Teamsters Local 760 regarding covering
- 47:11dispatch breaks.
- 47:15>> Okay, so as you can imagine, we had one
- 47:17employee that um when we started talking
- 47:19about this took a job at the Richland
- 47:21Police Department in their reception
- 47:22department and we lost the Toppenish
- 47:25contract, which is what started this
- 47:27whole thing, which was two dispatchers
- 47:28working at a time. We're now down to
- 47:30one. During the daytime, our um front
- 47:34desk services gal is a trained
- 47:37dispatcher and the dispatch supervisor
- 47:39when he's working is able to go up and
- 47:41cover breaks. What we have the issue is
- 47:43when there's no second dispatcher in the
- 47:45building and the dispatcher needs to
- 47:47take their um their breaks that are
- 47:49allotted to them by LNI.
- 47:52So, what we've asked and what we did
- 47:54years ago was we had the corrections
- 47:56officers cover those. So, we talked to
- 47:58the corrections officers. They came back
- 48:01and wanted um
- 48:04a high a pretty high number, and I told
- 48:05them there's no way that's going to
- 48:06work. So, what we settled on is a they
- 48:09would get a 10% pay bump while they're
- 48:12covering breaks. It's it'd be 1 hour per
- 48:1412-hour shifts. It'd be a 30 minute
- 48:16lunch and two 15-minute breaks. Um and
- 48:20they would they would get 10% pay bump,
- 48:22which is working out of class, which is
- 48:23in most of the contracts within the
- 48:25city. So, if you work a job that's out
- 48:27of your class, you usually get a 10% pay
- 48:30increase. They don't have that language
- 48:31in their contract. So, they ask for a
- 48:33memorandum of understanding to uh um
- 48:37to put that in writing. So, we'd be
- 48:40talking about a max of two hours a day
- 48:42that they would get 10% pay on top of
- 48:44what they get just during the just
- 48:46during the break coverage.

- 50:20defer to um uh deputy uh public works

- 50:29and Lincoln uh lift station replacement.
- 50:32Uh the projects uh occurred on April
- 50:351st, 2026. We had a total of four bids
- 50:38that were received. Uh the lowest
- 50:40responsive and respons responsible
- 50:43bidder had was seller construction HLA
- 50:47and land serving inc uh reviewed the
- 50:50received bids and have prepared a
- 50:52recommendation award for consideration.
- 50:54Acceptance of the recommendation award
- 50:56will allow the city to enter into the
- 50:57contract with the lowest responsive and
- 50:59responsible bidder in the amount of
- 51:01$926,7184.

- 53:03sewer uh funding. Um so we will not have
- 53:06to take any funding from general fund uh
- 53:08to subsidize and u get this completed.

- 55:10contract with the Wesley Group. They're
- 55:12out of the Tri Cities and they are
- 55:14consultants for uh labor negotiations as
- 55:18well as contract interpretations
- 55:20for um uh collective bargaining
- 55:23agreements.
- 55:24And uh they uh they don't necessarily
- 55:27replace an attorney, but they uh have
- 55:30services that is at a level that uh
- 55:34allows the city to save money for labor
- 55:37negotiation processes and interpretation
- 55:41of contracts.

- 56:30Typically, right now, we use our our
- 56:32attorneys to do labor negotiations and
- 56:35uh this person has been doing it for 39
- 56:37years and works with other cities, fire
- 56:39departments, police departments, and has
- 56:41a good cross-section of other cities our
- 56:44size. And so they provide the bargaining
- 56:46and negotiation process as opposed to an
- 56:48attorney. So we're not paying the
- 56:50attorney fee. However, we're not
- 56:52disengaging the attorney when it comes
- 56:54down to legal issues. They they then
- 56:56come to the team and provide that that
- 56:58professional service.
- 57:00>> So the current attorney fee is over 400.

- 57:05>> Our budget for attorney fees.
- 57:08>> That's what how much how much do we get
- 57:10charged hourly right now? Well,
- 57:12>> about $300 depending on the attorney

- 58:28the city of Tapenish for clerk
- 58:29mentoring.
- 58:32We have an interlocal agreement
- 58:33currently with the city of Toppenish to
- 58:36provide um usage of equipment or service
- 58:39or personnel and this goes back to I
- 58:41believe 2021.
- 58:43This is a subordinate to that agreement
- 58:45that now includes um services provided
- 58:49by their clerk team to provide
- 58:52mentoring, guidance, coaching, advice,
- 58:55assistance, question answers, whatever
- 58:57help uh that uh the new uh person that
- 59:01we're about to hire can have access to.
- 59:03So none of the office staff know
- 59:05anything about clerking. So who can they
- 59:08call? Well, this is a service provided
- 59:10by the city of Toppenish to provide that
- 59:12oversight.

- 59:32"We just don't have the time and energy
- 59:33to provide that service." So the other
- 59:36cities that I contacted asking for the
- 59:38same assistance, uh about 10 of them
- 59:40when I read to you the last time, the
- 59:42city of Tapenish was the only one, uh
- 59:44Tom, um
- 59:47I forget his last name now, uh who is
- 59:49the city manager there said, "Yes, we'd
- 59:51like to help you."

- 1:00:58imagine it's kind of covers their costs
- 1:01:01uh for having the time associated with
- 1:01:04it. The nice thing that we've been able
- 1:01:06to do is that we've provided them with
- 1:01:09laptop computers that connects to our
- 1:01:11system. So if something comes up that
- 1:01:13they need to provide us with actual
- 1:01:15documents, they can do it right there
- 1:01:17from their office and not have to make a
- 1:01:18trip here.

- 1:01:32the agreement for the criminal defense
- 1:01:34personal services. Um is that
- 1:01:37>> correct? doors open.
- 1:01:39>> Um, I brought this to you uh couple
- 1:01:42weeks, couple of council members,
- 1:01:45a couple of council sessions ago where
- 1:01:48there was not parody among the defense
- 1:01:50attorneys. And uh we went through a
- 1:01:53discussion as to the risk of of not
- 1:01:56accepting uh par uh keeping their rates
- 1:01:58at the current rate or bringing all five
- 1:02:01of them at the to have equal. and the
- 1:02:05risk was too high that we would not be
- 1:02:06able to service our contracts nor have
- 1:02:08other attorneys that could step up and
- 1:02:10take that position. So, uh, of the five
- 1:02:14contracts, four of them are up for
- 1:02:16renegotiation or or review in 2000 in
- 1:02:19end of this year at 2026.
- 1:02:22So, I believe I was given guidance to go
- 1:02:24ahead and approve an amendment or draft
- 1:02:26an amendment to their contracts that
- 1:02:29allows for uh this wage increase or or
- 1:02:32per case increase. is per case it I
- 1:02:35think it went from 340 to 377 now and uh
- 1:02:40so their case number remains the same uh
- 1:02:43but it it's retroactive to the beginning
- 1:02:46of the year January uh and so the amount
- 1:02:49of expenditure and an amount budgeted
- 1:02:52and the about of the budget amendment is
- 1:02:54listed there in the agenda bill.

- 1:03:05>> Um, I have a huge uh problem with this
- 1:03:08uh contract here just because
- 1:03:13it's very small. I mean, there's there's
- 1:03:15there's four items, five items here. It
- 1:03:18really doesn't address it only addresses
- 1:03:20the pay. We still don't know what
- 1:03:22standards, you know, we we operate in
- 1:03:25Sunnyside. Um, per RCW, we need to have
- 1:03:28a standard. um you know what what's the
- 1:03:31it doesn't address the case load limits,
- 1:03:33no performance standards, no reporting
- 1:03:35requirements, no training requirements,
- 1:03:37no support services. So
- 1:03:41we're kind of in my opinion, we're
- 1:03:43getting, you know, ahead of our
- 1:03:44ourselves here when we don't have any
- 1:03:47any actual standards that these uh
- 1:03:49defense attorneys are are following and
- 1:03:51and we're just giving them a raise. Um,
- 1:03:54you know, do we have a standard right
- 1:03:56now of of what?
- 1:03:57>> We have an existing contract
- 1:03:59>> and no standards for them to
- 1:04:01>> that defines their case load which is
- 1:04:03300 uh cases per attorney per year and
- 1:04:08it comes out breaks out to about 25 a
- 1:04:10month. And so we pay a retainer for uh
- 1:04:14those 300 cases. Uh so it would be 300
- 1:04:18time uh 25 divided by 12. So we pay that
- 1:04:23monthly and then at the end of the year
- 1:04:25we have what should be reviewed as a
- 1:04:28true up. So if they exceed that 300 then
- 1:04:31they get to uh identify what those
- 1:04:34actual cases that they are claiming that
- 1:04:38they uh are in excess of the 300 or the
- 1:04:42contract allows us that if the total
- 1:04:44amount is less by 10% of that 300 then
- 1:04:47they can have that their contract
- 1:04:50reduced by that amount. Uh there's
- 1:04:53supposed to be quarterly reporting. Uh
- 1:04:55again, I just came across this contract
- 1:04:58here recently, so I'm not familiar with
- 1:05:00the the frequency that they've been
- 1:05:02doing of that reporting, but this this
- 1:05:05is just an amendment to the existing
- 1:05:07contract. It doesn't replace the
- 1:05:09existing contract. It just changes the
- 1:05:11rate that allows them um the increase.
- 1:05:15They are allowed a CPI adjustment uh as
- 1:05:19a normal part of their increase.
- 1:05:22And uh I'm not sure how the one attorney
- 1:05:24was able to increase his, but then the
- 1:05:27other said it's uh not fair for us to
- 1:05:31have a lower rate than uh one of the
- 1:05:33five.

- 1:05:39>> Well, I know we've had questions in the
- 1:05:40past regarding um
- 1:05:44who's keeping track really of the um
- 1:05:47cases that they've worked. Um
- 1:05:50will we have more information at our
- 1:05:52workshop? Is this something we can table
- 1:05:55to get all our answers
- 1:05:58um cleared? Um
- 1:06:01>> but we are under contract requirements
- 1:06:03so we can't change that. And so ex
- 1:06:07essentially what you're
- 1:06:10what you by tableabling it you're saying
- 1:06:12we're not going to pay the extra
- 1:06:15uh until we have information
- 1:06:18uh we will still be obligated to pay the
- 1:06:21contract amount because they are under
- 1:06:23contract. We just we're declining to pay
- 1:06:26the increase. Uh so I mean it it'll be
- 1:06:30retroactive to the beginning of the year
- 1:06:33regardless and so um I welcome your
- 1:06:37input.

- 1:06:39>> could we get a a uh presentation by some
- 1:06:43of these attorneys so we have a better
- 1:06:45understanding of how we're supposed to
- 1:06:46know that they're actually doing what we
- 1:06:49pay them for? Because I I I go along
- 1:06:52with this and say I have a big problem
- 1:06:54with this. They tell us, well, here's
- 1:06:56the amount of money you owe us and we
- 1:06:58have nothing to show. Um I mean, can
- 1:07:01they do a purchase order maybe and and
- 1:07:04uh sign up ahead of time? There is a
- 1:07:07record and it should be a part of the
- 1:07:09regular reporting that says who did how
- 1:07:11many of their of their case loads
- 1:07:15>> and the time that that they put into it
- 1:07:18>> because that's the billing.
- 1:07:20>> I think it's just a flat
- 1:07:21>> flat rate. So regardless how much time
- 1:07:23they put into it, it's a flat rate.
- 1:07:26>> And um I don't know if Julie has any
- 1:07:29more comments on that as it relates to
- 1:07:32uh defense attorney fees.
- 1:07:34No, I'll just remind you that um these
- 1:07:38contracts expire at the end of this
- 1:07:40year. So, I think it would be
- 1:07:42appropriate to maybe do a workshop and
- 1:07:46have them talk to you as we work on
- 1:07:48contracts for next the next year. I
- 1:07:51don't see a lot of incentive to delay
- 1:07:55this fee increase because one of the
- 1:07:57risks you run is if they don't see the
- 1:07:59fee increase coming, they may terminate
- 1:08:00their service anyway and then you're
- 1:08:03left with the the other half of this
- 1:08:04year not having their service. So the
- 1:08:06idea is that these amendments with the
- 1:08:09exception of one contract that still has
- 1:08:11one year on it would just run through
- 1:08:13the end of the year and then we'll get a
- 1:08:15better sense of um where the case loads
- 1:08:18requirements affect next year's
- 1:08:20contracts and and what the fee looks
- 1:08:22like for all the entities next year.
- 1:08:26But they should be doing reporting. They
- 1:08:28have full existing contracts. This is
- 1:08:30just meant to amend one piece of it
- 1:08:33related to the compensation for for the
- 1:08:35cases and it's only through this year.
- 1:08:42>> The reason I ask about the case loads is
- 1:08:44because my understanding both the
- 1:08:46Supreme Court and the WSBA have
- 1:08:48established standards for the indigen
- 1:08:50defense and and both of those uh you
- 1:08:54know they kind of conflict with each
- 1:08:56other. So what what are are defense
- 1:08:59attorneys going by this the Supreme
- 1:09:01Court ruling or the WSBA um standards?
- 1:09:06>> So
- 1:09:06>> it's quite a difference. I know the
- 1:09:08Supreme Court I believe lets the cities
- 1:09:10um you know reduce the case loads
- 1:09:14>> within the next 10 years and and the
- 1:09:16other one just you know kind of drops
- 1:09:18the case loads on
- 1:09:19>> Yeah.
- 1:09:20the the the Supreme Court adopted the um
- 1:09:23the 10% decrease over the the 10-year
- 1:09:26period. So, by 2020 or 2036,
- 1:09:31um all cases have to be at 120 cases.
- 1:09:34And the Supreme Court did not uh
- 1:09:37distinguish between the type of case.
- 1:09:38It's just 120 cases. It didn't do the
- 1:09:41waiting that the WSBA did. Um but it
- 1:09:43agreed to the tapered decline. And the
- 1:09:46way that the the average is actually
- 1:09:48it's a strange way to calculate the
- 1:09:50average. So it's not you decrease 10%
- 1:09:52every year. It's you decrease 10% of the
- 1:09:55total average. So it it actually
- 1:09:57combined to you will decrease your case
- 1:09:59load by 18 cases every year to get to
- 1:10:02the the new standard. Um but this year
- 1:10:062026 did not impose any changes. The
- 1:10:09first year you're going to see any
- 1:10:10changes um is going to be in 2027.
- 1:10:14So, next year when we drop the new
- 1:10:16contracts, the the fee will likely be
- 1:10:18based off um the new case load standard.
- 1:10:22And the the biggest confusing thing is
- 1:10:25these cases can still say that your your
- 1:10:27case load limit is 300, but it's for the
- 1:10:30individual attorneys to determine
- 1:10:33whether how to staff that because they
- 1:10:35are the ones limited. So we have
- 1:10:37contracts like this with big cities in
- 1:10:38Seattle that that assess their fee on a
- 1:10:42600 case. You know they say 600 cases is
- 1:10:46the the retainer but they will have five
- 1:10:49attorneys working under that one
- 1:10:50contract. So these are contracts with
- 1:10:53individuals. So the assumption is each
- 1:10:55individual is agreeing to these limits.
- 1:10:57But in reality, you can have a a
- 1:11:00contract with an entity and they will
- 1:11:03have to manage the staffing in relation
- 1:11:05to um to the WSBA.
- 1:11:09So, the case load is really just meant
- 1:11:10to set the base fee and we leave it to
- 1:11:13them to regulate how many attorneys does
- 1:11:15it take for them to to work it under the
- 1:11:18base fee. Which is why they also don't
- 1:11:19want to see their compensation go down
- 1:11:21when their case load goes down because
- 1:11:23now they have to staff more attorneys.
- 1:11:30Go ahead, Deputy Mayor. Um,
- 1:11:32>> so many I think many of the questions
- 1:11:34that uh that Mr. Galvan is referring to,
- 1:11:37I think those are probably things that
- 1:11:38we can be looking at in the contract
- 1:11:41going forward when we look at the
- 1:11:43context going forward. I think for to
- 1:11:45for what we're looking at tonight is
- 1:11:47just uh u bringing the the the rates up
- 1:11:52to be everybody is getting paid the same
- 1:11:55amount per case. Um and I think that
- 1:11:58that's uh you know I I I I agree I
- 1:12:01understand about you know checking all
- 1:12:03the standards and everything but I think
- 1:12:04that's something we could maybe look at
- 1:12:06towards going towards our new contract
- 1:12:08with them. I think they're probably
- 1:12:09pretty well set for right now in the in
- 1:12:12the contracts as as well as I you know.
- 1:12:16>> So essentially if you decline this,
- 1:12:19you'll have one attorney that's making
- 1:12:20more than the others and those others
- 1:12:22might say, "Hey, I don't want to do this
- 1:12:24anymore. I'm going to go somewhere
- 1:12:26else." And then we run the risk of not
- 1:12:27having enough attorneys to process our
- 1:12:29claims or agreeing with Thomas Topish.
- 1:12:33So we we I thought we decided, okay,
- 1:12:35let's limp through this. We don't like
- 1:12:37it, but let's at the 2026 when the
- 1:12:40contracts are renewed, then we'll fix
- 1:12:42whatever problems we have.

- 1:12:53happened with one attorney then.

- 1:13:05bringing these numbers down so there's
- 1:13:07less cases and then you have two two
- 1:13:10married attorneys getting the same
- 1:13:13paycheck for the same case load for the
- 1:13:16same amount of money. Exactly. The only
- 1:13:19thing different in there was the middle
- 1:13:22initials of the two names.
- 1:13:24>> Well, you should not look at them as a
- 1:13:26married couple. They are individual
- 1:13:28attorneys. that just happened to be
- 1:13:30married.
- 1:13:31>> That was just incredible that they had
- 1:13:33the exact same numbers coming forward
- 1:13:35that we were paying their salaries with.
- 1:13:38>> Well, I mean that's because again, you
- 1:13:40take 300, multiply by the case load,
- 1:13:43divide that number by 12, and that's the
- 1:13:45monthly retainer. And then at the end of
- 1:13:47the year, if they have less, then we can
- 1:13:48deduct that less. Or if they have more,
- 1:13:50then they can have a true up. That's
- 1:13:52that's why I was asking for I think it
- 1:13:54was last month I was asking for some
- 1:13:57kind of you know an old purchase order
- 1:14:00or something that that would tell us
- 1:14:03what took place because I I didn't
- 1:14:05understand how you come up with the
- 1:14:06exact same paycheck for everybody and
- 1:14:08they're supposed to be individual
- 1:14:09attorneys.
- 1:14:13>> How does that work, Julie?
- 1:14:17Well, like I said, sometimes these
- 1:14:20contracts are based on an entity and
- 1:14:22sometimes they're based they're with
- 1:14:23individuals. So, if the two were in a
- 1:14:25firm together, then we would probably
- 1:14:27pay the one firm a a different rate.
- 1:14:30It'd maybe be 12,000 instead of 8,000 a
- 1:14:34piece. But there the rate we'd pay for
- 1:14:36the firm would be comparable to the
- 1:14:38individual attorney's rates to make it
- 1:14:40valuable for them. Like I said, the the
- 1:14:42number is based
- 1:14:45is based on a p perceived or or what
- 1:14:48they're expected to work through their
- 1:14:50staffing, whether it's them individually
- 1:14:52or through others that they partner
- 1:14:54with, which is what's going to make the
- 1:14:56these new case counts very expensive for
- 1:14:58the city. Because now you may have a
- 1:15:00contract with a firm that was for, say,
- 1:15:03$20,000.
- 1:15:04And as the case counts go down, they're
- 1:15:06going to have to add people in the firm
- 1:15:08to staff the case count. So it gets more
- 1:15:11expensive as they pay more attorneys. So
- 1:15:13that's why they will need a bigger
- 1:15:15contract rate. So these contracts happen
- 1:15:17to be written by individuals. So the
- 1:15:19assumption is each individual, but
- 1:15:21that's not going to be capable of being
- 1:15:23true. So even if we have these contracts
- 1:15:25with these individuals at 300 cases,
- 1:15:28when the case loads go down, they will
- 1:15:30have to bring somebody in under them
- 1:15:32also to help work these cases. and
- 1:15:34they're still getting paid that same
- 1:15:35rate. And so that's it's it's a little
- 1:15:39strange because these are with
- 1:15:40individuals, but try and look at it in
- 1:15:41terms of if these if these were worked
- 1:15:44by a firm, if there were two of them,
- 1:15:45you'd probably be paying twice the
- 1:15:48contract price.

- 1:19:56emergency repair of the bio gas piping
- 1:19:58um emergency project and that funding
- 1:20:01was provided by the public works board.
- 1:20:04There was a portion of that funding that
- 1:20:06was exceeded
- 1:20:08the uh available amount that was
- 1:20:12provided by the board. Uh you heard the
- 1:20:14number about 29,000.
- 1:20:16We have found uh a location for that in
- 1:20:19the capital fund for the wastewater
- 1:20:22treatment system. But this will require
- 1:20:25um an ordinance to amend the budget. So
- 1:20:28this is a motion uh directing staff to
- 1:20:31draft an ordinance for amending the
- 1:20:33budget to include uh this funding
- 1:20:36request or funding uh mechanism from the
- 1:20:40um public works board as well as a
- 1:20:42transfer of funds uh from the uh capital
- 1:20:45fund to the 26 budget.

- 1:21:07Madam Mayor, if I recall earlier this
- 1:21:11evening, uh Mr. Mahia said something to
- 1:21:13the effect that we had found the uh $29,
- 1:21:17I think $288
- 1:21:19uh to because there was already we had a
- 1:21:21million dollars set aside grant or
- 1:21:24>> correct
- 1:21:25>> and and loaned. Is that right?
- 1:21:27>> Correct. See, we didn't put that in the
- 1:21:2926 budget. So, it's it's not there. So
- 1:21:33we can amend the budget and usually we
- 1:21:36bundle a lot of these amendments towards
- 1:21:39maybe in towards the end of the second
- 1:21:41or maybe beginning of the third quarter.
- 1:21:43So as we approach the end of the year we
- 1:21:44know what our axles are going to be
- 1:21:47rather than just our forecasts. And so
- 1:21:50this will be an ordinance that we have
- 1:21:52to have before the council to amend the
- 1:21:55budget. And so this is just directing
- 1:21:58staff to draft that um that ordinance.

- 1:22:25the sewer fund and it it's going to be

- 1:22:37sewer fund is going to subsidize the
- 1:22:3928,000.

- 1:23:18public board is $500,000 grant and
- 1:23:22$500,000 loan. Um and that is going to
- 1:23:26subsidize the million dollars
- 1:23:27expenditures.
- 1:23:29Um, plus we're going to be over $29,000
- 1:23:31which is going to be funded from the
- 1:23:33sewer fund which has enough enough is
- 1:23:36going to be is doing fine financially to
- 1:23:39be able to subsidize that overage.
- 1:23:41>> And in fact, we when we looked that
- 1:23:44over, I believe we came out with a
- 1:23:45fairly significant amount left over.

- 1:23:50Yes. Um the 2026 budget um turned out
- 1:23:55favorably
- 1:23:56and we're on track to finish in the year
- 1:23:59in the SUR fund
- 1:24:01February. Also, I don't have the numbers
- 1:24:03with me because I didn't print out the
- 1:24:06budget to bring with me, but as as you
- 1:24:09may recall, um we're going to finish the
- 1:24:112026 favorably on track even after the
- 1:24:14$26,000 transfers out.

- 1:25:04a
- 1:25:05a um draw date.

- 1:25:32doing every change uh with a budget
- 1:25:35amendment, we are bundling them just
- 1:25:38have one big uh amendment or not one big
- 1:25:41but maybe multiple items in that
- 1:25:43amendment that include this and other
- 1:25:46things that we might uh need to amend
- 1:25:47the budget for. Anyway, so it doesn't
- 1:25:51dismiss what you're asking about, but it
- 1:25:53won't be included in the budget
- 1:25:54amendment language in the ordinance. No,
- 1:25:56I'm I'm asking for it to be included in
- 1:25:58the motion language so that there's a
- 1:26:00document that says you will have this
- 1:26:04stuff in place before this action takes
- 1:26:06place because in the last four years
- 1:26:08we've come across where this never
- 1:26:11happened. It doesn't happen and there's
- 1:26:13no accounting of and now we're going
- 1:26:16back and trying to find it. There's no
- 1:26:17accounting of what happened to that
- 1:26:20money and where was it taken out of and
- 1:26:22now is it being put back like it's
- 1:26:24supposed to be when there's a document
- 1:26:26that says it is just like our PO um
- 1:26:31program that's coming up with the stamp
- 1:26:33of approval
- 1:26:34>> and you know and to um and to follow up
- 1:26:37on your question um the interest so far
- 1:26:40that's going to be paid this year on
- 1:26:42that uh public works um board loan is
- 1:26:45going to be only $134. $4. That's the
- 1:26:47interest that we're about to pay, $134.
- 1:26:52And the principal is going to be about
- 1:26:54$4,000 for all of next year. So, we get
- 1:26:57to pay the interest in June of every
- 1:27:00year. And it's going to be an average of
- 1:27:03about $4,000. I mean, I mean, principal
- 1:27:06about $4,000 uh a year. Still, the extra
- 1:27:10would pay for all those staples we
- 1:27:12talked about.

- 1:27:14And of course that's going to go on the
- 1:27:162027 budget.
- 1:27:19And right now what we're going to be
- 1:27:20placing in the 2026 budget is only the
- 1:27:23$134
- 1:27:25plus the $29,000 plus the $1 million
- 1:27:28which is also going to be fully
- 1:27:30reimbured. So that's all that's all
- 1:27:33that's going to go in the 2026 budget
- 1:27:35after this amendment passes. Yeah.

- 1:28:28And where's the contract for using this
- 1:28:30money out of an enterprise fund? I was
- 1:28:32told a long time ago there was no
- 1:28:34enterprise funds and that was a lie.

- 1:28:39happening here is that we're just trying
- 1:28:41to reconcile the budget with expenses
- 1:28:43and revenues, and it's not it's doesn't
- 1:28:45currently exist. And so, we're going to
- 1:28:48have to amend the budget. Uh the
- 1:28:50documentation that you're referring to
- 1:28:51isn't isn't normally part of the
- 1:28:54amendment. If you did want to amend this
- 1:28:56motion, you'd have to make a motion to
- 1:28:58amend what you're you're requesting, and
- 1:29:00it would have to be seconded. And then
- 1:29:02the new motion would include all of the
- 1:29:05things that you're asking for.

- 1:29:49telling anyone, including council and
- 1:29:52none of this stuff has come forward. You
- 1:29:53weren't around for all this, but this
- 1:29:55this is the kind of thing we need to
- 1:29:57take steps on right now so that in the
- 1:29:59future this will be included every time.
- 1:30:02and they'll say, "Well, we need to use
- 1:30:05this much money. We need pull this much
- 1:30:08money out of the sewer fund to
- 1:30:10transfer." And it's going to include the
- 1:30:12wording it that says this is a contract
- 1:30:16between
- 1:30:18entities in the city.
- 1:30:21>> So, you don't wish to amend the motion
- 1:30:22now? I I'm gonna get I'm gonna make up a
- 1:30:25uh like I can use this as my as my model
- 1:30:29because the motion's good, but it needs
- 1:30:32I feel it needs to include wording that
- 1:30:34says in a concise way that the the rules
- 1:30:38that we have established need to be
- 1:30:40followed for a change because this is
- 1:30:43what has put us in this situation for
- 1:30:46years and years and years.

- 1:35:38several instances where there have been
- 1:35:41it just feels as though
- 1:35:44and it and some of the paperwork it
- 1:35:48adheres to it that things were just not

- 1:35:56about the one attorney. We're not
- 1:35:58talking about the entire firm. If I

- 1:36:47with our current um legal advice and I
- 1:36:50did some checking on getting a new uh
- 1:36:55a new uh
- 1:36:58legal council for the city of Sunnyside.
- 1:37:00I checked with several
- 1:37:03close friends and and uh who are
- 1:37:06attorneys with large firms. They said uh
- 1:37:10that's that's huge. That's going to put
- 1:37:12the city on the brink right there. And
- 1:37:15uh I think we should I think we should
- 1:37:17table this until we have a chance to go
- 1:37:20through it in the workshop. Maybe uh
- 1:37:22even call another special meeting and we
- 1:37:24can discuss this because I don't think
- 1:37:26there's been enough research done um at
- 1:37:28this time to tell you what's going to
- 1:37:31happen when you uh pass this motion
- 1:37:33tonight. And uh Karen has nothing to say
- 1:37:36because she's not here. But, uh, I think
- 1:37:39it's a really bad bad move and I'll just
- 1:37:41leave it at that. Or I, uh,
- 1:37:47if I can say one more. Um, deputy mayor,
- 1:37:50we we had a very productive conversation
- 1:37:52last week and and, you know, you you
- 1:37:54agreed with with uh with your role. You
- 1:37:56didn't you didn't like the way that uh
- 1:37:59um that was going to take us. And now
- 1:38:01earlier we agreed to pay topish to help
- 1:38:04us with the city clerk. Um, how much
- 1:38:05more are we going to pay? um to get
- 1:38:08another city to help us out. You know,
- 1:38:10are we going to get any city attorneys
- 1:38:12that are going to want to come to
- 1:38:13Sunnyside? Because by all means, I mean,
- 1:38:16uh it's going to be out there. Um you
- 1:38:18don't you don't like one bit of a of a
- 1:38:20decision and you don't agree with
- 1:38:22something, then you're pretty much uh
- 1:38:24saying you're out the door. Uh you know,
- 1:38:27it it's we had two different attorneys
- 1:38:30apply last time. Um with with this firm
- 1:38:33being one of them, the other one being
- 1:38:34from Idaho. um you know what's that
- 1:38:38going to do to the city? They they're
- 1:38:39handling our our city clerk um services
- 1:38:42right now. And if you all remember um
- 1:38:46you know there was one small mistake
- 1:38:47last year and it it cost us you know
- 1:38:49$25,000. Uh how many more mistakes are
- 1:38:52we going to have without a city
- 1:38:54attorney? Um how much more money are we
- 1:38:55going to pay um out of the general fund?
- 1:38:58Are we gonna have enough money to open
- 1:39:00up a pool if if we keep paying these
- 1:39:02these fees just based on uh emotions and
- 1:39:05and changing the votes and whatnot, but
- 1:39:07I'll leave it up to you.
- 1:39:10>> Well, since we're on the topic of of
- 1:39:13paying um um you know, we we did just
- 1:39:17get a report and um I thought you were
- 1:39:19actually going to talk about this,
- 1:39:20Councelor Dolan. I mean, since January
- 1:39:24through through now, um, we've been
- 1:39:26paying $67,000
- 1:39:28to Odden Murphy Wallace. And I actually
- 1:39:30went um line by line looking at every
- 1:39:33item. And, um, um, Julie's um, rates
- 1:39:38have gone up. I believe we started with
- 1:39:40around 285 and now she's at $35 an hour.
- 1:39:44Um, I did not foresee this happening,
- 1:39:48believe me or not. Um, but I thought at
- 1:39:51the very least you guys were going to
- 1:39:52bring this up because of the expenses to
- 1:39:56this firm and how high they have risen
- 1:39:58out to to this month. And yeah, that
- 1:40:02one. And um I actually wanted since
- 1:40:06we're on this topic, I I did want to ask
- 1:40:09um how is the the law firm processing
- 1:40:13the public records requests? I you my or
- 1:40:17yeah you the deputy mayor and myself had
- 1:40:20a meeting on Thursday and you mentioned
- 1:40:23that they're um that they're not fully
- 1:40:27processing them but they're just um
- 1:40:29acknowledging receipt
- 1:40:31>> correct to defer to Julie but they're
- 1:40:34stacking up and so um
- 1:40:37>> yeah maybe I can explain the the
- 1:40:40invoicing um first of all my rate has
- 1:40:42not changed it's been 305 the entire
- 1:40:45contract, right? I'm the senior senior
- 1:40:47partner with 20 years experience. So,
- 1:40:49that rate or maybe it changed this year
- 1:40:51because I just hit 20 years experience,
- 1:40:53but I've always been the the top rate.
- 1:40:55Um, the others in the firm are are 285
- 1:40:59for junior partners and whatnot. Um, we
- 1:41:02did not change the rates going into
- 1:41:032026, so they should be the same
- 1:41:05contract rates. Um, a lot of the fee is
- 1:41:07we've got five attorneys working on
- 1:41:09public records. They are doing all of
- 1:41:11your redactions for exemptions and
- 1:41:13redactions for large pro uh large
- 1:41:16requests. The city itself is receiving
- 1:41:19the the um requests and then they are
- 1:41:22sending the the underlying documentation
- 1:41:25to our office to have our associates in
- 1:41:28Seattle review it and um and do the
- 1:41:31redactions, exemptions and send it back
- 1:41:33so that the city can release it. We are
- 1:41:36still sitting on one with 18,000
- 1:41:37records. Um prior and we realized that
- 1:41:41the fees were getting up there and
- 1:41:42that's why right before Pat came on um I
- 1:41:45actually asked Chief Layman to work with
- 1:41:49us on a plan so that we could reduce the
- 1:41:51cost that it was that you were incurring
- 1:41:54for uh for the public records work. So
- 1:41:56we agreed that it was going to be
- 1:41:57reduced to about 10 hours. There's, you
- 1:42:00know, another large expense that you're
- 1:42:02seeing is there's just been a lot of
- 1:42:03meetings, a lot of meetings that are
- 1:42:05very, very long and that is that's a lot
- 1:42:07of time. So, um, yeah, we are processing
- 1:42:12large public records requests that we
- 1:42:14get the material from the city. Um, and
- 1:42:16they are stacking stacking up. In fact,
- 1:42:19Drew reached out to Pat this week and
- 1:42:21said, "Hey, what's your plan? because we
- 1:42:23can't keep just holding on to all these
- 1:42:25and and you're not going to get anywhere
- 1:42:26if we're only processing them 10 hours a
- 1:42:28week um for the foreseeable future.

- 1:43:07saying, "Hey, pay us right away." So, it
- 1:43:10resulted in a very large out outstanding
- 1:43:13balance.

- 1:43:16working with the manager on ways to to
- 1:43:18bring down the the cost. It's just been
- 1:43:20some incredibly costly months for your
- 1:43:23city between departures of of admin and
- 1:43:26and all the meetings.

- 1:43:32>> You know, since um you questioned me
- 1:43:35right now, I will go ahead and put this
- 1:43:38in record that we discussed this when we
- 1:43:40left council and you said that you also
- 1:43:42agreed that you did not want to have the
- 1:43:45firm. Am I correct?
- 1:43:47>> You are correct.
- 1:43:48>> Thank you. And on that note, I went out
- 1:43:51shopping to see if I could find another
- 1:43:54firm. And that's when I was told, and I
- 1:43:56I think I could probably have one of
- 1:43:58those individuals I spoke to show up at
- 1:44:00our workshop. So, if we could just
- 1:44:02postpone this a little bit longer. And
- 1:44:04he would outline for you the steps that
- 1:44:06will happen. He's just about ready to
- 1:44:09retire as an attorney. And he said that
- 1:44:12they would not take they would not take
- 1:44:15on the city of Sunnyside. and he says,
- 1:44:18"And I wish you the best of luck because
- 1:44:20there's not they're not lining up to
- 1:44:22work for Sunnyside. Um, we've got a a
- 1:44:25bad reputation right now. We're trying
- 1:44:27to get out of it." I think if we can
- 1:44:29keep these guys long enough to have
- 1:44:31someone in place and ready to go to work
- 1:44:34for us, that's another that's another
- 1:44:36consideration because I wasn't happy
- 1:44:39with a lot of what I was getting back
- 1:44:42then when you and I spoke. And uh by
- 1:44:46pushing this forward and having nothing
- 1:44:47in place for the next one, it's usually
- 1:44:50like if you're going to quit your job,
- 1:44:52you you try to have one lined up
- 1:44:54already. Otherwise, you're uh you got a
- 1:44:57big space in there in between paychecks.
- 1:44:59And so I I really think that by doing
- 1:45:02this tonight, it's a bad move. I think
- 1:45:05we should have another firm all lined up
- 1:45:07to to help us and try to get somewhere
- 1:45:11in the same price range which maybe even
- 1:45:15cheaper. Um we have the packet that you
- 1:45:19are welcome to look at and see just
- 1:45:21exactly what took place. I think uh
- 1:45:25council person Zesty has a copy of it
- 1:45:28also. I don't know if you had a chance
- 1:45:30to look at it, but I think this is a a
- 1:45:32real a real bad move and uh I yield
- 1:45:36back.

- 1:47:02is actually we have two of them
- 1:47:05or the arts commission.
- 1:47:14The first one is Ulyses Gutierrez who
- 1:47:18has a vast background experience in
- 1:47:20marketing, business development,
- 1:47:22software development and um currently
- 1:47:25owns
- 1:47:27um his own startup called Hello Abanero
- 1:47:31which serves local businesses in tech
- 1:47:33and marketing and Ulissa's Gutierrez is
- 1:47:37um applied for the arts commission. Um,
- 1:47:41if you all remember, we also made an
- 1:47:44amendment to the SMC for the arts
- 1:47:48commission um to include a youth. And we
- 1:47:52have a high schooler by the name of
- 1:47:56Genevia Era who also applied for the
- 1:48:00arts commission and actually submitted
- 1:48:03some of her very impressive art. Um
- 1:48:08she also I think created um she painted
- 1:48:11a a portrait for one of the local animal
- 1:48:14shelters um that actually made the paper
- 1:48:16and it's on those prints. Um, so I'm
- 1:48:20bringing those forth for um as
- 1:48:23nominating them for the arts uh
- 1:48:28commission.

- 1:48:36motion to vote them in as if these two
- 1:48:38are voted into the arts commission. It

- 1:50:42asking in instead to appoint Catalina
- 1:50:46Alvarez to the um I think her last name
- 1:50:49is also Cat Alvarez Villanoeva I believe
- 1:50:52it is

- 1:50:55uh to join on the climate resiliency
- 1:50:58board.
- 1:51:01So, Miss Alvarez comes with a lot of
- 1:51:04experience participating in um talking

- 1:57:25require membership outside the city and
- 1:57:27boards and commissions which expressly
- 1:57:29permit non-resident resident membership.
- 1:57:32Um so
- 1:57:35whether you can have non-residents
- 1:57:37depends on the specific committee and
- 1:57:40that's why I said I know specifically
- 1:57:43allows for certain non-residents.
- 1:57:45I I'm not sure which if we're talking
- 1:57:49about the climate resilience committee
- 1:57:50then we jump down here

- 1:57:58and it says the climate resiliency team
- 1:58:00shall consist of seven members to the
- 1:58:02extent available members shall represent
- 1:58:04the following areas serving Sunnyside
- 1:58:06agriculture business owners commercial

- 1:58:15um terms, meetings, duties and
- 1:58:18responsibilities. It doesn't say that
- 1:58:21these members
- 1:58:25are not residents. So that the the
- 1:58:28um
- 1:58:31it doesn't say that the the folks
- 1:58:33serving these are not um what's the word
- 1:58:38are excluded from the residency
- 1:58:40requirement. So in other words, unlike
- 1:58:43ELAC where it says you can have
- 1:58:46a personified, right, this one just says
- 1:58:48the they want these
- 1:58:51these
- 1:58:52um interests represented but through
- 1:58:57residence.

- 1:59:25rid of someone who would be a huge help
- 1:59:28to that committee. And he actually
- 1:59:31doesn't live in the city either. Well,
- 1:59:33here's here's one of the things that
- 1:59:35makes this particular committee
- 1:59:37different and reason why you're looking
- 1:59:39at having people from um education, from
- 1:59:45um environment, health, um business. And
- 1:59:49the reason why is because this is part
- 1:59:51of our comprehensive growth plan that
- 1:59:53we're trying to get done by the end of
- 1:59:55of December 2026.
- 1:59:58Um we are right in the midst of getting
- 2:00:01that done. Mr. Anderson was not
- 2:00:03attending meetings and hadn't been
- 2:00:05getting a hold of us to to let us know
- 2:00:07why he wasn't attending. Um he uh just
- 2:00:11he just and then when he did he it was
- 2:00:14already he'd already ex exceeded the
- 2:00:16three limits the three times. I think
- 2:00:18there were four or five I think since
- 2:00:20we've been meeting. In any case, because
- 2:00:23the climate resiliency is part of a
- 2:00:25larger activity that's going on in the
- 2:00:29county, which is why some of the folks
- 2:00:31who can be on can be in the country like
- 2:00:34Mr. Anderson, that was one of the
- 2:00:35reasons he's picked. Mrs. Vandergraph
- 2:00:38Erikson, she also lives in the country.
- 2:00:40She's an egg. So, she's an egg business.
- 2:00:42That's why she's there. Um,

- 2:07:50that was the best move we made on that

- 2:07:54check it out and you say, "Well, half of
- 2:07:57these people aren't even in the city
- 2:07:58limits and yet they're on these boards
- 2:08:00of commissions. Why is that? Why aren't
- 2:08:03we following our own rules?
- 2:08:07Why don't we have a contract for using
- 2:08:09enterprise money? Why don't there's so
- 2:08:11many things wrong here?"
- 2:08:13>> Yeah. And oh actually um to to to your
- 2:08:16point um I was t speaking to councelor
- 2:08:19Vosquez earlier today and um I I did a
- 2:08:22very quick audit of the vacancies um and
- 2:08:26I actually read through the the SMC's
- 2:08:29around boards and commissions and a lot
- 2:08:30of them are not cohesive and make way
- 2:08:34for a lot of confusion for our chairs.
- 2:08:36Um, for example, um, I know the parks
- 2:08:39and reccks had a meeting and there was
- 2:08:41some confusion on who handled the
- 2:08:43meeting. I think you were there, Hector.
- 2:08:46Um, and today I got to clarify some of
- 2:08:48those um, processes with with that
- 2:08:50chair. Um however this this um these
- 2:08:54concerns should make way to addressing
- 2:08:57these SMC's
- 2:08:59um to uh make sure that they are
- 2:09:02unilateral that they are cohesive and
- 2:09:04that um they're all standardized because
- 2:09:07there's a lot of commissions where the
- 2:09:08chair has a voting authority. There's
- 2:09:11other boards where um the chair like the
- 2:09:14parks and recrecks you are a liaison to
- 2:09:17that councelor Chavez um but you don't
- 2:09:19necessarily have a voting um have a vote
- 2:09:22or voting power um so this could make
- 2:09:25way to coming to the point of reviewing
- 2:09:28the SMC's
- 2:09:30making them make sense to all council
- 2:09:32council members and if there are going
- 2:09:35to be any amendments to those um like
- 2:09:37you're stating councelor um Dolan then
- 2:09:41that can be revisited. We can create a
- 2:09:43subcommittee to look at these SMC's
- 2:09:47um and you all can have a few meetings
- 2:09:50um to look over them. We can delegate
- 2:09:52them over to staff. Although I um that
- 2:09:56would be up to Mr. Haley um and then
- 2:10:00those um recommendations can come back
- 2:10:02to council and then we can initiate a
- 2:10:05move to amend the SMC's. But without
- 2:10:08amending the SMC's there's nothing
- 2:10:10really that we can do right now.
- 2:10:12However,

- 2:10:18that's my train of thought. Um
- 2:10:22oh well anyways we can that then can
- 2:10:26initiate the ongoing work around

- 2:12:14insight into what we talked about?
- 2:12:16>> Yes. So, um we uh myself councelor
- 2:12:21Chavez and Mrs. I don't want to hurt

- 2:12:27>> um met and uh for the parks commission
- 2:12:31um we were discussing on how we can be
- 2:12:35proactive on the art and the parks um to
- 2:12:38come together and make it much stronger
- 2:12:41committee. Uh
- 2:12:43we have a few ideas. Um obviously with
- 2:12:46the pool uh we are looking for u people
- 2:12:50who want to sponsor the first days and
- 2:12:52then we were discussing about having an
- 2:12:54end of the year um
- 2:12:57uh bash of the new year school going in
- 2:13:01the end of the uh swim swim time. So,
- 2:13:05uh, we will be, um, seeing who one would
- 2:13:08like to donate, um, for people to be
- 2:13:11coming in into the pool. Um, and then
- 2:13:14obviously at the same time, uh, talk to
- 2:13:18people and, um, let them know what the
- 2:13:21parks committee is all about. Uh, and,
- 2:13:23uh, look forward into what we want to do
- 2:13:26as a committee.

- 2:13:33and Girls Club this week. Uh Mr. Ace was
- 2:13:36out of the office. Um I think there was
- 2:13:39something that went on, so I will be

- 2:15:01I'm okay with that. I'm open to meet
- 2:15:03with community to have discussions. Um I
- 2:15:06will say that I vote based on my own
- 2:15:08personal experiences with situations and
- 2:15:11certain people. Um, I'm not persuaded
- 2:15:14one way or another. It's my my beliefs
- 2:15:18and um, like I said, I'm open. I don't
- 2:15:21appreciate um,
- 2:15:24the yelling um, getting loud talking
- 2:15:27over me, but again, I'm open and I think
- 2:15:30at one time or another, we've all or
- 2:15:32most of us have had and felt the heat.
- 2:15:36So, um, with that being said, um, you
- 2:15:40know, I'm open to hear community
- 2:15:42comments and and I'm willing to have a
- 2:15:44conversation,
- 2:15:46um, with anybody.

- 2:16:35little emotional I guess but uh I try
- 2:16:38not to raise my voice. I lived in a
- 2:16:40family with a mother that um taught me
- 2:16:43all the bad Mexican words, but uh
- 2:16:46>> I I try to I try to behave. Um my wife
- 2:16:51me not to get any fights tonight, so far
- 2:16:54it's so good.

- 2:17:00Sunnyside hosted by the Sunnyside
- 2:17:02committee and just want to congratulate
- 2:17:04all the winners. Um, Chief Layman took

- 2:17:09employees that took an award and
- 2:17:11volunteers and nonprofits out there.
- 2:17:13Just uh, you know, everybody putting
- 2:17:15their little grain of salt and make this
- 2:17:18community better. Um, also would like to
- 2:17:21get an update on the um, housing
- 2:17:23authority report that I had um, asked
- 2:17:25for or suggest or not suggested that you
- 2:17:28know kind of it's needed on a yearly
- 2:17:30basis. I'll get on on on um touching
- 2:17:35base with um um remind me of her name,
- 2:17:39deputy mayor.

- 2:17:46I'll email her and I'll um I'll copy you

- 2:17:59of sunny side. I got to sit at a table
- 2:18:01with I think there were
- 2:18:04three different award winners sitting at
- 2:18:06table. I sat with the chief um at his
- 2:18:08table and so the Sunnyside uh police
- 2:18:12foundation won an award for their
- 2:18:14efforts. I believe the uh Councilman
- 2:18:17Galves's wife is part of that foundation
- 2:18:19along with the chief's wife Charlotte.
- 2:18:22She's also on that board. And then the
- 2:18:24other young lady whose name is Nicole,
- 2:18:26can't remember her last name. Very nice
- 2:18:28young lady. I think she's the SRO at the
- 2:18:29high school. Yeah. And she won an award
- 2:18:32for volunteer. Was it volunteer?
- 2:18:36>> Oh, the police officer of the year.
- 2:18:38>> Police officer of the year. Very nice
- 2:18:39young lady. I I wrote them all down, but
- 2:18:42you know, my reading, my writing got a
- 2:18:44little bad there. But we also had the
- 2:18:46young man from the fire department,
- 2:18:48Gambio Sanchez, also won a uh award from
- 2:18:52the fire department, I believe it was.
- 2:18:54Um, so there were quite a lot of our
- 2:18:56city employees were uh got got awards
- 2:18:59and it was very nice program. Um, the
- 2:19:02the the one thing that was really bad
- 2:19:04was the dessert auction. Man, those
- 2:19:07desserts are good.
- 2:19:08>> I mean, we all everybody got some and
- 2:19:11shared some and I think I was going to
- 2:19:13go into a diabetic coma there pretty
- 2:19:15quick. We had something called peanut
- 2:19:17butter brownies. Was that what they were
- 2:19:20called, Chief?
- 2:19:22>> Buckeye Brownies. Oh my god, young young
- 2:19:24Miss Gary uh Jalisa, she made those. Oh
- 2:19:28my goodness. They're like that thick and
- 2:19:30that big. I mean, they were they were
- 2:19:32delightful. But anyway, it was a really
- 2:19:34nice evening. I really appreciate it.
- 2:19:36There's something else um too. We had
- 2:19:39the finance committee and the finance
- 2:19:41committee. I think we had um Mr. Dolan
- 2:19:43sat in on that with us. Uh Mr. Galvan uh
- 2:19:47gave his his his hour up. I imagine he
- 2:19:49could have been there too if he'd wanted
- 2:19:50to, but it was really well done. We
- 2:19:53appreciated um uh Leo, our finance
- 2:19:56supervisor's uh efforts and being a CPA
- 2:20:01really makes a difference when you're
- 2:20:03talking about money. And I suggest a
- 2:20:05further further uh employment packets.
- 2:20:09They're either got a degree in in in
- 2:20:11accounting or they got a degree in a CPA
- 2:20:14because working on money, working with
- 2:20:17people's money is is we know it's hard
- 2:20:19and we know we have problems, but we're
- 2:20:21getting there and figuring out where
- 2:20:23that other $30,000 more or less was was
- 2:20:26a big deal. It was a big deal and we
- 2:20:28look forward to finding more money like
- 2:20:30that. So, I appreciate the staff. the
- 2:20:32staff did really well and I want to give
- 2:20:34a shout out to all the administrative
- 2:20:36professionals that belong to the city
- 2:20:38and also um those who work in the
- 2:20:41community. You all do a great job and we
- 2:20:43couldn't many of us as we've found out
- 2:20:45can't do this job if we don't have a a
- 2:20:48administrative assistant a professional
- 2:20:50to work with this but that's that's what

- 2:21:14you can count on me that I'm going to
- 2:21:16continue um being transparent
- 2:21:19um information giver. Um I like making
- 2:21:22accounting accessible and I'm here to
- 2:21:25you know get our mission carried out. um
- 2:21:29sitting here I think this is like my
- 2:21:31third time that I'm here and I've seen
- 2:21:34you disagree with each other but I have
- 2:21:37seen that each one of you has the best
- 2:21:39interest of the community and of the
- 2:21:42city at heart even if you do disagree
- 2:21:45you mean the best and I I haven't had I
- 2:21:49haven't been bored not even for a single
- 2:21:51minute so I I really I'm looking forward
- 2:21:54to continue working with you thank you

- 2:22:26We have two presentations currently
- 2:22:27scheduled. One is with the judge who
- 2:22:30will define activities that go on there
- 2:22:32with our uh public defense services and
- 2:22:34we also have a housing authority that's
- 2:22:36coming in to describe services that
- 2:22:38their uh agency provides to give us a
- 2:22:42little bit more background
- 2:22:44on available issues related to servicing
- 2:22:48housing needs here in our community. Uh
- 2:22:52then our next regular council meeting is
- 2:22:54scheduled for May 11th.

- 2:23:27meeting, we talked about the
- 2:23:28establishing a purchase order policy.
- 2:23:31Um, you know, we have been like walking
- 2:23:34on a tight rope, you know, for the
- 2:23:36longest time with no safety net. And
- 2:23:39this purchase order policy that we
- 2:23:41talked about will be our safety net.
- 2:23:44Um, we're going to be establishing um
- 2:23:49that up to $3,000 won't require a
- 2:23:52purchase order.
- 2:23:543001 to 10,000 will require a purchase
- 2:23:58order and two approvals
- 2:24:01from the one of the directors
- 2:24:03and uh from the the city manager.
- 2:24:07over $10,000 will come straight here to
- 2:24:11this chamber for your approval.
- 2:24:14Um on top of that to make this policy
- 2:24:18stronger I will be sending out a monthly
- 2:24:21variance report budget to action report
- 2:24:24to the directors for their um analysis
- 2:24:28and for any explanation of any variances
- 2:24:32and also I will be bringing a budget to
- 2:24:35action report to the finance committee
- 2:24:37meeting so we can so the members can see
- 2:24:40how the um invoices that they are
- 2:24:42reviewing is affecting in the budget.
- 2:24:46>> So everything will be explained. You
- 2:24:48will see a flowchart, you know, and
- 2:24:51that's just going to bring this thing
- 2:24:52full circle and that's going to be um
- 2:24:56you know, our uh safety net and our
- 2:24:58firewall. So we won't have any more um
- 2:25:02um surprises when it comes to budgeting
- 2:25:04to the budget. So you have my word for
- 2:25:07it and um I'm looking forward to working
- 2:25:09together.

- 2:25:14anything over $10,000 is going to come
- 2:25:16to council for approval.

- 2:25:24Because right now we're approving these
- 2:25:26claim vouchers and and these checks have
- 2:25:28already been mailed out. There's really
- 2:25:30don't no accountability. You know,
- 2:25:32that's I've been asking for an report
- 2:25:34back on that one particular one that,
- 2:25:36you know,
- 2:25:37>> well, that's where the software is going
- 2:25:38to come into into place. Um, we're going
- 2:25:42to be working with the Springbrook.
- 2:25:44We're going to um establish, we're going
- 2:25:47to chat with the Spring Brook uh people.
- 2:25:51They're going to make it that if there
- 2:25:53is a threshold, there's going to be a
- 2:25:55threshold of 10,000. Then it's going to
- 2:25:57stop right there and it won't let us
- 2:25:59advance unless it is approved. There's
- 2:26:02going to be like a check mark. there's
- 2:26:04going to be a notification
- 2:26:06and the person that is approved to to uh
- 2:26:09to approve will approve it. So the and
- 2:26:14the Spring Brook is going to put like a
- 2:26:16stop to anything that requires an
- 2:26:18approval and it won't move forward
- 2:26:20unless it's been approved.
- 2:26:23>> Can I get a follow-up? So is is this
- 2:26:25procedure going to be added to the the
- 2:26:27purchasing and procurement agreement
- 2:26:29that we have right now?
- 2:26:30>> Yes. So it's going to that that
- 2:26:33procedures or procurement is going to be
- 2:26:35amended.
- 2:26:36>> Yes. Nothing else is going to change um
- 2:26:39about the procurement policy that we
- 2:26:40have, you know, about bidding and and
- 2:26:43all that. It's just going to be the
- 2:26:45invoice portion of it.

- 2:26:50is approved, it will still be invoiced.
- 2:26:53And when the invoice gets um entered in
- 2:26:55Springbrook, it depending on the on the

- 2:27:04it's going to be.

- 2:27:40community. That shows the transparency
- 2:27:42of what they want and what they need.

- 2:27:46safekeepers of um of the people's money
- 2:27:50>> and uh we were we were always working
- 2:27:53and waiting for when is the shoe going
- 2:27:55to drop you know but this is going to
- 2:27:58give us peace of mind

- 2:28:01with their taxes with their money and um
- 2:28:04we're going to be accountable
- 2:28:06>> and responsible so and I say starting
- 2:28:09tomorrow because uh now that I'm giving
- 2:28:11you this information I'm going to pick
- 2:28:12up the phone and talk to the people at
- 2:28:15Springbrook and say what is the very
- 2:28:17first step that we need to do right now
- 2:28:19and they're they're going to walk us
- 2:28:20through. Um hopefully I'm going to get
- 2:28:24uh the corporation from Jafet and the IT
- 2:28:27people um the IT team to to put this um
- 2:28:31purchase order in place in Spring Brook.
- 2:28:33Yeah. So I'll give them a call tomorrow.

- 2:28:41orders for 25 years, I it forces you to
- 2:28:45um plan ahead
- 2:28:48and then you there's accountability.

- 2:28:52submitted this purchase order and now
- 2:28:54your invoice is different than the
- 2:28:56purchase order. You have to resubmit and
- 2:28:59prove why it's going to be different.
- 2:29:01So, it's a very good structure and I
- 2:29:03when we talked about it on Tuesday, I
- 2:29:06was really excited that it's finally
- 2:29:07coming to I think I mentioned it in
- 2:29:10January at my very first council
- 2:29:12meeting, but um yeah, it's it's
- 2:29:16>> common sense and it made me wonder why
- 2:29:17we never had it,
- 2:29:19>> but you know, with the turnover and too
- 2:29:21many things on our minds, you know, but
- 2:29:23this is the time to actually just, you
- 2:29:26know, get some peace of mind.

- 2:30:04Mr. Taylor is not here tonight, but uh
- 2:30:06we we had a very good meeting, Mr.
- 2:30:08Taylor, uh Councelor Gavon, and myself
- 2:30:11on ordinance. Um and we will be looking
- 2:30:14at those and get them updated. Um, and I
- 2:30:18will bring it to the public works
- 2:30:19committee um to review and then be able
- 2:30:21to send it out to the council for also
- 2:30:24reviews before we uh uh take it for a
- 2:30:28vote.

- 2:30:35with uh HR on um getting some
- 2:30:40uh employees that are uh employed by us.

- 2:30:50be moving to uh development technician
- 2:30:53uh uh position that we have open um and
- 2:30:57June 1st uh which will be very helpful
- 2:31:00to myself and Mr. Taylor. Um we will get
- 2:31:03her all caught up uh it will take a
- 2:31:06little bit but she has done the pool
- 2:31:08prior. uh she has uh been helping me out
- 2:31:11with the reservations for the community
- 2:31:14center. So, um I'm excited to have her
- 2:31:16on our side and uh uh help us out, keep
- 2:31:20the doors open. Um I know when I started
- 2:31:23that was one uh one issue that uh was
- 2:31:26brought to my attention and Mr. Taylor
- 2:31:28and I have been doing uh and Mr. Rangel
- 2:31:31and Miss Espinosa has been doing a great
- 2:31:34job keeping it open. Um, so, uh, she's
- 2:31:37willing to help and move forward.

- 2:32:12I think it was a pioneer school where
- 2:32:14you went and talked about being a

- 2:32:22that I saw the pictures of that and I
- 2:32:23thought that was really good. I want to
- 2:32:25also thank you very much for having guys
- 2:32:26out at when we have our ribbon cutings
- 2:32:28and wel welcoming new businesses to
- 2:32:31town, having some of your firemen show
- 2:32:33up there so that the new business owners
- 2:32:36know what the firemen look like when
- 2:32:38when they show up if they need them. You
- 2:32:40know, that was that was really good. I I
- 2:32:42really appreciate that. So, thank you

- 2:33:21received him about three weeks ago. his
- 2:33:23his first week of training, he came up
- 2:33:24and started limping a little bit.

- 2:33:29discovered that he has elbow dysplasia
- 2:33:30in his front elbows.

- 2:33:32>> And so, Alabama Kines is going to
- 2:33:35warranty him and we'll be sending a uh
- 2:33:37new dog probably this week. Um, he he's
- 2:33:41not going to be able to function as a
- 2:33:42police canine, but it looks like we
- 2:33:44maybe have a family that's going to
- 2:33:46adopt him. So, I'm working on getting a
- 2:33:48waiver put together, you know, um for
- 2:33:50them to take over the dog. Um the police
- 2:33:55foundation golf tournament's July 16th.
- 2:33:57Um the police foundation won nonprofit
- 2:34:00of the year at the Spirit of Sunnyside
- 2:34:01Awards. And question for council, I I
- 2:34:04don't remember the answer on this. I
- 2:34:05know it was discussed multiple times.
- 2:34:07Overtime for Cinco de Mayo. We discussed
- 2:34:10billing and not billing and we were
- 2:34:12going to cover some, not some. We were
- 2:34:14going to cover the parade but bill for
- 2:34:15the event. What did we decide on that?
- 2:34:17And was it going to be able to go back
- 2:34:19to ELTAC or were we waiting another
- 2:34:20year? I don't have a definitive answer.

- 2:37:42Maria harassing you outside had anything
- 2:37:45to do with it. Just like Maria and Vicki
- 2:37:47harassed Gdeton and called her a piece
- 2:37:49of trash. Just like they harassed

- 2:37:57blame you. But um I want your decision

- 2:38:22decided. That's no here or there. The
- 2:38:26point is is to be fair and in the best
- 2:38:27interest of the city. And Julie, if
- 2:38:30you're listening, I hope that you really
- 2:38:32ask them what they're going to be saying
- 2:38:34about you, considering you never had the
- 2:38:36opportunity to bring it up and they
- 2:38:39never discussed it with you. To me,
- 2:38:41you're being slapped in the face and
- 2:38:43that's wrong and that's unfair.
- 2:38:46I think your decisions have been
- 2:38:47reckless and they have not been planned
- 2:38:50out
- 2:38:51and I don't understand your reasoning
- 2:38:53behind it. Thrasto, you have talked more
- 2:38:57in trying to bring Mike back than you
- 2:38:58have any action. And Mike already has a
- 2:39:00job. He's working in Echo, Oregon. It
- 2:39:03sounds like he's moved on. Maybe we
- 2:39:05should, too. So, the situation that you
- 2:39:08guys have put us in is we had no clerk
- 2:39:09with no plan. We have no attorney with
- 2:39:12no plan. Well, if that isn't allegations
- 2:39:15of malfeasants, misfeasance, and
- 2:39:16violation of your oath of office, I
- 2:39:18don't know what is. So, I know what you
- 2:39:21guys can do. But I do know what this the
- 2:39:24community and I can do and I've been
- 2:39:26reaching out to the community. We are
- 2:39:28going to be having a meeting the
- 2:39:31community about a recall. Your decisions
- 2:39:34have been poor, well judged and biased.
- 2:39:38Maria is not your boss when you sit in
- 2:39:41that chair, but you have let her be. So
- 2:39:45you make your decisions and we can make
- 2:39:47ours. So for those of you listening, we
- 2:39:50haven't reached out to all of you yet.
- 2:39:52But yes, you've asked us for a few times
- 2:39:54now. We are going to start the process
- 2:39:56of recall. We notifying you when we're
- 2:39:58meeting and I've reached out to those
- 2:40:00individuals that are interested in
- 2:40:02funding this and so we will be taking
- 2:40:04this to recall. I wish us all the best
- 2:40:06of luck and maybe through this process
- 2:40:08we can come to the middle and finally

- 2:41:12she didn't think she would get done in
- 2:41:14time, but she asked me if I could sign
- 2:41:17her up.

- 2:41:22>> Okay. Okay, then we'll just go ahead and
- 2:41:26>> here.

- 2:41:36>> Here you go. I know it's been a long day
- 2:41:39for you guys.
- 2:41:40>> You made it.
- 2:41:41>> Me, too. My name is Sis Canard and I'm a
- 2:41:44resident of Sunnyside.
- 2:41:46Maybe you're familiar with my name. I
- 2:41:49run a small cat res rescue in order to
- 2:41:52do my part to assist the city with
- 2:41:55animal control. Or maybe you know me
- 2:41:58from the food bank
- 2:42:00that I have volunteered at regularly for
- 2:42:02nearly 10 years. Or maybe you associate
- 2:42:06me with the neighborhood watch program I
- 2:42:09support to help have safer
- 2:42:12neighborhoods. Or maybe you're familiar
- 2:42:14with my having served with the former
- 2:42:18park and wreck commission that tried
- 2:42:20very hard to improve soccer
- 2:42:21opportunities for children and started
- 2:42:25with the first group of pickle ball
- 2:42:27players.
- 2:42:28Or maybe you know me from the Sunnyside
- 2:42:30Museum and the and historical
- 2:42:32association and our efforts to preserve
- 2:42:34the artifacts of Sunnyside by funding
- 2:42:37and building a $192,000
- 2:42:41building. the association then gave to
- 2:42:43the city. Or maybe it's my work as an
- 2:42:46elder at my church, Sunnyside First
- 2:42:48Baptist. Or maybe my application to fill
- 2:42:52an unexpected vacancy on the Sunnyside
- 2:42:55School Board. Or maybe just simply my
- 2:42:58attendance at city council meetings. I
- 2:43:01hope you do know my name because I want
- 2:43:04you to know that I am here with no
- 2:43:07personal agenda. I am here because I
- 2:43:10believe that if you are not part of the
- 2:43:13solution, you are part of the problem.
- 2:43:15And I long to be proud of Sunnyside.
- 2:43:20I watched the special meeting that was
- 2:43:22held April 21st.
- 2:43:24I could feel the dissension through my
- 2:43:27computer screen.
- 2:43:29I am a former business owner for more
- 2:43:31than 40 years, employing many people,
- 2:43:34some for as long as 25 to 28 years.
- 2:43:38Continuity
- 2:43:39in the administration of an operation
- 2:43:43is the result of mutual respect and
- 2:43:46sharing a common goal that is good for
- 2:43:50the whole.
- 2:43:52The meeting left me thinking,
- 2:43:55if the city were a car,
- 2:43:58the wheels would fall off and the engine
- 2:44:00would fail before it gets to the next
- 2:44:02exit.
- 2:44:04If it were a marriage, it would be
- 2:44:06heading to for a divorce court. And if
- 2:44:09it were a human, it probably is
- 2:44:12terminal.
- 2:44:13A combination of financial problems,
- 2:44:16lack of qualified individuals in
- 2:44:18critical positions, and a low level of
- 2:44:21community confidence is a prescription
- 2:44:23for failure. Anyone who knows me knows I
- 2:44:29am a good finder
- 2:44:31generally with a very positive attitude.
- 2:44:34I was left last week discouraged and
- 2:44:38ready to call in the state or anyone.
- 2:44:43I am here to ask the council
- 2:44:47to search your heart. Do the right
- 2:44:50thing. Stop the hamster wheel
- 2:44:54and make a motion to have a forensic
- 2:44:57audit. Get to the bottom of your
- 2:44:59problems and stop trying to put a
- 2:45:02band-aid on a virus.
- 2:45:04Financial problems,
- 2:45:06>> any inaccuracy,
- 2:45:07>> Miss Canard,
- 2:45:10your time's up.
- 2:45:12>> Thank you. Um, she can, if she has it
- 2:45:16already down, she can submit it. Yeah,
- 2:45:18you can also submit your public comment
- 2:45:20if you email it to to the entire council
- 2:45:23>> or if you have it here, we can we can
- 2:45:25take it.

- 2:45:46Next up is Marisella Santana.
- 2:45:55>> Good afternoon, city council members and
- 2:45:58staff. Uh my name is Marisella Santana.
- 2:46:01I'm the environmental justice
- 2:46:02coordinator for AYA. And this May's
- 2:46:05first, Aya, alongside other partner
- 2:46:07organizations,
- 2:46:09we'll be hosting a Mayday to honor all
- 2:46:11our workers in our community. This day
- 2:46:15is dedicated to our essential workers,
- 2:46:17including farm workers, truckers,
- 2:46:19daycare providers, teachers, and so many
- 2:46:22others
- 2:46:24that work so hard to feed school,
- 2:46:27provide free resources, and build a safe
- 2:46:29and supportive community. This march
- 2:46:32will start at 2 p.m. with the Mayday
- 2:46:34Action to support workers at Woodmill
- 2:46:37Farms. And then at 3:30 p.m., we will
- 2:46:39begin our Mayday March at the South Hill
- 2:46:41Park in Sunnyside. This march is led by
- 2:46:44our local youth and adult advocates that
- 2:46:47have worked so hard to support this
- 2:46:49march and the workers in our community.
- 2:46:52After the march, we will have a
- 2:46:53community celebration starting at 4:30
- 2:46:56p.m. with a welcoming performance from
- 2:46:59SATali a dance team connecting us with
- 2:47:03our indigenous roots and honoring those
- 2:47:06who have become have who have become
- 2:47:08before us. We will have free children's
- 2:47:11activities, food vendors, youth singers,
- 2:47:14and balo chlorico.
- 2:47:16Um, we also will have a free community
- 2:47:19raffle and over 15 resource tables
- 2:47:21including services and information
- 2:47:23around children, education, health,
- 2:47:26voting registration, assistance for
- 2:47:28disability, legal aid, environmental,
- 2:47:31and so much more. We really invite um
- 2:47:34the whole community as well as city
- 2:47:36council to come out build relationship
- 2:47:38with community and learn from another
- 2:47:41and also eat really good food. And I'm
- 2:47:43going to hand out some flyers right
- 2:47:44here, but hopefully you could join us.

- 2:48:10>> Bring this all the way down a little
- 2:48:11short. Good evening um everyone. My name
- 2:48:14is Sandra Sati. Um and I just wanted to
- 2:48:16say thank you um to the city of
- 2:48:19Sunnyside you all for allowing us to
- 2:48:21have the event at the Sunnyside
- 2:48:23Community Center. I wanted to share with
- 2:48:24you some
- 2:48:26um data because we did do a survey and I
- 2:48:28always think it's important right to to
- 2:48:30show data at events like these. So we
- 2:48:33did have over a 100red people come in um
- 2:48:36for our college and career um ready um
- 2:48:41and we received 62 surveys. So we had
- 2:48:43students come in with their parents.
- 2:48:44They had a plate of of dinner um thanks
- 2:48:47to Yakama Valley Partners of Education.
- 2:48:49We had Chavez tacos which were really
- 2:48:52delicious. But we did receive 62 surveys
- 2:48:55and these were the responses. We had
- 2:48:57students from Gran View, 10 of them.
- 2:48:59Granger had two students come through,
- 2:49:01Mapton 4, Roser 2, Sunnyside, 44 and we
- 2:49:05even had students from Yakama as well.
- 2:49:07Um actions that were completed, we had
- 2:49:10over 30 financial aid applications
- 2:49:12completed, which I'm super proud of
- 2:49:13that. you know, just getting our
- 2:49:15students into, you know, higher
- 2:49:17education and receiving the, you know,
- 2:49:19the help into um doing their financial
- 2:49:22aid completion. Um 14 students were able
- 2:49:26to do admissions process. Um 10 of them
- 2:49:29left with coming in needing their next
- 2:49:32steps and didn't know what their next
- 2:49:33steps were and 10 of them left knowing
- 2:49:35exactly what their next steps were. And
- 2:49:38we had um
- 2:49:4116 um that secured contact information
- 2:49:44to their schools so they can connect
- 2:49:45with their with their school um that
- 2:49:47they're wanting to attend. And then we
- 2:49:49had 13 others that said they left, you
- 2:49:52know, feeling connected um and also
- 2:49:56completion of high school um
- 2:49:57equivalency. So we also had information
- 2:50:00on like our GED programs. Um, we also
- 2:50:03had students that connected with our
- 2:50:05trade schools, which was eight, and 37
- 2:50:08overall connected with um, universities.
- 2:50:11So, we did have students that connected
- 2:50:13with financial aid and scholarships. So,
- 2:50:17we rated, you know, out of five, we got
- 2:50:19a rating of 4.8, which I'm super happy.
- 2:50:23And so, thank you all. Again, this was
- 2:50:25the first time doing this for the
- 2:50:26community. Um, it's meeting our our
- 2:50:29families where they're at, right? And I
- 2:50:30just really want to thank you all for
- 2:50:32allowing us to um use the facility of
- 2:50:35the Sunnyside Community Center and I
- 2:50:36hope that we can continue to partner. Um
- 2:50:38thank you to Sunnyside School District.
- 2:50:41Um my board members that supported the
- 2:50:43event. Thank you all. Um Sunnyside was
- 2:50:46able to Sunnyside School District was
- 2:50:48able to provide 15 laptops so they
- 2:50:51students you know had where to sign up.
- 2:50:54Um and then Yakama Valley Partners for
- 2:50:56Education was able to provide the
- 2:50:58dinner. I do want to give a shout out to
- 2:51:00the council members that showed up. I
- 2:51:01really appreciate it. And Hector, thank
- 2:51:04you very much. I I I feel like for the
- 2:51:07art commission and even this event, I've
- 2:51:08had him kind of like running around. And
- 2:51:10so, Hector, thank you so much for your
- 2:51:12help. You're you're awesome. Um, any
- 2:51:14questions that I have or anything, he
- 2:51:16always comes through. So, um, Hector is
- 2:51:19a person I really want to give a shout
- 2:51:20out to because he's he's been able to
- 2:51:22help support not just this event, but
- 2:51:24our arts commission as well. So, thank
- 2:51:27you
- 2:51:29Hector.

- 2:52:18council agreeable to extending the time
- 2:52:21for the council meeting 10 minute like
- 2:52:24another 10 minutes 15 minutes to be
- 2:52:26safe.
- 2:52:27>> Okay. I will note that we will be going
- 2:52:29into executive session for 10 minutes
- 2:52:32starting um starting with 10 minutes um
- 2:52:35uh reading RCW4230.11
- 2:52:39subsection 1 I discussion with legal
- 2:52:41counsel representing the agency
- 2:52:42regarding pending claims or litigation.
- 2:52:45There should be no action expected after
- 2:52:48the council uh after the executive
- 2:52:50session and I will go ahead and recess
- 2:52:53us into the executive session at 8:52
- 2:52:56p.m. if everybody can please vacate the
- 2:52:58the the chambers for executive session.
